ADJOURNMENT Page 1 of 8 Committee Item Memo Meeting Date: September 09, 2024 Staff Contact: Noah Rife, Management Analyst Department: Village Manager's Office Subject: Discussion of Creating a Class 7B Liquor License Classification Background Information: In July 2024, the legal team representing SSA Group reached out to inquire about the ability to serve alcohol for off-site consumption. The event in particular that Brookfield Zoo Chicago would want to serve alcohol for off-site consumption would be Wines in the Wild on November 9th, 2024. SSA Group holds two liquor licenses, Class 7 and Class 7A. Both liquor licenses only allow for on-site consumption. Currently, the only way off-site consumption of alcohol that is permitted is through either a Class 3 or Class 6 liquor license. The annual fee for the Class 3 Liquor License is $2,000. The annual fee of the Class 6 Liquor License is $1,000. The Village of Riverside passed an ordinance on August 15, 2024, creating a special liquor license allowing for SSA Group to serve alcohol for off-premises consumption. The Class B1 liquor license is supplemental to the Class B Liquor License, which is only held by SSA Group. The cost of the Class B1 Liquor License is $450. This is approximately 4% of the total cost of the Class B Liquor License which is $10,500. Staff recommends charging $450 for the Class 7B liquor license to reflect the Village of Riverside's fee. Upon discussion with Village Attorney Adam Durkin, staff recommends creating an additional liquor license. Class 7B would be a supplemental license for Brookfield Zoo and models the Village of Riverside's Class B1 Liquor License to allow for off-site consumption and unifies the liquor code for Brookfield Zoo Chicago across their campus. Recommendation(s): Staff recommends the Board of Trustees to approve of a new Class 7B liquor license. H( Q2 AN ORDINANCE AMENDING TITLE 3 ( BUSINESS REGULATIONS), CHAPTER 2 ( ALCOHOLIC LIQUOR) OF THE VILLAGE CODE OF THE VILLAGE OF RIVERSIDE, ILLINOIS REGARDING ALCOHOLIC LIQUOR AND LICENSES — CLASS B- SPECIAL LICENSE CHANGES AND CREATION OF CLASS B- 1 LICENSE WHEREAS, the Liquor Control Act of 1934 ( 235 1LCS 5/ 1- 1 of seq.) (" Acf ) grants to the Village the power, by general ordinance or resolution, to determine, among other things, the number, kind and classification of licenses for sale at retail of alcoholic liquor not inconsistent with the Act, and to establish such further regulations and restrictions upon the issuance of and operations under local licenses not inconsistent with law as the public good and convenience may require; and WHEREAS, pursuant to the authority granted Act and other applicable authority, the President and Board of Trustees of the Village of Riverside have determined that it is in the best interests of the Village and its residents amend Title 3 ( Business Regulations), Chapter 2 ( Alcoholic Liquor) of the Village Code of the Village of Riverside regarding Class B- Special License Changes and Creation of Class B- 1 License ( the " Code Amendments"), as set forth below and find the adoption of the Code Amendments to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Riverside, Cook County, Illinois, as follows: SECTION 1: Recitals. Each whereas paragraph set forth above is incorporated by reference into this Section 1. SECTION 2: Amendment to Section 3- 2- 5. Subsection 3- 2- 5( A)( Classes of Licenses; Permits) of Chapter 2 ( Alcoholic Liquor) of Title 3 ( Business Regulations), of the Village Code of the Village of Riverside is amended by revising the provision on Class B- Special Licenses to read in its entirety as follows: CLASS B- SP€ CIAL- license, which shall authorize the licensee to sell and offer for sale at retail in the premises specified in such license, beer, wine and alcoholic liquors for consumption on the premises at the facilities of the Chicago Zoological Society on land owned by the Forest Preserve District of Cook County, under the following conditions: CLASS B- 1 add - on license, which shall authorize a Class B licensee to sell and offer for sale at retail in the Discovery Center Area, as such area is specified at the time of the issuance of the license, beer and wine in sealed packages but not for consumption on the premises where sold. 2 Page 5 of 8 Holders of Class B- 1 licenses shall be permitted to conduct beer and wine sampling or tasting promotions upon the licensed premises; provided, that no charge shall be made therefor. SECTION 3: Amendment to Section 3- 2- 6. Subsection 3- 2- 6( A)( License and Permit Fees) of Chapter 2 ( Alcoholic Liquor) of Title 3 ( Business Regulations), of the Village Code of the Village of Riverside is amended as follows: Class B- s iaa: a 10, 500. 00 Class B- 1: 450. 00" SECTION 4: Amendment to Section 3- 2- 7. Subsection 3- 2- 9( A)( Closing Hours) of Title 3 ( Business Regulations), Chapter 2 ( Alcoholic Liquor) of the Village Code of the Village of Riverside is amended relative to Class B and B- 1 Licenses as follows: A) No alcoholic liquors shall be sold, given away, served, offered for sale in or consumed on any premises licensed under this chapter, except during the times hereinafter specified: Class B- Between the hours of 11: 00 A.M. and 12: 00 midnight Monday apes+at and through Thursday; between 11: 00 A. M. and 1: 00 A. M. on Friday; B- 1 licenses between 10: 00 A. M. and 1: 00 A. M. on Saturday; and between 10. 00 A. M. and 11: 00 P. M. on Sunday. On January 1, the closing hours shall be 2: 00 A. M. ( Ord. 2930, 11- 3- 2016 SECTION 5: Repeal. All ordinances, or parts of ordinances, in conflict with the provisions of this Ordinance, to the extent of such conflict, are repealed. SECTION 6: Severability. Each section, paragraph, clause and provision of this Ordinance is separable and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the remainder of this Ordinance, nor any part thereof, other than that part affected by such decision. SECTION 7: Effective Date. This Ordinance shall be in full force and effect from and after its adoption, approval, and publication in pamphlet form as provided by law.
