Village Board of Trustees Regular Meeting March 4, 2025 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 4th of March, 2025 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Josh Subin, Village Attorney Christine Dennett, Village Clerk/Assistant Village Manager Pledge of Allegiance Continued Public Hearing to Amend a Special Use Permit and Intent to Declare Lead Agency – Trump National Mr. Rob Good, Geologist, provided a brief review of the memoranda. The Board had general discussion regarding the potential impacts of the wells on the wetlands and the status of the review by the DEC. Mr. Dan Coughlin, representing the Applicant, stated the wetlands were flagged and pumping mitigation was in place. The Board requested the wetlands be reviewed by the Village’s consultant and for the applicant to address the DEC’s letter for the record. Mr. Philip Benza, representing the Applicant, requested the Board provide a list of all information sought so the Applicant could address them. Upon motion by Trustee Netburn, seconded by Trustee Mallett, the Board voted unanimously to adjourn the public hearing to March 25, 2025. Board of Trustees Announcements  Upcoming Registration and Program Information for both the Library and the Recreation Department are listed on the Recreation Department on the website. 1  Upcoming Dr. Seuss Scavenger Hunt at the Library. Visit their site for more info.  Residents are encouraged to volunteer and join the Fire and Ambulance Departments.  The Briarcliff Manor School District passed the Firefighter Tax Exemption.  The Historical Society is doing a presentation on the Croton Dam on March 30th.  Call for Volunteers. Anyone interested should submit a resume and letter of interest through the website or to BOT@briarcliffmanor.gov. Village Manager’s Report  A survey for the Comprehensive Plan is on the website.  A campaign to notify residents of the upcoming change to the speed limits in neighborhoods throughout the Village will soon be underway. Committee Report  No report. Public Comments Mr. Alex Maglietta of 100 Holbrook Road stated he shared a sewer easement with 345 Scarborough Road and to date there had been no resolution to that matter. Ratification of a Memorandum of Agreement between the Village and the CSEA The Board commended the Village Manager and Assistant Village Manager for working with the CSEA to get the contract completed. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby ratifies and approves the attached memorandum of agreement dated February 19, 2025 between the Village and the CSEA. Roll Call: Trustee Netburn Aye Trustee Mallett Aye Trustee Hunt Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Schedule a Public Hearing on a Proposed Franchise Renewal Agreement with Verizon New York Inc 2 The Board thanked Trustee Hunt for all his work on this along with the Village Manager and Special Counsel. Upon motion by Trustee Hunt, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Meeting is hereby scheduled for the March 25, 2025 Board of Trustees meeting at 7:30pm at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed franchise renewal agreement with Verizon New York Inc. Presentation of Revised Project Plans and SEQR Draft Scoping Document prepared for Briarcliff Solar, LLC – 345 Scarborough Road Mr. William Null, Attorney for the Applicant, gave an overview of the draft scoping process and the proposed changes. He stated they were not proposing a BESS but had to list it as an alternative as a requirement of the process. He further stated they were willing to relocate the shared sewer line at the Applicant’s full expense. He requested a scoping session be scheduled. A representative from Langham Engineering on behalf of the Applicant reviewed the site disturbance and different options. Mr. Glen Rossman of 120 Holbrook Road stated he had no notice of the meeting and the application greatly impacted his property. Village Planning Consultant, Sarah Yackel, explained the Scoping Session and review of the draft Environmental Impact Statement. Mr. Alex Maglietta of 100 Holbrook Road stated he was concerned with the BESS listed in the draft document and it was not in keeping with the neighborhood. Trustee Mallett requested a timeline and table of the process be provided and asked Counsel to prepare a memorandum. Ms. Yackel offered to give a SEQRA presentation. Mr. Sal Maglietta of 217 Schrade Road noted there were moratoria all throughout the State on BESS. Ms. Yackel noted part of the requirement is to provide alternatives. Mr. Null noted that the Applicant was financially able to move forward with the solar farm proposal and did not want to do a BESS but provided it as a required alternative. 3 Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to schedule the Scoping Session for Briarcliff Solar, LLC located at 345 Scarborough Road for Tuesday, April 1, 2025 at 7:30pm or as soon as practicable thereafter with the necessary referrals and noticing requirements to be done. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, with one abstention by Mayor Vescio, the Board voted to approve the minutes of the February 18, 2024 Regular Meeting.
