CITY OF BRISTOL, TENNESSEE MINUTES OF THE BEER BOARD MEETING HELD NOVEMBER 16, 2016 BOARD MEMBERS PRESENT CITY EMPLOYEES PRESENT Mr. Craig Kistner – Chairman Chief Blaine Wade Mr. Mike Ketron – Vice Chairman Capt. Mica Doty Mr. Vince Turner Ms. Danielle Kiser Mr. Spike Tickle Call to Order – At approximately 5:00 pm on November 16, 2016, Mr. Kistner, Chairman of the Beer Board for the City of Bristol, Tennessee, called the meeting to order in the Conference Room of the Ewell L. Easley Municipal Bldg., located at 104 Eighth St., Bristol, Tennessee. Review of Minutes – Item #4 under Levy Restaurants, add “or $1,500 Civil Penalty” to Mr. Vernon’s Motion. All else approved as read. NEW BUSINESS Paramount Center for the Arts, 518 State St., Bristol, TN – Mr. Miles Marek, Executive Director, was summoned before the Board for the violation of selling alcohol to an underage Confidential Informant (CI). Capt. James advised Mr. Marek was not present at this time. Mr. Kistner advised the Board would proceed with no representation present. Capt. James related the violation occurred on September 17, 2016 during Alcohol Compliance Checks conducted by the Bristol Tennessee Police Dept. Street Crimes Unit (SCU). Their Permit was issued September 2011, this is their first violation. Mr. Kistner called Inv. Doty, SCU, to brief the Board. Inv. Doty advised the SCU was conducting checks during Bristol Rhythm and Roots with an Underage CI, he was instructed to use his legally issued ID and to answer any questions truthfully. They entered the Beer Garden set up outside the Paramount Center for the Arts, approached the employee working the cash register and ordered a beer. The employee took the payment and relayed the order to another employee who poured the beer and served it to the CI. After the beer was served to the CI Inv. Doty identified himself and told the server he had just served the beer to an underage CI. The employees told Inv. Doty that there was supposed to be someone at the entrance to the Beer Garden checking ID’s, and no one under 21 was allowed in. Inv. Doty then issued the server a State Citation for the violation. Mr. Kistner asked to see a copy of the CI’s ID, which Inv. Doty provided, and related the CI was not asked to show ID at any time. Following discussion Mr. Kistner gave a brief history of penalty’s offered on a first violation. Mr. Ketron made a Motion for a 10 day Suspension with the option of a $1500 Civil Penalty, seconded by Mr. Vernon. Capt. James advised Mr. Marek had just arrived, Mr. Kistner explained to Mr. Marek what was happening and where the Board stood. Mr. Marek advised patrons entering the Beer Garden were supposed to be issued wristbands, anyone else bypassed the Beer Garden and went into the theater. When leaving the theater they were supposed to use the side door, however, some went to the front of the building and entered the Beer Garden without being ID’d by employees. He advised employees were told if anyone asked for a beer 1 and did not have a wristband, do not serve them. Inv. Doty told Mr. Marek that no one was at the street entrance to the Beer Garden to check ID’s, Mr. Marek advised it is obvious the ushers, cashier and server did not do their job. Mr. Kistner called for further discussion, there being none he called for a vote. The Motion was approved by unanimous vote. PENDING BUSINESS Capt. James advised he has one Application pending a Board Meeting in December 2016. Mr. Kistner scheduled a meeting for 21 December 2016. There being no further business to conduct the meeting was adjourned. 2
