TOWN COUNCIL REGULAR MEETING Thursday, August 15, 2024 at 7:00 PM Council Chamber Bristol Municipal Complex MINUTES CALL MEETING TO ORDER Council President Jeff Beachy called the Thursday, August 15, 2024 Council Meeting to order at 7:00pm PLEDGE OF ALLEGIANCE was led by Dean Rentfrow ROLL CALL Members present: Doug DeSmith, Dean Rentfrow, Gregg Tuholski Absent: Cathy Burke Others in attendance: Town Manager, Cathy Nik, alex, steve Town Marshal Steve Priem, Legal Counsel Alex Bowman, Clerk-Treasurer Cathy Antonelli, Town Manager Mike Yoder, Fire Chief Nik Kantz APPROVAL OF AGENDA stands as published. President’s note: One of our former council members Delbert Schrock passed away on July 14, 2024. Delbert was on Council for two or three terms. He was a good member of the Council and served the community well. A moment of silence was held in honor of his community serivce. APPROVAL OF INVOICES  Motion to approve the invoices made by Doug DeSmith, Seconded by Dean Rentfrow. Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy APPROVAL OF MINUTES Approval of work session minutes of August 13, 2024  Motion to approve the minutes made by Gregg Tuholski, Seconded by Doug DeSmith Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries. PLANNING AND DEVELOPMENT ITEMS REPORTS TOWN MANAGER Mike Yoder Wastewater project pay applications and task order approvals presented by Andrew Robarge and Jeremy of Commonwealth. Commonwealth now has a South Bend office. 6% completion of project to date. Brief review of the disbursement request process, recommendation to Counsel for consideration. 5% of each payment is held for retainage. SRF disbursements 6,7,8 and 9 and a task order. (extension to their contract) Andrew also reviewed the billing terms. Four checks and an authorization to amend the contract. SRF 6 Bose McKinney $1,319 SRF 7 Dentons Bingham $3,741 SRF 8 Crosby Construction $593,940 (retainage $31,260) SRF9 Commonwealth $31,231 Task order $440,000  Motion to approve the disbursement requests 6,7,8,9 for the WWTP project (as listed above) Jeff Beachy, Seconded by Doug DeSmith.Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries.  Motion to approve amended task order 2024-02 extension (also listed above) made by Doug DeSmith, Seconded by Dean Rentfrow.Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries. Project Updates - Property Clean Up May start up tomorrow, site access issues with INDOT. - approval from park board on splash pad. John Young to totally reconstruct splash pad. Phase one, new surface and drainage, but may need a second phase in order to treat the water. May need a smaller pump and tie into the museum or have a new lift station. High hopes for the drainage solution to resolve all issues and consider broom finish for less slippage. Commerce drive sign not ready to be moved into the budget. - Commerce Drive Sign currently on hold. CLERK-TREASURER no report this evening TOWN MARSHAL Steve Priem Marshal Steve Priem reviewed the July, 2024 Operations report. Bristol Homecoming was success and there were no issues. Bid packet presented for new cars, includes three bids. (City Ford, Eby Ford & Rochester Ford) Rochester Ford came in with the lowest bid, thus recommended to Council for the budgeted vehicle. $49,210 vendor for build sheet and radar also included. Local vendor to be used for striping.  Motion to approve the purchase a 2025 vehicle from Rochester Ford made by Dean Rentfrow, Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries. Introduction of Chandler Pittman. He is our new patrol officer in training. He worked for Wakarusa on their Reserves team. Dustin Lundgren recently promoted to the Chief Deputy position. Dustin came to Bristol from the Elkhart County Sheriff’s Department and has been with us for eight years and holds many certifications. Jeff Beachy welcomed to Chandler to the team with wishes of many years of service and congratulations to Dustin. Appreciate the leadership that you’ve given to the department, especially as of late. Jeff also thanked Steve and the department for all they do and for protecting our town. FIRE CHIEF Nik Kantz Fire Chief Nik Kantz reviewed the July, 2024 Operations report. Still short staffed, may be down three staff members by the end of October. August 16, the fire department is participating at the United Way cardboard boat race at LaSalle Bristol. AJ Robertson put the boat together, hoping to take first place again this year. Racing about 3:00. Will also be at the Car show this Saturday and corn dog festival next month. Jeff Beachy thanked Nik and Jimmy for all that they do for us and offered prayers for their safety. PARK BOARD No report this evening TOWN ATTORNEY Alex Bowman Second Reading re-amending Ordinance No. 8-15-2024-21 Amending Sections of Title V of the Code of Ordinance for the Town of Bristol, Indiana. IDEM has requested these changes. Legal Counsel recommends Council to approve.  Motion to adopt Ordinance No. 8/15/2024-21 made by Doug DeSmith, Seconded by Gregg Tuholski. Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski. Motion carries. Resolution No. 8/15/2024-7 Adopting a Fiscal Plan for the Annexation of Certain Territory into the Town of Bristol, Indiana – Legal Counsel Alex Bowman reviewed the plan, noting that the Town will have certain obligations to provide services in a certain amount of time and recommends Council approval.  Motion to adopt Resolution No. 8/15/2024-7 made by Gregg Tuholski, Seconded by Doug DeSmith. Open for discussion: Jeff stated Section 1C, (Abby’s property up North) current zoning is R1 & A1 (residential and agricultural) proposed zoning is R1 & M1. Community prefers not to have manufacturing in this area. This does not mean it’s being rezoned, but we need to stay cognizant of this. Mike Yoder notes there are no planning requests at this time. Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries. Second reading of Ordinance No. 8-15-2024- 19 Voluntary Annexation Petition Ordinance No. 8/15/2024-19 annexing Certain Territory and Declaring the same to be a part of the Town of Bristol Indiana.  Motion to adopt Ordinance No. 8.15.2024-19 made by Dean Rentfrow, Seconded by Doug DeSmith. Voting Yea: Doug DeSmith, Dean Rentfrow, Gregg Tuholski, Jeff Beachy. Motion carries. Legal Counsel Alex Bowman made a note to clarify a comment from Tuesday night’s meeting regarding the property to be cleaned up and speaking to the notice issue, it has been resolved and we will move forward. Town Manager Mike Yoder noted a second annexation that is in process. The fiscal plan is not yet completed, but hope to present at the September 5 meeting.
