Page 1 of 8  Committee Item Memo Meeting Date: June 17, 2025 Staff Contact: Libby Popovic, Community Development Director Department: Community Development Subject: Discussion of Proposed Text Amendment to Chapter 62 Zoning to add Electric Vehicle Charging Background Information: The Metropolitan Mayors Caucus (MMC) launched the EV Readiness Program in the fall of 2022. In December 2024, the MMC announced the third cohort of participating municipalities. Brookfield applied and was selected as one of the third cohort communities to participate in the program. The MMC program is designed to help local governments prepare for the growing demand for electric vehicles and the supporting charging infrastructure. Since joining the third cohort, Brookfield has been working to complete the requirements for Bronze certification outlined by the MMC. Staff has participated in a structured series of workshops, planning exercises and readiness checklists. These activities were designed to guide municipalities through key steps toward becoming electric vehicle ready. To date, the Village has completed 15 of 16 required items, as detailed in the attached EV Readiness Checklist. The remaining requirement is establishing EV chargers as an accessory use, which is addressed in this amendment. Additionally, the State of Illinois enacted the Electric Vehicle Charging Act, which took effect on January 1, 2024. The Act sets minimum requirements for EV charging infrastructure in new construction and highlights the need for local governments to support statewide sustainability and transportation goals. The proposed ordinance would align with state legislation. Brookfield is seeing more frequent large-scale developments. Adopting the proposed draft ordinance positions the Village to qualify for Bronze Certification in the EV Readiness Program by June 2025 and regulate the growth of EV infrastructure. The draft ordinance may be adopted as presented to allow progress on the immediate regulatory objectives, but it remains subject to further revisions as part of the broader zoning code update currently underway. The MMC has granted the Village tentative approval of the Bronze Certification pending enactment of this Text Amendment. The proposed ordinance includes definitions related to electric vehicles, a purpose statement, and accessory use classifications. It designates Level 1 (L1) and Level 2 (L2) chargers as Page 2 of 8 permissible accessory uses in all zoning districts, while Direct Current Fast Chargers (DCFC or Level 3) are classified as permissible accessory uses only in commercial and industrial areas. EV chargers would be restricted to private use in residential districts. The proposed ordinance can be amended at a later date to incorporate additional provisions, adjustments or clarifications as identified through ongoing review, MCC and stakeholder input. Adoption at this stage provides a working framework while maintaining flexibility for refinement. Staff will continue to evaluate alignment with comprehensive zoning goals and bring forward updates or supplemental recommendations as needed. Attachment Description: Draft Zoning Amendment - Village of Brookfield EV Readiness Checklist Attachments: 6.17.25 EV Readiness Checklist Page 5 of 8 Village of Brookfield, Illinois Draft Zoning Ordinance for Electric Vehicle Charging (EVSE) ARTICLE _ ELECTRIC VEHICLE CHARGING (EVSE) SECTION _-1 DEFINITIONS DEFINITIONS Electric Vehicle (EV): vehicles that store electric energy to be used for propulsion. Commonly considered synonymous with PEV. Plugin Electric Vehicles (PEV): vehicles that have a conductive plug (or inductive wireless) connection for recharging the battery. Hybrid Electric Vehicle (HEV): vehicle that uses a dual system of electric propulsion and an internal combustion engine, but the primary source of energy is derived from fuel that powers an engine (gasoline, diesel, and other fuels) and the electric portion comes from recovering energy which charges an on-board battery when the vehicle is decelerating. This stored battery power is used to increase the fuel efficiency of the vehicle, such as assisting in acceleration. HEVs do not plug in. Battery Electric Vehicle (BEV): vehicle that only uses energy stored in rechargeable battery packs onboard the vehicle to propel the vehicle. BEV’s must be plugged into an external electricity source to recharge. Plug-in Hybrid Electric Vehicle (PHEV): vehicles with an electric motor and an internal combustion engine (gasoline, diesel, or other fuel). PHEVs can be powered with either the electric motor or the gasoline engine. Level 1 EV Charging: EV battery charging that uses 110 to 120 VAC supply power, with a power range from 880 Watts (0.88 kilowatts, kW) to 1,920 kW (1.92 kW) and provides 3 to 6 range miles per hour connected. Level 1 EV chargers are supplied with Alternating Current (AC) and in turn provide AC power to the EV through a standard connector. Level 2 EV Charging: EV battery charging that uses 208 to 240 VAC supply power, with a range from 3.3 kW to 19.2 kW, and provides 16 to 80 range miles per hour connected. Level 2 EV chargers are supplied with Alternating Current (AC) and in turn provide AC power to the EV through a standard connector. Direct Current Fast Charging (DCFC): EV battery charging that uses DC power to refuel Battery Electric Vehicles (BEVs) at various amperage levels and voltage levels, most commonly 480 VAC, with power outputs ranging between 25 and 350 kW of power and provides 50 to 800 range miles per hour connected. DCFCs convert Alternating Current (AC) from facility power and output Direct Current (DC) and Volts Direct Current (VDC), which then delivers DC power to the BEV through a standard connector. DCFCs are sometimes referred to as Level 3 EV Chargers. Page 6 of 8 Electric Vehicle Supply Equipment (EVSE): The conductors and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, or apparatus installed specifically for the purpose of transferring energy between the premises wiring and the electric vehicle. Electric Vehicle Charging Station (EVCS): equipment designed to safety supply and manage power into Plugin EVs. EV Charging Stations include hard-wired EV Charging Stations and EV Charging Stations that plug in to standard wall outlets and may also integrate communication, metering, GPS and other features that assist EV drivers and the host facility. Electric Vehicle Charging Infrastructure (EVCI): "make ready" electrical equipment including panels with circuit breakers, switchboards, transformers, conduit, wiring, junction boxes, conduit hangers and other interconnections necessary to delivery electrical power from a facility to an EVSE. Electric Vehicle Power Transfer System (EVPTS) - Electric power supply and management technology that 1) provides and manages power transferred from a power source to EVSEs, including power transformers, switchboards, panels, circuit breakers and interconnecting conduit and wiring (EVCI), 2) plus the EVSE(s). PURPOSE The purpose of this ordinance is to foster the development of safe, convenient, and accessible electric vehicle (EV) infrastructure, removing barriers to EV use, and to support the Village of Brookfield’s goal of reducing vehicle emissions, encouraging sustainable transportation options, and promoting the adoption of electric vehicles within the community GENERAL PROVISIONS 1. Retail Charging, Accessory Use a. Level 1 and Level 2 Charging Stations: Level 1 and level 2 charging stations are permitted in every zoning district, when accessory to the primary permitted use of said district. Charging stations located at single-family and multiple-family dwellings shall be designated as private use only. Installation of charging stations shall be subject to permit approval. All necessary permits must be obtained prior to the installation of any charging station. b. Level 3 (DC Fast) Charging Stations: Level 3 charging stations are permitted only in commercial and manufacturing districts when accessory to the primary permitted use. All necessary building and electrical permits must be obtained prior to the installation of any charging station. Installation thereof shall be subject to permit approval. SECTIONS _-_ -Reserve Page 7 of 8  COMMIT TO EV READINESS CR-1 Make a public statement in support of EV readiness. 5 x Report baseline metrics, including power level and quantity of publicly CR-2 accessible and municipally owned EVCSs; number of municipal EVs; and 5 x registered constituent-owned EVs. Evaluate zoning code to identify any barriers to safe, expedient EVCS ZP-1 development. 10 x When EV charging is not the primary use of the site, classify the EV ZP-2A charging station as an accessory use. 5 Where minimum parking requirements exist, flex the number of ZP-4 required parking spaces to accommodate Level 2 and DCFC EVCS. 5 x (Conditional Points) Develop a clear standard permitting and inspection process for single family residential EVCSs, including pre-permit application requirements PI-1A (e.g. checklist), standard permitting application form(s) and standard 5 x inspection report form(s). Develop a clear and code-compliant standard permitting and inspection process for multiple family and commercial EVCSs, including pre-permit PI-1B application requirements (e.g. checklist), standard permitting application 5 x form(s) and standard inspection report form(s). Post standard EVCS checklist, permitting forms, and approval PI-1D requirements online. 5 x PI-2C Establish reasonable standard permitting and inspection fee structures. 5 x Advise constituents that EVCS installation contractors should be PI-3D registered with the ICC. 3 x Provide professional awareness training of EVs and EVCSs for first ST-1A responders and public safety personnel. 5 x Communicate provisions of Illinois Vehicle Code (ILCS 625 ILCS 5/11- PK-2A 3 x 1308) and/or local parking code regarding unauthorized use of EV-only parking by non-EVs at both public and private properties. UE-2A Encourage all EV owners to register with utility. 2 x CE-1A Communicate EV readiness commitment and actions to constituents. 2 x MD-1A Provide current information on incentives and grants to community. 3 x Monitor existing and pending grants and incentive programs to be ready MD-1E to deploy plans when funds become available. 2 x Page 8 of 8
