OFFICIAL MINUTES OF A BOARD OF PUBLIC WORKS: Regular / Special Meeting: Board of Public Works Date and Time: Tuesday, October 13, 2020 at 7:00pm Location: City Hall, 2000 N. Calhoun Road, Council Chambers Members Present: Alderman Rick Owen-Chairman, Alderman Chris Blackburn, Alderman Scott Berg (Mayor alt.), Alderman Mike Hallquist, Alderwoman Jenna Meza Members Excused: Mayor Ponto, Alderman Bill Carnell Others Present: Director of Public Works Tom Grisa, City Engineer Jeffrey Chase 1. Roll Call Alderman Rick Owen noted a quorum present and called the Board of Public Works meeting to order at 7:06pm. 2. Announcements The Next Regularly Scheduled meeting will be held on Tuesday, November 10, 2020 at 7:00pm. 3. Minutes of the September 8, 2020 meeting Motion by Alderman Mike Hallquist, second by Alderwoman Jenna Meza to approve the minutes of the September 8, 2020 Board of Public Works meeting. Motion carried 5-0. 4. Unfinished Business None 5. New Business a) Dedication of Pathway – Bright Future of America, Inc. (Kiddie Academy) Motion by Alderman Chris Blackburn, second by Alderwoman Jenna Meza to approve the dedication of pathway for Bright Future of America. Motion carried 5-0. b) Perpetual Pedestrian Pathway Easement – The Artisan at Georgetown Square Discussion centered around the snow and ice control provision of the easement and if indeed the intent was to have the property owner do the snow and ice control. Mr. Grisa responded that he believes that is in error. Motion by Alderman Scott Berg, second by Alderman Mike Hallquist to postpone action on the perpetual pedestrian pathway easement for The Artisan at Georgetown Square to allow staff to review the easement provisions. Motion carried 5-0. Board of Public Works October 13, 2020 Page 1 of 2  c) Driveway Access Control Ordinance Alderman Blackburn expressed concern about the ordinance requirement of having the driveway a minimum of 100 feet from an intersection. Mr. Grisa replied that this requirement is already in the current code and if a property is sized such that this is impossible to meet, the ordinance provides for variances to accommodate that condition. Alderman Blackburn pointed out that many existing driveways do not meet the requirements of private driveways in the proposed ordinance. Mr. Chase stated that those properties would be grandfathered into the existing condition and would only need to be brought up to code if the driveway was modified. Aldermen Berg discussed the variance procedure in the ordinance and how that could be interpreted as playing favorites, or being too subjective with certain properties. Alderman Hallquist understood the concern but postulated that the Board and Common Council would weigh the circumstances appropriately and in accordance with the spirit of the ordinance provision and treat all properties fairly. However, there does need to be a variance procedure to accommodate special circumstances and development patterns, like those in the Village area. Mr. Grisa stated the ordinance is set up to establish safe transportation facilities and these are the principles to establish a safer community. Motion by Alderman Mike Hallquist, second by Alderwoman Jenna Meza to approve the driveway access control ordinance. Motion carried 5-0. d) Perpetual and temporary pathway easement-Brookfield Square, Moorland Road Alderman Blackburn asked if this is a necessary step in order to go through the engineering study to be included in the Moorland Road project. Mr. Grisa said it is necessary in order for the plat that the County is submitting for approval to preserve the City’s right to build the sidewalk. Alderman Hallquist asked if there are any negative repercussions of taking the easement if the City does not go forward with building the sidewalk. Mr. Grisa said the mall could ask for the easement back because the sidewalk was not built. Motion by Alderman Chris Blackburn, second by Alderman Scott Berg to approve the perpetual and temporary pathway easement for Brookfield Square. Motion carried 5-0. 6. Adjournment Motion by Alderman Scott Berg, second by Alderman Chris Blackburn to adjourn the meeting at 7:45pm. Motion carried 5-0.
