Village Board of Trustees Regular Meeting October 21, 2025 7:30 p.m. A Regular Meeting of the Board of Trustees of the Village of Briarcliff Manor, New York was held at the William J. Vescio Community Center on the 21st of October, 2025 commencing at 7:30 p.m. Present Steven A. Vescio, Mayor Kevin Hunt, Trustee Rhea Mallett, Trustee/Acting Deputy Mayor Malcolm Netburn, Trustee Also Present Josh Ringel, Village Manager Christine Dennett, Village Clerk/Assistant Village Manager Josh Subin, Village Attorney Kevin Leddy, Village Engineer Absent Peter S. Chatzky, Deputy Mayor Pledge of Allegiance 1030/1050 Pleasantville Road Lead Agency Designation Village Engineer Leddy gave a synopsis of the proposed action. Mr. David Cooper of Zarin and Steinmetz, representing the Applicant, stated a full presentation and renderings would be presented next month. He requested the Board declare their intent to be lead agency for SEQR. Mr. Patrick Normoyle, Applicant, provided a brief recap of where the project is and stated they received positive feedback thus far. Upon motion by Acting Deputy Mayor Mallett, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: LEAD AGENCY DETERMINATION BE IT RESOLVED that the Village of Briarcliff Manor Board of Trustees issues this Notice of Intent for the purpose of determining lead agency pursuant to the requirements of the State Environmental Quality Review Act (SEQRA) and Part 617 (6 NYRR Part 617), the Statewide implementing regulations pertaining to SEQRA. If no written objections are received the Village of Briarcliff Manor Board 1 of Trustees will assume lead agency 30 days after the date of this notice. This notice has been prepared pursuant to Article 8 of the Environmental Conservation Law. Project Title: Briarhouse & Village Justice Center Project Location: 1050 & 1030 Pleasantville Road, Village of Briarcliff Manor, Westchester County, New York SEQRA Type: Unlisted Action Project Description: Briarhouse, LLC (the “Applicant”) has entered into a land development agreement (“LDA”) with the Briarcliff Manor Local Development Corporation (the “LDC”) and the Village of Briarcliff Manor (the “Village”) to develop certain municipal, public, and private residential/commercial improvements on two, Village-owned, tax lots located at 1050 and 1030 Pleasantville Road, tax parcel numbers 98.10-1-51 and 98.14-1-29 respectively (the “Project Site”). The Applicant, per the LDA, proposes to develop the Project Site with a mixed- use, multifamily development consisting of two multifamily buildings with commercial uses on the first floor, together with associated improvements (“Briarhouse”), a Village Police Station and Court Facility with associated parking (the “Justice Center”), and various public improvements and amenities (together, the “Proposed Project”). Briarhouse would be owned and operated by the Applicant and would consist of two buildings, as well as public and residential amenities and parking. The buildings would be 4-stories in height and contain approximately 86 apartments comprised of studio, one- and two-bedroom units, with the first floor of both buildings having approximately 5,440 square feet of commercial space (totaling 10,880 square feet of commercial area). The Justice Center would be retained by the Village and would be two-stories, approximately 13,390 sq ft, and include associated secure and public parking areas. The Proposed Project would also include various public improvements across both properties consisting of a trail system, sidewalks, and other public roadway improvements, in addition to a public plaza that will be a part of the Briarhouse development. The Proposed Project requires various local approvals from the Village Board of Trustees, including the creation of the “Strategic Property Redevelopment Floating Zone,” (“SPR”), mapping the Project Site within that district, and approving an SPR Concept Plan for the Site. Additional local approvals include a lot line adjustment, and, for the Briarhouse project, site plan, wetlands, steep 2 slopes, and tree permit approval, as well as a transfer of ownership from the Village/LDC to the Applicant (the “Proposed Actions”). The Project will also require approval of a SWPPP by the Village. Other approvals for the Project may be required from the New York State Department of Environmental Conservation (freshwater wetlands) and the New York State Department of Transportation (roadway improvements). Vescio Community Center located at 1 Library Road, Briarcliff Manor, New York to hear and discuss a proposed Local Law to Reorder and Reorganize Various Chapters of the Code and Establish Chapter 220-21 Specialty Zones the Code of the Village of Briarcliff Manor. BE IT FURTHER RESOLVED that the proposed local law is hereby directed to the Village Planning Board and Westchester County Planning Board for review and recommendation. 235 Elm Road – Rose Enterprises Group, Inc. Renaissance Briarcliff Manor, 235 Elm Road Public Hearing – (i) establishment of a Downtown Adjacent Planned Unit Development District (220-21.C) and (ii) Preliminary Planned Unit Development approval (“Preliminary PUD Approval”) pursuant to the proposed §220-21.C of the proposed draft legislation Mr. David Steinmetz of Zarin and Steinmetz, Attorney for the Applicant, gave a synopsis of the project and requested the Board refer the application to the Village and County Planning Boards and schedule a public hearing. Mr. Leonard Glickman of Rose Enterprises stated their project website was up and running https://www.renaissancebriarcliffmanor.com/ and stated he wanted to hold a neighborhood meeting on November 17th to answer questions. 3 Mr. Diego Villareale of JMC reviewed the proposed site plan stating they were proposing five single family homes along Tuttle Road, 110 townhomes, trails and sidewalks for connectivity as well as amenities. Mr. Stuart Lachs, Architect for the Applicant, showed proposed renderings. Mr. Steinmetz stated the houses on Tuttle would be custom or privately sold to be developed. He requested the Board also refer them to the Architectural Review Advisory Committee. The Board had general discussion regarding the application. Ms. Maloney from 81 Tuttle Road asked for the timing of the next steps and stated many were not aware this was in motion. She stated she welcomed an open dialogue with the developer. Project Title: Renaissance Briarcliff Manor Project Location: 235 Elm Road, Village of Briarcliff Manor, Westchester County, New York SEQRA Type: Unlisted Action Project Description: Rose Enterprises Group (“Applicant”), contract vendee of the property located at 235 Elm Road (“Property”), is seeking the following approvals from the Village of Briarcliff Manor Board of Trustees (“Board”): (i) establishment of a Downtown Adjacent Planned Unit Development District (§220- 21.C) and (ii) Preliminary Planned Unit Development approval (“Preliminary PUD Approval”) pursuant to the proposed §220-21.C of the proposed draft legislation (“Proposed Action”). The Proposed Action would facilitate the development of the proposed Project, known as Renaissance Briarcliff Manor, which envisions the 4 redevelopment of the vacant 37-acre former Pace University campus into a planned residential community. The proposed project includes 110 townhomes on the campus site and 5 single-family homes along Tuttle Road, complemented by permanent open space, including a publicly accessible walking trail system, landscaped buffers along Elm and Tuttle Roads and a 10-acre preserved wooded area, together encompassing approximately 30% of the Property. The proposed project also provides for residential amenities, including a clubhouse and pool. SCHEDULE PUBLIC HEARING BE IT RESOLVED that a Public Hearing to hear and consider a request by the Applicant for a Downtown Adjacent Planned Unit Development District (§220- 21.C) and Preliminary Planned Unit Development approval (“Preliminary PUD Approval”) pursuant to §220-21.C located at 235 Elm Road is hereby scheduled for Tuesday, November 18, 2025 at 7:30 pm or soon thereafter at the William J. Vescio Community Center located at 1 Library Road, Briarcliff Manor, NY 10510. Continued Public Hearing Chapter 186-7, Streets and Sidewalks, Protection of Existing Facilities The Board had general discussion regarding the draft, requesting revisions and stated they were waiting on further revisions from Special Counsel. There was no public comment. 5 Upon motion by Acting Deputy Mayor Mallett, seconded by Trustee Netburn, the Board voted unanimously to adjourn the public hearing to November 18, 2025. Board of Trustees Announcements  The Ragamuffin Parade will be on October 25th.  The Harlem Magic Masters event is on November 7th. Tickets are available at the Recreation Office.  Election Day is November 4th. Village Manager’s Report  The North County Trail access behind the Library is temporarily closed during the HVAC project. There is still access behind the Youth Center. Committee Report  The Comprehensive Plan Committee is holding a public workshop on November 5th and the draft plan will be available by Thanksgiving. Public Comments There were no public comments. Village Justice Court Annual Auditor’s Report for FY 2024-2025 Village Manager Ringel noted it was a clean audit report completed by a third party. Upon motion by Acting Deputy Mayor Mallett, seconded by Trustee Hunt, the Board voted unanimously to approve the following resolution: BE IT RESOLVED that the Village Justice Court conducted an Independent Audit for Fiscal Year 2024-2025 in accordance with Section 2019-a of the Uniform Justice Court Act. BE IT FURTHER RESOLVED that the Board of Trustees does hereby approve and accept into the record the Village Justice Court Independent Audit for Fiscal Year 2024-2025. Award of Bid – VM2324-14 – Law Park Drainage Phase 2 The Board stated the bids were very competitive and thanked the Village Engineer for his process. They requested the bid tabulations not be included in future packets. Mr. Charles Blowe of Colby Lane asked if the project total was fully grant funded or if there was a cost to the Village. Village Engineer Leddy stated the Village had a matching expense of 50%. 6 Upon motion by Acting Deputy Mayor Mallett, seconded by Trustee Netburn, the Board voted unanimously to approve the following resolution: WHEREAS the Village received 9 bids for the Law Park Drainage Phase 2 Project (VM2324-14); and NOW, THEREFORE, BE IT RESOLVED that the bid for the Law Park Drainage Phase 2 Project (VM2324-14) is hereby awarded to Site Construction Corp. per their bid of $1,398,300.00 from budget code H1440.201.24280; and BE IT FURTHER RESOLVED that the Village Manager is hereby authorized and directed to execute a contract with Site Construction Corp. for said project. Roll Call: Trustee Hunt Aye Trustee Netburn Aye Acting Deputy Mallett Aye Mayor Vescio Aye Chilmark Park SEQR Negative Declaration Chilmark Park Playground and Bathroom Improvements Upon motion by Trustee Netburn, seconded by Acting Deputy Mayor Mallett, the Board voted unanimously to approve the following resolution: WHEREAS, the Board of Trustees of the Village of Briarcliff Manor, Westchester County, New York, is proposing a series of capital improvements at Chilmark Park, located at 48 Macy Road, aimed at enhancing recreation, accessibility, and public amenities; and WHEREAS, the proposed improvements consist of three initiatives as follows: 1) Accessible Playground - the first improvement, supported by a New York State Consolidated Funding Program grant, focuses on the creation of a new accessible playground. This playground will be designed with universal accessibility in mind, incorporating ramps, sensory play elements, and surfaces that are friendly to wheelchairs, strollers, and walking aids. 2) Compostable Toilet Facility - The second proposed improvement, funded by a CREST grant, will replace temporary portable toilets with a permanent compostable restroom facility. These improvements are collectively known as the “Proposed Action”; and 7 WHEREAS, The Village consulted with the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) who conducted a review of the proposed project in accordance with the New York State Historic Preservation Act of 1980 and based on this review, OPRHP, by letter dated September 24, 2025, determined that the Proposed Action will have no adverse impact on historic or archeological resources; and WHEREAS, pursuant to 6 NYCRR Part 617 (“SEQR”) the Project is classified as an Unlisted Action; and WEHERAS, the Board of Trustees of the Village of Briarcliff Manor have conducted an Uncoordinated Review of the Proposed Action under SEQR and is the Lead Agency for the SEQR review of this Unlisted Action; and WHEREAS, the Board of Trustees of the Village of Briarcliff Manor reviewed a Short Environmental Assessment Form (Short EAF) Parts 1, 2 and 3 dated October 16, 2025. NOW THEREFORE BE IT RESOLVED, that pursuant to 6 NYCRR Part 617, State Environmental Quality Review, the Board of Trustees of the Village of Briarcliff Manor hereby confirms its Lead Agency designation for the SEQR Review of the Proposed Action. BE IT FURTHER RESOLVED, that pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, the Lead Agency has determined that the Proposed Action will not have a significant adverse effect on the environment for the reasons enumerated in the attached Negative Declaration Form (Short EAF Part 3). BE IT FINALLY RESOLVED that this SEQR Negative Declaration resolution shall have an effective date of October 21, 2025. Chilmark Park Accessible Playground Grant Acceptance The Board thanked staff and the advocacy of residents for helping to secure the grant. Upon motion by Trustee Netburn, seconded by Acting Deputy Mayor Mallett, the Board voted unanimously to approve the following resolution as amended: 8 RESOLVED, that the Village of Briarcliff Manor applied for financial assistance from the New York State Office of Parks, Recreation and Historic Preservation (“OPRHP”) under the Municipal Parks and Recreation Grant Program through the Clean Water, Clean Air, and Green Jobs Environmental Bond Act of 2022, Article 58, Title 5 of the Environmental Conservation Law, for the purpose of funding the development of Chilmark Park Project #258239, Chilmark Park Accessible Playground; RESOLVED, that Village of Briarcliff Manor is authorized and directed to accept these grant funds in an amount not to exceed $720,000 for Project #258239, Chilmark Park Accessible Playground; RESOLVED, that Village of Briarcliff Manor is authorized and directed to agree to the terms and conditions of the State of New York Contract for Grants ("Contract") with OPRHP for such development of Chilmark Park Project #258239, Chilmark Park Accessible Playground; RESOLVED, that Village of Briarcliff Manor is authorized and directed to agree to the terms and conditions of any required deed of easement granted to OPRHP that affects title to real property owned by the municipality and improved by the grant funds, which shall be a duly recorded Notice of Grant Requirements; and RESOLVED, that the Board of Trustees of the Village of Briarcliff Manor delegates signing authority to execute the Contract and any amendments thereto, any required deed of easement, and any other certifications to the Village Manager or Assistant Village Manager subject to review by Counsel.
