Background Information:
The applicant, Victoriano Garcia, proposes to consolidate two (2) existing lots (Lots 22 and 23,
except the southeasterly 2.5 feet of the northeasterly 50 feet thereof, in Block 19 of Grossdale
Subdivision) commonly known as 3736-3738 Grand Boulevard. The applicant must consolidate the
existing lots within the property in order to build a proposed new three-story mixed-use building in place
of the two (2) existing buildings. Currently, Emerald Bay Jewelers and Strive 4 Fitness are located in
the existing adjacent buildings. The proposed new lot (Lot 1) will have 47.5 feet of frontage and a total
area of approximately 5,000 square feet.
Per Section 62-21 - Consolidation of Zoning Lots – of the Brookfield Zoning Code:
(a) No person shall use two or more contiguous subdivided lots or portions thereof to satisfy the
requirements of this chapter unless said person shall duly record with the county recorder of deeds a plat
conforming to the applicable state statutes and the requirements of this Code consolidating or subdividing
the lots as the proper case may be.
(b) No person shall build or extend any building or structure on two or more contiguous subdivided lots
or portions thereof unless said person shall duly record with the county recorder of deeds a plat
conforming to the applicable state statutes and the requirements of this Code consolidating or subdividing
the lots as the proper case may be.
PLANNING AND ZONING COMMISSION DISCUSSION AND ACTION
The Planning and Zoning Commission (PZC) considered this request on April 22, 2021. No members of
the public provided testimony. The PZC voted 7-0 to recommend approval of the Plat of Resubdivision
subject any necessary technical revisions prior to recording.

DISCUSSION
The applicant proposes to consolidate two (2) existing lots (Lots 22 and 23, except the
southeasterly 2.5 feet of the northeasterly 50 feet thereof, in Block 19 of Grossdale Subdivision)
commonly known as 3736-3738 Grand Boulevard. The applicant must consolidate the existing
lots within the property in order to build a proposed new three-story mixed-use building in place

Sec. 48-19. - Plats to conform to official plan.
No map or plat of any subdivision affecting land within the corporate limits of the village and
contiguous territory outside of and distant not more than 1.5 miles from such limits, and not

included in any city, village or incorporated town, and presented for record after the adoption of
the official plan provided for in chapter 40 of this Code shall be entitled to record or shall be valid
unless the subdivision thereon shown provides for streets, alleys and public grounds in conformity
with any requirements applicable thereto on such official plan.

Sec. 48-20. - Approval of plats—Required.
Any person subdividing lands, blocks, lots or sublots, or any part thereof, located in the village
shall make a map or plat of such subdivision and, before recording the same in the county
recorder's office, shall submit the same to the chief building inspector and the village attorney for
their examination. If such officers approve the same, they shall so certify; and such map or plat
shall not be valid or effective, as far as the interests of the village are concerned, until it has been
approved by the president and board of trustees.

recommending plats for approval by the Village Board. Consistent with that practice, the
proposed plat should be reviewed by the Planning and Zoning Commission and approved by the
Brookfield Village Board before it may be recorded.
RECOMMENDATIONS
Staff recommends that the Planning and Zoning Commission recommend approval of the
proposed Plat of Resubdivision to the Village Board subject to any necessary technical revisions
prior to recording.

Background Information:
The applicants, Mathew and Jennifer Hendricks, propose to consolidate three (3) existing lots (Lots 23,
24 and 25 in Block 44 in Gross First Addition to Grossdale Subdivision) commonly known as 3242 Grand
Boulevard. The applicants must consolidate the existing lots within the property in order to build an
addition onto the rear of the existing house. The existing house straddles the lot line between Lot 23 and
24 as well as the lot line between Lot 24 and Lot 25. As a result of this, the existing house does not
comply with the minimum required interior side yard setbacks for those interior lot lines. Non-conforming
structures may not be expanded without being brought into conformance with the Zoning Code. The
proposed new lot (Lot 1) will have 75 feet of frontage and a total area of 6,715 square feet. The new lot
will comply with the minimum 50-foot lot width and 6,200 square-foot area for requirements for the A-1
Single-Family Residential District. The existing detached garage which sits mostly upon existing Lot 23,
will be made conforming by being located on the new Lot 1 and access to the garage will remain from
the alley. There will be no new curb cut.

conformance with the Zoning Code. The proposed new lot (Lot 1) will have 87.5 feet of frontage and a
total area of approximately 10,997 square feet. The new lot will comply with the minimum 50-foot lot
width and 6,200 square-foot area for requirements for the A-1 Single-Family Residential District. The
existing garage with above coach house will continue to be accessed from the alley. There will be no
new curb cut.
