ADJOURNMENT Page 1 of 19 Committee Item Memo Meeting Date: May 22, 2023 Staff Contact: Kate Portillo, Village Planner Department: Community Development Subject: Discussion of the Business Use "Smoke and Vape Shop" and Potential Public Hearing at the Planning and Zoning Commission related to Zoning Code Text Amendment Background Information: When a new business wants to open, a zoning review is the first step taken by staff. The Village Planner receives a business license application and reviews it to confirm whether the use is permitted "by-right", by a Special Use Permit, or is prohibited. §62-30 Table of Allowed Uses provides information on permitted, special use, and prohibited uses in commercial and industrial zoning districts, and §62-216 provides information on permitted, special use, and prohibited uses in the Station Area zoning districts. Use classifications are found in §62-22 through §62-32 of the Village Code. The definition "Nondurable goods" is found within the Commercial Use category, and reads as follows: Retail sales uses that sell or otherwise provide non-durable, consumable (aka "soft") goods that are consumed quickly and that must be purchased on a regular basis, such as: (1) sundry goods; (2) products for personal grooming and for the day-to-day maintenance of personal health or (3) food or beverages for off-premises consumption. Typical uses include convenience stores, drug stores, grocery and specialty food stores, wine or liquor stores, gift shops, newsstands and florists. A smoke and vape shop business falls within the nondurable goods classification. As such, this business use is allowed as a permitted use in the C-1, C-3, C-4, SA-1 and SA-3 zoning districts. A nondurable goods business is allowed in the SA-2 and SA-4 zoning districts with a maximum floor area of 3,500 square feet and in the I-1 zoning district by special use permit only. The attached zoning map exhibit is modified to show the areas where a Nondurable Goods business use is allowed by right in black block-out. There are currently four "Smoke and Vape" nondurable goods businesses in Brookfield at the following locations: • 9152 Broadway Avenue • 8907 Burlington Avenue • 9120 Ogden Avenue Page 2 of 19 • 9323 Ogden Avenue Specific regulation of this business type would require an application by the Village to the Planning and Zoning Commission for Text Amendment. Potential code changes could range from the creation of a standalone use category for this business type regulated by zoning district to a possible moratorium on the use type, with existing businesses becoming legal non- conforming uses and allowed to remain. Recommendation(s): Village staff recommend the Committee of the Whole review the information and discuss whether to direct staff to research potential policy changes to restrict and/or prohibit the "Smoke and Vape Shop" type of business use and bring potential Text Amendments to a public hearing with the Planning and Zoning Commission. Historically, there has not been a comprehensive banner policy or scheduled program for banners as far as staff can determine. The intent and goals of a banner program have not been discussed with the Village Board within the past five years or more. Staff would like to present information on the existing banners, discuss staff's recommended changes for the short-term, and get direction from the Committee of the Whole on future banner plans and policies. After reading the memo and hearing from staff the Committee of the Whole should consider the following key questions: • Should the Village allow community organizations to design and pay for banners to be installed by the Village? • How can banners support branding, marketing, and economic development efforts? • Should some banners be permanent as part of streetscaping, placemaking, and public art efforts? Existing Banners: The attached banner description document illustrates the design of each banner and lists the number of poles available for banners for each of the three business districts. The table below summarizes some of that information. The installation and removal of banners in each business district differs based on the type of light pole fixtures and safety needs. The approximate time needed for the installation by district is illustrated below. Page 5 of 19 • Ogden Avenue approximately 1.5-2 days each change • Downtown approximately 3-4 hours each change • Eight Corners approximately 4 hours for each change Recommended Short-Term (2023 and 2024) Staff's recommendations initially includes a change to the variety in banner designs and fewer changes for Public Works. Staff also recommends making community sponsored banners a routine option. An example of a community sponsored banner are the banners purchased and designed by an organization like the Chamber of Commerce. This option could be made available to the Library, Schools, and Brookfield Non-profit Organizations for Brookfield based activities/events. Staff's recommendation intends to save time and labor for Public Works staff while still making a positive visual impact with banners. The table below summarizes staff's recommendation for the number of banner changes. After that, staff recommends making plans to include more permanent banners at key locations (e.g. on Ogden Avenue would be eastern and western gateway poles). These permanent signage/banners provide a strong visual impact and can be harmonious with other streetscape designs. Next Steps Banners are one of many different types of streetscape elements controlled by the Village. Other items include things like bike racks, benches, sidewalk material, trash and recycling receptacles, etc. The Energize Ogden Plan identifies streetscapes as an important element for Ogden Avenue. The discussion with the Committee of the Whole will direct staff on how to use banners as a way to promote an overall vibrant community. Staff would like direction from the Committee of the Whole on how much importance to place on this particular streetscape element and direction on how to proceed. Staff seeks direction from the Committee of the Whole on the key questions listed in the beginning of this memo. Financial Impact: New light pole banners for use in each district for the next one to two years may be included in the 2024 budget workshop. Banners are estimated at approximately to cost $50 to $100 each to manufacture. Page 6 of 19 Permanent signage/banners will require additional financial resources to support these streetscape improvements. Financial resources will need to be identified in 2025-2026 to meet these long-term plans. Energize Ogden signage will be realized in 2027-2028 through the planned improvements which begin with Phase I Engineering process. Recommendation(s): Staff asks the Committee of the Whole to review the material and provide direction on the future of banners.
