CITY OF BRISTOL, TENNESSEE MINUTES OF THE BEER BOARD MEETING HELD AUGUST 10, 2016 BOARD MEMBERS PRESENT CITY EMPLOYEES PRESENT Mr. Craig Kistner – Chairman Capt. Glenn James Mr. Mike Ketron – Vice Chairman Ms. Danielle Kiser Mr. Walt Vernon Ms. Robin Stedman Mr. Vince Turner Call to Order – At approximately 5:00 pm on August 10, 2016, Mr. Kistner, Chairman of the Beer Board for the City of Bristol, Tennessee, called the meeting to order in the Conference Room of the Ewell L. Easley Municipal Bldg., located at 104 Eighth St., Bristol, Tennessee. Review of Minutes – Board Members reviewed the minutes of the July 20, 2016 meeting, the minutes were approved as read. NEW BUSINESS The Last Lap, 2800 Hwy 11E, Bristol, TN – Mr. Brandon Rogers appeared before the Board to request a renewal of their Temporary Permit. Capt. James advised they have held the Permit for several years in the same location, no violations and no problems have been noted. Mr. Kistner called for questions/comments from the public, there being none he called upon the Board. Mr. Turned made a Motion to approve the Application, seconded by Mr. Ketron. There being no further discussion Mr. Kistner called for a vote, the Motion was approved by unanimous vote. Martin’s K P Duty, 12 & 14 Bank St., Bristol, TN – Ms. Lisa Martin, Owner of Martin’s K P Duty, filed a request to renew her Temporary Permit, but was not able to attend the meeting. Capt. James advised the Board it is not necessary for the Permit holder to be present during a request for renewal. He related there have been no violations or problems since the Permit was first issued. Mr. Kistner called for questions/comments from the public, there being none he called upon the Board. Mr. Ketron made a Motion to approve the Application, seconded by Mr. Vernon. There being no further discussion Mr. Kistner called for a vote, the Motion was approved by unanimous vote. Yee Haw Brewing, 151 Speedway Blvd., Bristol, TN – Ms. Margaret Stolfi, representing the business appeared before the Board to request a renewal of 4 of their Temporary Permits for locations inside the track property. Capt. James advised in 2015 they obtained a Temporary Manufacturers Permit and 7 Temporary Permits for sales, but want to renew only 4 of the Temporary Permits. He related there were no violations or problems in the past. Mr. Kistner asked Capt. James if he has a map of the locations with clear directions, he advised he does. Mr. Kistner called for questions/comments from the public, there being none he called upon the Board. Mr. Turner made a Motion to approve the Application, seconded by Mr. Vernon. There being no further discussion Mr. Kistner called for a vote, the Motion was approved by unanimous vote. 1 A Matter of Taste 1, 2800 Hwy 11E, Bristol, TN – Mr. Justin Peters appeared before the Board to request a Temporary On/Off Premises Permit for A Matter of Taste 1. Capt. James advised the Application is in order, background checks conducted, and fees paid. He related Mr. Peters has operated several temporary sites in the vicinity of Bristol Motor Speedway for several years with no violations or problems noted. This site is located across from the North Gate on the Rogers Gardens property. Mr. Kistner called for questions/comments from the public, there being none he called on the Board. Mr. Turner asked if this business and The Last Lap were going to be on the same property, Mr. Peters said it will be in close proximity on the same property, and he submitted a map to Capt. James. Capt. James showed the map to the Board. Mr. Kistner asked if employees have received training, Capt. James advised Mr. Peters employees are all Tennessee State Certified to serve alcohol. Mr. Turner made a Motion to approve the Permit, seconded by Mr. Vernon. There being no further discussion Mr. Kistner called for a vote, the Motion was approved by unanimous vote. A Matter of Taste 2, 191 White Top Rd., Bristol, TN – Mr. Justin Peters also requested a Temporary On/Off Premises Permit for A Matter of Taste 2. Capt. James advised the previous Application covers both businesses, however they are located at separate addresses. A Matter of Taste 2 is located in Red Barn Campground. Capt. James advised as with A Matter of Taste 1 the fees were paid, and employees are State Certified in alcohol sales. Mr. Kistner called for questions/comments from the public, there were none. He then asked Mr. Peters if he is familiar with the long list of past problems at Red Barn Campground during the races, he (Mr. Peters) related all he heard about were problems with the mechanical bull. Mr. Kistner told Mr. Peters he will be greatly challenged in dealing with the problems that always seem to arise in this particular campground, and advised security will be very important. Mr. Peters asked how many points of sale were typically located in the campground, Mr. Kistner said only one that he was aware of. Capt. James advised that minors in Bristol, attending the races or not, know Red Barn Campground is the place to go to get beer, Mr. Kistner related he has personally seen many high school age teens wandering through the campground completely intoxicated, that they know they can go there and get anything they want. Mr. Peters related he will have a higher number of security personnel in that location, that he has always operated by the book and will continue to do so. Mr. Oberdan Congello, Levy Foods, requested to speak, he advised Bristol Motor Speedway is leasing the Red Barn Campground for parking during the September football game, they are working with Mr. Peters in this location and will provide increased security coverage. Mr. Peters related that he also believes since this will be a football game it will bring in a different group of people, and hopefully they will be more self-controlled. There being no further discussion Mr. Kistner called for a Motion, Mr. Turner made a Motion to approve the Application, seconded by Mr. Ketron. The Motion was approved by majority vote, with Mr. Vernon voting no. Birthplace of Country Music, 603 Shelby St., Bristol, TN – Ms. Leah Ross, representing the business appeared before the Board to request a Temporary On-Premises Permit for use during Bristol Rhythm and Roots. Capt. James advised the Application is in order, fees paid, and Ms. Ross attending Alcohol Sales Education Training on August 9, 2016. He related she intends to 2 send 8 or 10 more people to the next class, scheduled before Rhythm and Roots. Mr. Kistner called for questions/comments from the public, there being none he called upon the Board. Mr. Kistner asked Ms. Ross if she is comfortable with the set up and their plan of operation, she related she is, this is not their first time selling alcohol, they operate four sites in Virginia and have for several years. Since they have added a stage at this location they were asked to establish a site to sell beer and have done so. She advised they are very strict about who they allow in at their sites in Virginia, and will continue to be so in Tennessee. Capt. James advised Ms. Ross submitted a site plan and diagram of their operation, and passed it around for Board Members to look at, it is located in the L C King parking lot behind State Line Restaurant. Ms. Ross advised this is the second year they have had a stage in this location, but the first time selling beer. Mr. Turner made a Motion to approve the Application, seconded by Mr. Vernon. Mr. Kistner called for further discussion, there being none he called for a vote. The Motion was approved by unanimous vote. Brewfest at Bristol, 810 State St., Bristol, TN – Mr. Russell Morrell and Mr. Matt McMillen appeared before the Board to request a Temporary On-Premises Permit for use on September 8, 2016. Capt. James advised this will be located on city property at the Downtown Center, it was presented to City Council for a Resolution of Approval to sell alcohol on city property, and he has a copy of the approved Resolution signed by the Mayor for the file. Mr. Morrell filed the Application on behalf of Tailgating For A Cause, a 501c3 Nonprofit Organization, who will be the Permit holder. Capt. James advised Mr. Morrell has completed Alcohol Awareness Education Training. Mr. Kistner called for questions/comments from the public, there were none. Ms. Danielle Kiser, City Attorney, advised the Beer Board does have the authority to approve the Permit, however, it was taken to the City Council first since this will take place on city property. They approved the use of city property, but the only Beer Board can approve the actual Permit. Mr. Morrell was requested to bring in a nonprofit organization, and will provide insurance to cover the event. There will be several breweries who will provide samples within an enclosed area, only paying attendees with a wristband will be allowed in the area and their ID’s will be checked. Capt. James advised he has a copy of the site plan, the same one presented to the City Council, it includes the State St. and Shelby St. sides of the Downtown Center plus a small portion of Eighth St. Mr. Turner asked if the area will be fenced in, Mr. Morrell said it will with security personnel both inside and outside the fence. There being no further questions or discussion Mr. Ketron made a Motion to approve the Application, seconded by Mr. Turner. There being no further discussion Mr. Kistner called for a vote. The Motion was approved by unanimous vote. Levy Restaurants, 151 Speedway Blvd., Bristol, TN – Mr. Oberdan Congello appeared before the Board to request 20 new Temporary On-Premises Permits for operations inside the speedway. Capt. James advised Applications are in order and all fees paid, these Permits will be in addition to Temporary Permits already held by Levy Restaurants. Personnel to work these sites complete initial training by computer and must complete onsite testing within one year. Mr. Kistner called for questions/comments from the public, there were none. Mr. Kistner asked if a site plan with the location of each site has been submitted, Capt. James related he has a list with the number and name of each location and a diagram of where they will be located. Mr. Kistner 3 asked if they were for sales in the stands, Mr. Congello said they are. Mr. Kistner asked how many people will be working these locations, Mr. Congello said he will have two servers per tent, so 40 people. Mr. Kistner asked if these were related to the hawking operation, Mr. Congello said they would not, they are a set location for customers to buy from, and will be in operation during the September football game only. Mr. Turner made a Motion to approve the Applications, seconded by Mr. Vernon. There being no further discussion Mr. Kistner called for a vote. The Motion was approved by unanimous vote. Whiskey Rebellion, 520 State St., Bristol, TN – Mr. Thomas Nichols, Co-Owner, appeared before the Board to request an On-Premises Permit. Capt. James advised this business is located in the old K P Duty Restaurant location, the Application is in order, background checks completed, fees paid, and the staff are State Certified in alcohol sales. Mr. Nichols attended the Alcohol Awareness Education Training class on August 9, 2016, and has experience with alcohol sales in Virginia. Mr. Kistner called for questions/comments from the public, there being none he called on the Board. Mr. Kistner asked Mr. Nichols where he got his experience, he related in Abingdon, VA, and advised his partner has extensive experience in alcohol sales. Mr. Kistner asked if he had any problems, Mr. Nichols related the business had no violations, and was actually owned by his parents. Mr. Kistner told him they would be tested, Mr. Ketron told him the Tennessee Drivers License plainly states if the person is under 21, so there should be no mistakes. Mr. Kistner called for further discussion, there being none he called for a Motion. Mr. Turner made a Motion to approve the Application, seconded by Mr. Vernon. Mr. Kistner called for a vote, the Motion was approved by unanimous vote. PENDING BUSINESS Capt. James advised he received an Application today, and has one pending. Mr. Turner asked if there is enough time to meet all requirements and hold a meeting before the VT Football Game. Capt. James advised there is enough time if the Board would like to hold a called meeting on August 31 or September 1 to post the sign and have notice published in the newspaper, a meeting on August 31 would give him 20 days to work with. Mr. Kistner tentatively scheduled a meeting for August 31, 2016, and suggested Capt. James contact the business with the pending Application and advise them if they get theirs turned in right away they should be able to meet the Board on that day. There being no further business to conduct the meeting was adjourned. 4
