I. Call to Order
Chairperson Grund called the regular mee�ng of the Planning and Zoning Commission to order
at 7:00 PM.
II. Roll Call
Present: Chairperson Grund and Commissioners Benjamin, Evans, Miller, Straka, Svoboda,
Weber.
Absent: None.
Others Present: Trustee Liaison Hendricks, Village Planner Por�llo, Director Egan.
III. Approval of Minutes
Chairperson Grund entertained a mo�on to approve the mee�ng minutes dated June 22, 2023.
Commissioner Svoboda so moved. The mo�on was seconded by Commissioner Evans.
AYES: Benjamin, Evans, Miller, Weber, Svoboda.
NAYS: None.
ABSTAIN: Grund, Straka.
Mo�on Passed 5-0.
IV. Public Comment
Commissioner Benjamin complimented the new banners on Broadway.
V. Case No. 23-11 Public Hearing to hear a request for a Variance from §62-75 Bulk, yard and
space requirements to build a garage at 3106 Oak Ave.
Chairperson Grund entertained a mo�on to open the public hearing. Commissioner Straka so
moved. The mo�on was seconded by Commissioner Benjamin.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None.
Mo�on Passed 7-0.
Chairperson Grund requested the staff report.
Village Planner Kate Por�llo presented the case and the staff report. Chairperson Grund
requested that Ms. Por�llo review the process for analysis of the maximum building coverage
and minimum green space requirements for residen�al lots.
Chairperson Grund opened the floor for Public Comment to those who intend to give tes�mony.
Two persons were sworn in but neither came forward for Public Comment.

Chairperson Grund entertained a mo�on to close the public hearing for Case 23-11.
Commissioner Straka moved to close the public hearing. The mo�on was seconded by
Commissioner Svoboda.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None.
Mo�on Passed 7-0.
Commissioners deliberated the varia�on request, discussing that the hardship is not self-created
by the applicant and they are proposing a minimum size garage, that it is an improvement to the
property, and for context neighboring proper�es are also substandard lots and have garages of
similar scale. In their findings, the Planning and Zoning Commission determined that the seven
(7) standards for Varia�on had been met.
Chairperson Grund entertained a mo�on to recommend approval of the variance allowing
40.7% building coverage for 3106 Oak Avenue. Commissioner Miller so moved, and the mo�on
was seconded by Commissioner Straka.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None

VI. Case No. 23-10 Public Hearing to hear a request for a Preliminary Planned Development to
build a 12-unit residen�al condominium building at 8845 Burlington Ave.
Chairperson Grund entertained a mo�on to open the public hearing. Commissioner Svoboda so
moved. The mo�on was seconded by Commissioner Evans.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None.

Chairperson Grund requested the staff report.
Village Planner Kate Por�llo presented the case and the staff report. Commissioners asked
ques�ons about the previous proposal for this property, regarding the Village’s requirements for
Stormwater Management, in reference to the on-street parking the illustrated on the site plan,
if the developer proposed improving the unimproved alley, regarding the leaf design element on
the front of the building, and about the landscaping features shown for the roof deck.
Chairperson Grund opened the floor for Public Comment to those who intend to give tes�mony.
Applicant Peter Haleas spoke on the building design and his professional background. Project
Architect Ron Vari came forward to speak to the site plan, floor plans, eleva�on drawings,
enclosed parking configura�on, loca�on of trash and mechanicals, logis�cs of bicycle storage,
ar�cula�on of the building base/middle/top.

Linda Andrys and Miroslaw Kowal came forward with public comments. Village Planner Kate
Por�llo read public comments into the record from Melissa Amison, Tina Biel, Steve Sabourin,
and Diana Rodriguez.
Applicant Peter Haleas and Project Architect Ron Vari responded to ques�ons and comments
from both the public and the Planning and Zoning Commissioners.
Chairperson Grund entertained a mo�on to close the public hearing for Case 23-10.
Commissioner Evans moved to close the public hearing. The mo�on was seconded by
Commissioner Straka.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None
Mo�on Passed 7-0.
Commissioners deliberated the proposed Planned Development, discussing the design as
presented and an interest in further architectural detail for the submital, on-site and off-site
parking, stormwater management, poten�al alley improvement, site engineering, and
enhancements to the current landscaping plan. Commissioners expressed an interest in
con�nua�on of the public hearing based on receiving greater detail in order to give full support.
Architect Ron Vari asked to make a comment and the Commission responded by reopening the
public hearing. Commissioner Straka made a mo�on to reopen the public hearing and
Commissioner Evans seconded the mo�on.
AYES: Benjamin, Evans, Grund, Miller, Straka, Svoboda, Weber.
NAYS: None.
ABSTAIN: None
Mo�on Passed 7-0.
Mr. Vari made a comment on design in general, sta�ng that the preliminary Planned
Development was based on an ini�al budget-friendly decision making process and refinements
will take into account as much feedback as possible.
Commissioner Straka made the mo�on to close the public hearing and Commissioner Miller
seconded the mo�on.

NAYS: None.
ABSTAIN: None

Chairperson Grund made a mo�on to con�nue the public hearing to the next Planning and
Zoning Commission mee�ng on September 28, 2023. Commissioner Benjamin so moved and
Commissioner Evans seconded the mo�on.

Village Planner Kate Por�llo provided staff updates and Director Egan shared and update on the
Economic Development Commission.
Commissioner Miller shared posi�ve feedback on the July 2023 Intelligentsia Cup and
Commissioner Evans referenced high-quality murals in Riverside that the Beau�fica�on
Commission may be interested in seeing.
VIII. Adjournment
Chairperson Grund made a mo�on to adjourn the mee�ng. Commissioner Svoboda so moved.
Commissioner Straka seconded the mo�on.
