ADJOURNMENT Page 1 of 6 Committee Item Memo Meeting Date: February 13, 2023 Staff Contact: Kate Portillo, Village Planner Department: Community Development Subject: Discussion of Case No. 23-01 Request for a Special Use Permit to Operate a Warehouse for Vehicles Associated with a Transportation Company at 8939 Ogden Avenue Background Information: On October 31, 2022, Mr. Jeremy Camancho made an application to the Planning and Zoning Commission for a Special Use to store the six-vehicle livery fleet associated with his business, Premier Luxury Transportation, LLC, at 8939 Ogden Avenue. The property is located in the C- 1 zoning district where the business office is a by-right use, but the short-term and long-term storage of vehicles defined as a "Warehouse" use requires a Special Use permit. Subject Site: Page 2 of 6 The Planning and Zoning Commission held a public hearing on January 26th, 2023, to consider the application for a Special Use permit. During the public hearing, Village Planner Kate Portillo gave the staff report, noting that the proposed use is solely to park/store vehicles for the required State inspections and when the vehicles are not in use. Ms. Portillo referenced facade improvements and aesthetics as goals enumerated in both the Ogden Avenue Subarea Plan of the 2018 Comprehensive Plan and the 2022 Energize Ogden Plan. Commissioners raised questions related to Mr. Camancho's hours of operation, site utilization, fleet upkeep and maintenance, on-site alarm system and intention to add signage aligned with the Village Code. The option to require facade improvements and a landscaping element with planters as a condition of the special use permit was also discussed. Mr. Camancho noted that the site accommodates all parking requirements on-site, that a fire alarm system has been installed in the building, and that he will utilize neighboring businesses along Ogden Avenue for his operational needs (gasoline, car wash, vehicle repair, etc.). Findings of Fact: The Commission deliberations contemplated the following standards for review: Special Use Standards • The use is generally compatible with the intent and purpose of the General Service zoning district in that the transportation company intends to enhance the facade and can access necessary operational resources which in return supports neighboring business owners. • The use is generally compatible with the site and the vicinity because the existing building is comprised of an office space and an open floor plan warehouse space, therefore providing meaningful amenities for the petitioner's transportation company. • The special use will not cause or intensify negative impacts upon public facilities or neighboring properties because the use will be fully contained within the building and the required on-site parking is provided on an adjoining parcel under common ownership. By unanimous vote of 6 ayes, 0 nays and 0 abstaining, the Planning and Zoning Commission moved to recommend approval of the Special Use permit without conditions. Recommendation(s): Village staff recommends the Committee of the Whole discuss the petition request and attached recommendation from the Planning and Zoning Commission and determine if it is appropriate to direct the Village Attorney to prepare an Ordinance for vote at the next Village Board meeting. Roll Call Present: Chairperson Grund and Commissioners Benjamin, Evans, Miller, Svoboda, Straka. Absent: Commissioner Weber. Others Present: Trustee Hendricks, Village Planner Por�llo, Director Egan III. Approval of Minutes Chairman Grund made a mo�on to approve the mee�ng minutes dated November 17, 2022. Commissioner Straka so moved. The mo�on was seconded by Commissioner Miller. AYES: Benjamin, Grund, Miller, Straka, Svoboda. NAYS: None. ABSTAIN: Evans. Mo�on Passed 5-0. IV. Public Comment None. V. Case No. 23-01 Request for a Special Use Permit to Operate a Warehouse for Vehicles Associated with a Transportation Company at 8939 Ogden Avenue. Chairman Grund made a mo�on to open the public hearing. Commissioner Straka so moved. The mo�on was seconded by Commissioner Benjamin. AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda. NAYS: None. ABSTAIN: None. Mo�on Passed 6-0. Chairman Grund requested the staff report. Village Planner Kate Por�llo presents the case and the staff report. Chairperson Grund opened the floor for Public Comment and swore in those who intend to give tes�mony. Business Owner and pending tenant Jeremy Camancho spoke about his business opera�ons and the an�cipated use of the property. 1 Planning and Zoning Commission Record of Minutes – Meeting Date: January 26, 2023 Page 5 of 6 Commissioners asked ques�ons related to the proposed use and site. Resident Barbara Dahm spoke in support of the Commission recommending a Special Use Permit for this use to the Village Board. Property Owner Roland Johnson provided background on his family’s long�me ownership of the property, his recent investment in building improvements and the available on-site parking. Chairman Grund asked for a mo�on to close the public hearing for Case 23-01. Commissioner Benjamin moved to close the public hearing. The mo�on was seconded by Commissioner Evans. AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda. NAYS: None. ABSTAIN: None. Mo�on Passed 6-0. Commissioners deliberated on the site and recommenda�ons within the Energize Ogden Plan for signage and façade improvements. Ul�mately, the Commissioners indicated support of the request without condi�ons. Chairman Grund made a mo�on to recommend approval of Case 23-01 a request for a Special Use Permit to Operate a Warehouse for Vehicle associated with a Transportation Company at 8939 Ogden Avenue. Commissioner Benjamin so moved and the mo�on was seconded by Commissioner Straka. AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda. NAYS: None. ABSTAIN: None Mo�on Passed 6-0. VI. Other Business Village Planner Kate Por�llo provided staff updates including the recent Commitee of the Whole advancement of proposed text amendments related to Mobile Vending licensing and the expected Board vote on February 13th, 2023, along with foreshadowing numerous agenda items expected for the February 23rd PZC mee�ng. Community Development Director Emily Egan provided updates on the Economic Development Commission. They will be ac�vely promo�ng the Property Improvement Program grant, and the First Na�onal Bank of Brookfield is making a zero interest loan available to PIP grant recipients. VII. Adjournment Chairman Grund asked if there was a mo�on to adjourn the mee�ng. Commissioner Straka so moved. Commissioner Benjamin seconded the mo�on.
