MINUTES REGULAR COUNCIL MEETING BRIDGETON CITY HALL 12355 NATURAL BRIDGE ROAD MARCH 15, 2017 7:00 P.M. The regular Council meeting was called to order by Mayor Terry W. Briggs on Wednesday, March 15, 2017, at 7:00 p.m. in the Council Chambers at City Hall. PLEDGE OF ALLEGIANCE ROLL CALL Present: Abram, Eaker, Fetsch, Grimmer, Hein, Norris, Saettele, Zimmer Absent: None The Mayor noted a quorum present. AGENDA APPROVAL Mr. Fetsch moved, second by Mr. Hein, for approval of the agenda. Motion to approve the agenda carried by voice vote. PUBLIC PORTION There being no one who wished to address Council at this time, the Public Portion was closed. APPROVAL OF MINUTES – MARCH 15, 2017 Mr. Fetsch moved, second by Ms. Eaker, for approval of the Minutes of March 15, 2017. Motion carried by voice vote. APPOINTMENTS/PRESENTATIONS/PROCLAMATIONS/ANNOUNCEMENT/SET PUBLIC HEARINGS Item 1 ANNOUNCEMENT IN EVENT OF ABSENCE Mayor Briggs announced that because all members of Council are present this evening a new item introduced tonight may be acted upon if they choose to do that. REGULAR COUNCIL MEETING MINUTES MARCH 15, 2016 PAGE TWO APPOINTMENTS Mayor Briggs nominated the following individuals to the respective commissions: Joe Buehler Ward 3 Police Commission Jessica Perkins Ward 4 Police Commission Ginger Noblitt Ward 1 Special Events Commission Both Police Commission appointments will become effective on April 1st, pending Council approval. PERFECTION OF BILLS Item 3 BILL 6129 AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF BRIDGETON, MISSOURI AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH GATEWAY FIREWORKS DISPLAYS, IN THE FORM SUBSTANTIALLY ATTACHED HERETO, IN THE AMOUNT OF THIRTY- TWO THOUSAND FIVE HUNDRED DOLLARS ($32,500) FOR FIREWORKS FOR THE CITY’S 2017 FOURTH OF JULY CELEBRATION Mrs. Norris moved, second by Mrs. Abram, for second reading of Bill 6129. Roll Call Vote; AYES: Saettele, Zimmer, Abram, Eaker, Fetsch, Grimmer, Hein, Norris NAYS: None REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE THREE Item 4 BILL 6130 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIDGETON, MISSOURI, (APPLICATION #17-PZ-01) WHICH AMENDS THE BRIDGETON ZONING ORDINANCE, APPENDIX IV-1 PLANNED COMMERCIAL DISTRICT, “B-5(R) 4530 NORTH LINDBERGH BOULEVARD”, TO ADD “MULTI- FAMILY DWELLING UNIT” AS A PERMITTED LAND USE WITH A SPECIAL USE PERMIT IN ORDER TO ALLOW LUXURY APARTMENTS (KAISER HOTELS LLC) Mrs. Abram moved, second by Mrs. Norris, for second reading of Bill 6130. Motion carried by voice vote. Mrs. Abram moved, second by Mr. Saettele, to substitute the Bill 6130 included in the packets in lieu of the original Bill given to Council. This changes the word “Multi” to “Multiple” in the heading and in the first paragraph of the Bill. Motion carried by voice vote. Roll Call Vote: AYES: Zimmer, Abram, Eaker, Fetsch, Grimmer, Hein, Norris, Saettele NAYS: None Item 5 BILL 6131 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIDGETON, MISSOURI (APPLICATION #17-PZ-02) ESTABLISHING A SPECIAL USE PERMIT FOR “MULTI-FAMILY DWELLING UNITS” TO ALLOW LUXURY APARTMENTS LOCATED AT 4540 KAISER PARKWAY (KAISER HOTELS LLC) Mrs. Abram moved, second by Mrs. Norris, for second reading of Bill 6131. Motion carried by voice vote. Mrs. Abram moved, second by Mrs. Norris, to substitute the Bill 6131 included in the packets in lieu of the original Bill given to Council. Motion carried by voice vote. REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE FOUR Mrs. Abram moved, second by Mrs. Norris, that the proposed use set forth in Bill 6131 be determined to promote the health, safety, morals or general welfare of the people of the City of Bridgeton in accordance with and in the accomplishment of the comprehensive zoning plan of the city, taking into consideration the effect of such building or use on traffic conditions, fire safety, the character of the neighborhood, the general welfare of the community and public utilities. Mrs. Abram stated she finds as a fact the proposed use will have no adverse effect on the health, safety, morals or general welfare of the people of Bridgeton with respect to traffic conditions, fire safety, the character of the neighborhood, the general welfare of the community or public utilities and her vote is Aye. Mr. Hein concurs and votes Aye. Mr. Fetsch concurs and votes Aye. Ms. Eaker concurs and votes Aye. Mr. Grimmer concurs and votes Aye. Mr. Saettele concurs and votes Aye. Mr. Zimmer concurs and votes Aye Mrs. Norris concurs and votes Aye. Mrs. Abram moved, second by Mrs. Norris, to suspend Council Rules and remove Bill 6131 from the table. Roll Call Vote: AYES: Abram, Eaker, Fetsch, Grimmer, Hein, Norris, Saettele, Zimmer NAYS: None At this time, Mr. Craig Biesterfeld, filling in for Mr. Linenbroker who was absent, left the meeting because of a conflict of interest involved with the next item. He returned following the vote on the bill. Item 6 BILL 6132 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIDGETON, MISSOURI, TO REDEVELOP APPROXIMATELY 88.83 ACRES OF LAND AT 13930 AND 14120 MISSOURI BOTTOM ROAD PURSUANT TO A REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE FIVE REDEVELOPMENT PLAN SUBMITTED IN ACCORDANCE WITH CHAPTER 145 OF THE CITY OF BRIDGETON MUNICIPAL CODE AND PROVIDE TAX ABATEMENT IN ACCORDANCE WITH CHAPTER 353 OF THE REVISED STATUTES OF MISSOURI (DAVIDSON REALTY V, LLC) Mr. Fetsch moved, second by Mr. Hein, for second reading of Bill 6132. Mr. Fetsch moved, second by Mr. Hein, to substitute the Development Agreement distributed this evening for the one previously attached to the bill. Motion carried by voice vote. Ms. Eaker moved, second by Mr. Saettele, to suspend Council Rules to recognize the attorney for the City, Mr. Tom Addis. Motion carried by voice vote. Mr. Addis briefly explained the changes in the new agreement and answered questions from members of Council. It was stated that at a meeting with representatives of the Pattonville Fire Protection District, they agreed to the final agreement. Roll Call Vote: AYES: Eaker, Fetsch, Grimmer, Hein, Norris, Saettele, Zimmer, Abram NAYS: None CONSIDERATION OF NEW BILLS Item 7 BILL 6133 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIDGETON, MISSOURI, (APPLICATION #17-PZ-03) GRANTING THE MINOR COMMERCIAL SUBDIVISION KNOWN AS “LOVE’S BRIDGETON” TO SUBDIVIDE 22.49 ACRES INTO TWO (2) LOTS ZONED “B-5(S) 13945 MISSOURI BOTTOM ROAD” PLANNED COMMERCIAL DISTRICT, LOCATED AT 13945 MISSOURI BOTTOM ROAD (A FINAL PLAT) (LOVE’S TRAVEL STOPS AND COUNTRY STORE) Mrs. Abram moved, second by Mrs. Norris, for first reading of Bill 6133. Motion carried by voice vote. REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE SIX DISCUSSION Item 8 STREETS Mr. Fetsch stated it was nice having Fee Fee opened both ways and it looks very nice. Item 9 DESIGN AND REVIEW BOARD VARIANCES Mr. Fetsch stated that the Design and Review Board and some members of Council have indicated the Sign Ordinance needs to be reviewed. He was informed that some cities do not allow variances, but he found that is wrong. They all have a board that reviews appeals, but it is not always the Council. Some even go to the Board of Adjustment. In order to reduce the number of requests for variances that Council receives, perhaps the administration could look at some revisions and bring them to Council for changes if they feel it is necessary. Some members of Council said they want Council to have the authority to decide what should be or should not be allowed; this should not be done by the administration. The main variance that comes before Council involves the size of signs; maybe this should be increased. Also electronic boards are not a part of the Sign Ordinance. Item 10 LANDFILL Ms. Eaker announced a meeting tomorrow evening at 6:30 p.m. at John Calvin Church. ATTORNEY’S REPORT Mr. Biesterfeld had nothing to report at this time. COUNCIL COMMUNICATIONS Ms. Eaker reported the Historical Commission has been having activities the first meeting of the month. They have had some members going through the house and cleaning it. As a result, they have found things they don’t need anymore. They have decided to have a “Spring Cleaning Day Sale” on April 1st at the Payne Gentry House. REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE SEVEN Mr. Grimmer stated he saw Jeff Homsher, who recently opened a business in Bridgeton and was told by him how nice it was to be in Bridgeton. Everyone has treated him very well and it’s a pleasure to have a business here. Mr. Hein said the Beautification Commission discussed changing the name “ Holiday Lighting” to “Christmas Lighting” Also, some old street banners were found in the old Recreation Center that used to hang along St. Charles Rock Road and they would like to use them on Natural Bridge. Mrs. Abram reported they had a subcommittee meeting on Council Rules last week. She will have the changes for everyone at the next meeting. One thing they suggested is that all members of Council contact Department Heads with their various concerns or items to be addressed in the City. This would help to shorten Council meetings; the reports from the staff sent to each member of Council has helped tremendously. Mrs. Norris reported she attended the Business Watch meeting this morning and it was very interesting; the laser scanner which was introduced at the meeting will be a great asset to the City. She announced the Kiwanis Pancake Breakfast on April 9th and the Prayer Breakfast is May 4th. MAYOR’S REPORT Mr. Gunn reported there is more street work to be done at Old St. Charles and Fee Fee by the Steak and Shake (tearing out concrete). Mr. Siemsglusz reported the pool packs change order is going very well; the project should be completed in another week. As far as Senior Citizen Funds, they had 870 residents receive $81,500. This is down about 10% from the past. They budgeted about $92,000 so this is within budget. Mr. Siemsglusz stated that relative to the banners, the problem was with Ameren, not MoDOT. Chief Hood reported the Business Watch meeting went very well. The FARO 3D X130 Laser Scanner has multiple applications for use in forensic evidence evaluation, crime scene diagraming, and serious traffic crash investigations. It provides fast, straightforward and accurate measurements of objects, structures, accident sites and crime scenes. The data is then loaded into software and displayed as a three dimensional to scale representation of the environment captured. REGULAR COUNCIL MEETING MINUTES MARCH 15, 2017 PAGE EIGHT Chief Hood also invited everyone to attend a free weather course on March 23rd at the Bridgeton Recreation Center. The Police has partnered with the National Weather Service to host a Severe Storm Spotter/Weather Safety class. No registration is required. There will be a Drug Take Back program on April 29th, from 10:00 a.m. to 2:00 p.m. Mayor Briggs concurred that the Business Watch program today was very good. He also announced that the property value in Bridgeton has increased in value by 8%. The abatement on the St. Louis Hotel is continuing and because the cost has been much higher than anticipated by the developer, the developer may only build a surface parking lot on that site in the beginning.
