PRIVILEGE OF THE FLOOR (AKA Public Comment) - no public comment this evening. PLANNING AND DEVELOPMENT ITEMS: Swank & White rezoning request Ord. 8.17.2023-14 Second reading and public hearing  Danny Dean from the Elkhart County Planning & Development and Mae Kratzer, planning director explained that there was no recommendation from the planning commission regarding the NW side of SR 120 , not so much with what was presented but in the way it was presented. Chris Godlewski, Abonmarche 315 W Jefferson Blvd, South Bend, representing Matt Schneider, contractor from Ancon and Cory White, Developer, noted that all developmental standards for multi-family need to be met. Cory - addressed most of the concerns. Rezoning from R1 to R3 and then move on to DPUD step. Public hearing opened on Ordinance No. 8-17-2023-14. Hearing no public comment, the public hearing was closed.  Motion made for second reading and final approval of Ordinance No. 8/17/2023-14 by Doug DeSmith, Seconded by Gregg Tuholski. Permission to sell surplus equipment: Ford 150 pick-up, VIN 2FTRF17204CA29872, 77,822 miles  Motion for permission to sell surplus F150 equipment at auction made by Gregg Tuholski, Seconded by Cathy Burke. TOWN MARSHAL Mike Albin Bristol Police Department July Operations Report reviewed Thanks to the community during the homecoming. Special thanks to New Life church volunteers. Code enforcement report – Randy Cripe, code enforcement officer has been extremely busy this month and if we have people in need of assistance, they would like to help find resources to do just that. Marshal Albin gave a public thank you to Randy for what he does. FIRE CHIEF Nik Kantz Bristol Fire Department Operations Report reviewed Still short one full time firefighter/EMT cardboard boat race participant in the United Way fundraising event this year, 3:00 on Friday Zoning approval came thru for the new training center, hoping to be up and running by September. Car show this weekend in Congdon Park and preparations for the corn dog festival in September. PARK BOARD Linda Powell Sarah Burton visited the meeting from The Hub to give a brief overview.  Healthy Life Nutrition, Juana Gomez, requested use of Hermance Park for exercise two nights each week. Tuesday and Friday. promotion of better health. Mike Yoder discussed pedestrian bridge. Jill Swartz discussed location change for the girl scouts inspirational rock garden to the memorial area. Sign for the project is on the way. Kristen Ploeger was on vacation, but supplied a report. Requested additional trash cans, park board to further discuss. She also attended back to school night at Bristol Elementary on August 15 to inform everyone of upcoming events. Saturday, August 26, St. Joe River clean up 9:30-12:30 public invited to meet at Congdon Park, bring work gloves, bottle of water, floatation device if going in the river. Congdon Park - car show, additional picnic tables have been added, Hermance Park - Mike Ropp, Park Board member will be planting native Indiana plants in 2024 Cummins Park - poison ivy discovered in several locations New Business: Park rental agreements – need to add an age requirement of 21 years of age or older Plans for an Arbor Day tree planting, location tbd Working on the DNR application for the handicapped kayak launch Next Park Board Meeting will be Tuesday, September 12, 2023 at 6pm at the Town Hall. TOWN ATTORNEY Alex Bowman Fiscal plan voluntary annexation R8-17-2023-17 Alex gave a brief overview, followed by discussion.  Motion to accept R8/17/2023-17 Adopting a Fiscal Plan for the Annexation of Certain Territory into the Town of Bristol, Indiana made by Cathy Burke, Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski. Motion carries. Voluntary annexation Ord. 8/17/2023-15 second reading  Motion to approve Voluntary Annexation Ordinance 8/17/2023-15 on second reading made by Doug DeSmith, Seconded by Gregg Tuholski. Voting Yea: Doug DeSmith, Andrew Medford, Cathy Burke, Gregg Tuholski. Motion carries. Ord. 8.17.2023-16 G.O Bond 2nd reading Second reading of Ord 8/17/2023-16 presented by Attorney Scott Frissell Scott gave a brief overview of the Ordinance. This Ordinance approves the issuance of General Obligation Bonds which will fund the purchase of a new fire truck and complete certain improvements to Main Street and assist with construction of the pedestrian bridge. The bonds will be paid for with tax revenues. $1.6M will not exceed an interest rate of 6% and not to exceed 10 years. They will be sold to the IBB under the community funding resource program. A public hearing was opened, hearing no public comment the public hearing is closed.  Motion to approve Ordinance 8/17/2023-16 authorizing the issuance of General Obligation Bonds made by Gregg Tuholski. NO NEW BUSINESS NO UNFINISHED BUSINESS TOWN COUNCIL DISCUSSION ITEMS: Doug DeSmith – no comments Cathy Burke – no comments Gregg Tuholski – asked what do we have to do about ‘junk’? Marshal Albin addressed this first by stating that Junk and Abandoned Vehicles are defined in our ordinance, but junk in yards/trash of no value/one person’s junk is another person’s treasure/definition is to be determined. It was suggested that it be discussed with our code enforcement officer, Randy Cripe and have him investigate and see it there is anything within the existing ordinances. If not, he would have to bring it back to the Council for approval of any changes. Mike Yoder added that he had recently had a discussion with Himco about a secured space, operated by Himco for recycling or other ‘treasures’ that may need to go to the landfill.
