Chairperson Grund called the regular mee�ng of the Planning and Zoning Commission to order
at 7:00 PM.
II. Roll Call
Present: Chairperson Grund and Commissioners Evans, Miller*, Sabourin, Straka, Weber.
*Commissioner Miller arrived at 7:03 P.M.
Absent: Commissioner Svoboda.
Others Present: Trustee Liaison Hendricks, Village Planner Por�llo.
Chairperson Grund welcomed Commissioner Sabourin and gave the floor to the Village Planner
for a brief introduc�on of Commissioner Sabourin. Commissioner Sabourin expressed his
apprecia�on for the appointment.
III. Approval of Minutes
Chairperson Grund entertained a mo�on to approve the mee�ng minutes dated October 26,
2023, as updated with correc�ons. Commissioner Evans so moved. The mo�on was seconded by
Commissioner Straka.
AYES: Evans, Grund, Straka, Weber.
NAYS: None.
ABSTAIN: Sabourin.

Chairperson Grund noted his oversight in opening the public hearing and entertained a mo�on
to open the public hearing. Commissioner Straka so moved. The mo�on was seconded by
Commissioner Evans.

Commissioners asked ques�ons about any known history surrounding omi�ng specific districts,
about exis�ng off-site parking examples, the current ordinance versus the proposed text
changes, about off-street parking that is provided beyond what is required, and whether public
parking lots could be u�lized to meet off-street parking requirements. Commissioners
deliberated the proposed text amendments and stated that the standard of promoting and
protecting the public health, safety, comfort, convenience and the general welfare of the
population had been met.
Commissioner Evans entertained a mo�on to approve the request for Text Amendments.
Chairperson Grund seconded the mo�on.

Background Information:
The Village of Brookfield has operated numerous park locations for many decades and in some cases,
possibly dating back to the incorporation of the Village. The 1940 Code Book indicates that at that time
“Parks, Recreation Buildings and Clubs not conducted as a business or for profit” were permitted uses in
the “A Residence District” (§42.005, 4). On April 17, 1951, a Playground and Recreation Board was
created when a proposition passed that established the maintenance and conduct of a playground and
recreation system. The Zoning Ordinance adopted on March 25, 1996, includes the “Special Districts”
zoning designation (§30.06.04) with language identical to that in the Village’s current Zoning Code, and
parks and recreation uses were no longer listed as permitted uses in any single-family residential
districts. A copy of this Code section is attached for your review.

Analysis
The 2014 Open Space Plans illustrated the value the community has placed on parks amenities and open
space, and includes the following mission statement:
“The Village of Brookfield strives to maintain and enhance the quality of life for all citizens of
Brookfield by providing park, recreation, and leisure opportunities by developing, maintaining,
preserving, and enhancing recreations areas and open space”.
In Chapter 8 “Parks, Open Space & Environmental Features” of the 2018 Comprehensive Plan it is stated
that “Village officials and staff, stakeholders, local conservation organizations, and residents have
continuously identified the importance and value of parks, open space, and natural resources within the
Village of Brookfield”. Protection and enhancement of the Village’s natural resources has been
identified as a key issue relative to the future of the Village.
Currently, only Kiwanis Park North and Kiwanis Park South have S-1 General Open Space district zoning,
and portions of Ehlert Park have S-2 Restricted Planned Open Space district zoning. The remaining park
properties are considered legal non-conforming uses in their respective zoning districts. The map
amendments requested intend to protect the park assets and associated land uses for the Village. The
intention is for parks and open space uses to have the appropriate zoning designations so that the
results are conforming uses.
Please note: Madlin Park has been removed from this map amendment request as the Village ownership
records and information have been found to be incomplete.
Standards of Review:
An application for a map amendment should be considered in the context of the general Intent and
Purpose of the Zoning Ordinance as follows:
• To promote and to protect the public health, safety, morals, comfort, convenience, and the
general welfare of the people.
• To protect the character and maintain the stability of residential, business, commercial and
manufacturing areas within the village, and to promote the orderly and beneficial development
to such areas.
• To provide adequate light, air, privacy, and convenience of access to property.
• To regulate the intensity of use of zoning lots, and to determine the area of open spaces
surrounding buildings and structures necessary to provide adequate light and air and protect
the public health.
• To limit congestion in the public streets and so protect the public health, safety and general
welfare by providing the off-street parking of motor vehicles and for the loading and unloading
of commercial vehicles.
• To provide protection against fire, explosion, noxious fumes, and other hazards in the interest of
the public health, safety, and the general welfare.

Sec. 62-163. Purpose.
(a) Special districts are provided to recognize the existence of major open space within the village which offer
active and passive recreational use, contain waterways with recognized floodplains, and may in some cases
offer potential for enhanced development without negatively affecting the environment or intensify
flooding.
(b) The S-1 General Open Space Zoning District is intended to provide for limited development of redevelopment
which will continue to provide public space which is properly planned to take into account environmental
consideration and maintain a high quality natural or naturally planned environment. The S-2 Restricted
Planned Open Space District is intended to provide for planned development potential of public open space
which cannot only maintain a high quality natural environment but would also offer enhanced benefit to the
community as a whole by taking into account proximity to major thoroughfares.

(a) The following uses and no others are permitted as of right in the S-1 General Open Space District:

(2) Baseball fields, amateur, publicly owned.

(5) Bicycle, hiking and walking trails.
(6) Conservatories.
(7) Courts, including basketball, tennis, horseshoe, publicly owned.
(8) Forest preserves.
(9) Municipal buildings, facilities and support structures.
(10) Parks, publicly owned.
(11) Picnic areas.
(12) Playgrounds, publicly owned.
(13) Playfields, including soccer, tag-football, publicly owned.
(14) Swimming pools, indoor or outdoor, municipally owned.
(b) The following uses and no other are permitted as of right in the S-2 Restricted Planned Space District:

Please describe your amendment request.
The Village is seeking the requested map amendments so as to accurately represent the existing
uses on these VIiiage-owned parcels. The requested zoning designation for portions of Ehlert
Park would be "S-2 Restricted Open Space Districf'. The requested zoning designation for
Candy Cane Park, Harrison Park, Madison Tot Lot, Madlin Park, Maple Park South, Veterans
Memorial Park, Creekside Park, and Maple Park North would be S-I General Open Space
