Subject: Discussion Concerning the Provision of Prosecution Services
Background Information:
The Village operates an Administrative Hearing Officer system as a means to adjudicate local
ordinance violations at the local level. The Village Board appoints an independent Hearing
Officer to serve as the "judge" or Hearing Officer and he presides over cases and determines
liability or other potential outcomes of each case.
At each hearing, the most common cases involve local violations of quality of life codes, i.e.
noise, etc. that have resulted from tickets issued by our Police Department, or violations of
property maintenance standards resulting from citations issued by our Community
Development Department. Cases involving property maintenance issues can often involve
technical legal issues and/or mitigating circumstances that can be referenced as a defense for
a violation. Currently, the Village does not have an appointed Prosecutor to represent our
cases. Instead, existing Village staff will typically provide this service, or in more complex
cases involving multiple violations, an attorney from the Village Attorney's Office serves as
Prosecutor.
Staff is recommending a more formal approach be afforded to this task and is therefore
recommending that the Village issue a Request for Proposals document seeking qualified
candidates to serve as Prosecutor. Staff feels that having an independent third party serve in
this capacity ensures an unbiased view on each case and appointing someone with ample
experience should provide the Village with an individual that can draw on their experience in
recommending appropriate enforcement action for each violation. Staff does not anticipate
that a Prosecutor necessarily needs to attend every hearing but would be available when staff
determines a need.

Subject: Update Status of Park and Gateway Signage
Background Information:
The purpose of this memo is to provide the Village Board with a status update of our sign
installations within the community.
The 2015 Open Space Plan, approved by the Village Board, included a support document
called the "Village of Brookfield Park Design Guidelines" to include and identify park standards.
"The purpose of the Village of Brookfield Park Design Guidelines document is to set standards
so that further park development will have a consistent brand, replacement, and maintenance
needs. This goal is to be accomplished in large part by providing recommendations and
guidance in the use of quality materials, architectural styles, site furnishings, color schemes,
appropriate proportion and scale, and functionality of improvements throughout the Village of
Brookfield park system. While these guidelines are intended to provide for a unified quality
approach, plans and/or designs that vary from details of the guidelines will be considered for
approval if judged to be in keeping with the overall intent of quality and functionality of the
guideline standards. The Village of Brookfield will consider variances on a case by case
basis."

In alignment with the Open Space Plan recommendations and Park Design Guidelines, staff
proposed a plan to the Village Board in 2022 to budget for phased sign purchases to
incrementally update Village signs in our parks and facilities. The below update status is for the
purchase of five Village signs that will identify our program facilities and create new signage to
replace outdated and/or dilapidated structures.

each budget year.

Not included with a rendering in this memo but planned for 2023 is permanent signage to be
placed on the Kiwanis Park Bandshell where we have increased community event attendance
to up to 400 attendees on Friday night concert dates (10 concert dates annually), hosts over
140 campers each day of the Summer, and is open for rentals and the community to enjoy.
This sign installation will also assist as a visual marketing and location tool.
Financial Impact:
Total budgeted cost of $28,900 (includes installation costs of $8,380)
