Village Board of Trustees Regular Meeting July 1, 2025 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 1st of July, 2025 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Peter S. Chatzky, Deputy Mayor Kevin Hunt, Trustee Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk/Assistant Village Manager Kathryn Nivins, Village Treasurer Josh Subin, Village Attorney Pledge of Allegiance Sustainable Westchester Power Presentation Mr. Noam Bramson of Sustainable Westchester gave a brief presentation on Community Choice Aggregation power choices available for the Board to opt the Village into. Continued Public Hearing to Add Chapter 40, Notifications of Defect Village Counsel Subin explained the proposed legislation. There were no public comments. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to close the public hearing. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: WHEREAS, the Board of Trustees has determined that it is in the best interests of the Village of Briarcliff Manor to adopt a Local Law to add a new Chapter 40 entitled Notification of Defects, to the Village Code to establish procedures for notification and liability relating to certain defects in Village property; and 1 WHEREAS, the adoption of this Local Law is classified as a Type II action pursuant to 6 NYCRR §617.5(c)(20) and (27), and is therefore not subject to further review under the State Environmental Quality Review Act (SEQR); and WHEREAS, a public hearing on the proposed Local Law was duly noticed and held, and all public comments were considered; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby adopts Local Law No. 3 of 2025 to add a new Chapter 40, Notification of Defects, to the Village Code; and BE IT FURTHER RESOLVED, that this action is a Type II action under SEQR and no further environmental review is required. Continued Public Hearing to Amend Chapter 45, Planning Board Deputy Mayor Chatzky explained the proposed legislation. There were no public comments. The Board discussed a section that potentially belonged in another chapter and determined since the section was already written, they’d schedule a separate public hearing for Chapter 190, Subdivision of Land to be held in tandem with the public hearing for Chapter 45, Planning Board. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to adjourn the public hearing to July 15, 2025. Continued Public Hearing to Amend Chapter 220-2, Definitions and 220-10, Affordable Housing Deputy Mayor Chatzky explained the proposed legislation. There were no public comments. Upon motion by Deputy Mayor Chatzky, seconded by Trustee Hunt, the Board voted unanimously to adjourn the public hearing to August 5, 2025. Board of Trustees Announcements  Summer Camp is underway and the Recreation Department is doing a great job running the program.  Kids Crochet Club begins soon. Details on the Library website.  Volunteer to join the Fire Department and Ambulance Department. Village Manager’s Report  Briarcliff Bash at the Club on July 11th at 6pm.  The Library is moving for a cool reason! Their HVAC system is being redone. 2  A survey is out regarding the pool. Due by July 10th.  There have been some recent bear sightings. Secure trash bins and don’t leave bird feeders out if possible.  Some pickleball court repairs will occur soon. Committee Report  No report. Public Comments Mr. Charles Blowe of Colby Lane gave a shout out to camp for a great first few days. He stated the camp required a lot of logistics and the Recreation Department did a fantastic job. Sleepy Hollow Country Club Tax Certiorari Village Treasurer Nivins explained the timeline of the filing. Mr. Charles Blowe of Colby Lane thanked the Board for attempting to do a good faith settlement and gave a hats off to the Treasurer for holding it on the books to reduce the liability to this year’s budget. Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: WHEREAS, Sleepy Hollow Country Club (Parcel ID’s: 105.09-1-1, 104.16-1-10, 104.16-1-7, 104.12-1-1, 104.11-1-41, and 104.08-1-51) instituted tax certiorari proceedings pursuant to Article 7 of the Real Property Tax Law of the State of New York; and WHEREAS, the tax certiorari filings were initially for Town of Ossining assessment years 2012 through 2019, which relate to Village of Briarcliff Manor fiscal years 2012-2013 through 2020-2021; and WHEREAS, a Judgment of the Supreme Court of the State of New York, County of Westchester, was entered on March 16, 2021, after the finalization of the Village’s Fiscal Year 2020-2021 budget; and WHEREAS, the Order was subsequently appealed; and WHERAS, upon appeal the Village offered payment of the Judgment in order to stop any accrual of interest; and WHERAS, said payment was refused; and WHERAS, upon appeal a negotiated settlement as occurred lead by the Town (Consent Judgment); and 3 WHEREAS, the Consent Judgment includes interest in the amount of $24,250.48 and expands the assessment years under review to include 2020, 2021, 2022, 2023, and 2024, which affect Village Tax Years 2021-2022, 2022-2023, 2023- 2024, 2024-2025, and 2025-2026 respectively; and WHEREAS, Assessment Year 2024 (impacting the 2025-2026 Village Tax Year) was already adjusted in the final assessment roll received from the Town of Ossining, requiring no additional refund or adjustment for that year; and NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby authorizes the total refund of $180,476.89, comprised of $156,226.41 in principal and $24,250.48 in interest (as previously calculated through April 5, 2023 with an included discount of 12%), for Village Fiscal Years 2012-2013 through 2019- 2020, to be charged as follows: A.0601 – Accrued Liabilities: $180,476,89 Roll Call: Trustee Hunt Aye Trustee Netburn Aye Deputy Mayor Chatzky Aye Mayor Vescio Aye Acceptance of Fee Court as Village Road and Right of Way Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution as amended: WHEREAS, Pacwater Corporation, as developer of the subdivision known as Briarcliff Acres, received final subdivision approval from the Village of Briarcliff Manor Planning Board on January 10, 2006, and a re-approval of said subdivision on April 4, 2017; and WHEREAS, as part of said subdivision, the developer constructed a roadway known as Fee Court, located within the Village of Briarcliff Manor, along with associated roadway improvements including pavement, curbing, drainage infrastructure, and related appurtenances; and WHEREAS, said improvements have been reviewed and inspected by the Village Engineer and determined to be in substantial compliance with the approved plans and specifications; and WHEREAS, Pacwater Corporation has offered to dedicate Fee Court and its associated right-of-way to the Village of Briarcliff Manor for public use and maintenance; and 4 WHEREAS, the Board of Trustees of the Village of Briarcliff Manor has determined that it is in the best interest of the Village to accept such dedication; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby accepts the offer of dedication from Pacwater Corporation of the roadway known as Fee Court and its associated right-of-way, as shown on the filed subdivision plat for Briarcliff Acres, and authorizes the Village Manager to execute any and all documents necessary to effectuate the acceptance and recording of such dedication, subject to the review and approval of the Village Attorney; and BE IT FURTHER RESOLVED, that upon execution and recording of the necessary documents, Fee Court shall be and hereby is established as a public road of the Village of Briarcliff Manor, to be maintained and regulated as part of the Village’s public street system. Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Lydia Sternfeld to the Briarcliff Manor Fire Department. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the membership of Richard Aldrich to the Briarcliff Manor Fire Department. BE IT RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor hereby approves the under 18 membership of Killian McCabe to the Briarcliff Manor Fire Department. Schedule a Public Hearing to Amend Chapter 190, Subdivision of Land, General Design Standards Deputy Mayor Chatzky explained the proposed legislation. 5 Upon motion by Trustee Netburn, seconded by Deputy Mayor Chatzky, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that a Public Hearing is hereby scheduled for July 15, 2025 at 7:30pm in the William J. Vescio Community Center to hear and discuss an amendment to Chapter 190, Subdivision of Land, General Design Standards. Minutes Upon motion by Deputy Mayor Chatzky, seconded by Trustee Netburn, the Board voted unanimously to approve the minutes of the June 17, 2025 Regular Meeting. Adjournment Happy Anniversary to Steve and Jessica Vescio on June 28th and Kevin and Lisa Hunt on July 11th. Free Slurpee’s for all! Upon motion by Trustee Hunt, seconded by Trustee Netburn, the Board voted unanimously to adjourn the Regular Meeting at 8:28pm.
