CITY OF BRUSH! MINUTES OF THE DECEMBER 11, 2017 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on December 11, 2017. Mayor Chuck Schonberger called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Chuck Schonberger Councilor Jeanine Anderson Councilor Rick Bain Councilor Heath Becker Councilor Kimberly Dykes Councilor Vicky Quinlin Absent: Councilor Marlene Baker Also present were City Administrator Monty Torres, City Attorney Robert Chapin, Assistant City Administrator Karen Schminke, Finance Director Joanne Gosselink, Police Chief Travis Anderson, Assistant Fire Chief Ray Uhrick and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of November 27, 2017, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Public Hearing to Adopt the 2018 Budget. Mayor Schonberger opened the public hearing at 6:01 p.m. to hear comments on the proposed 2018 Budget. Finance Director Gosselink stated that the amount received from the Highway User’s Tax Fund for 2017 was $145,000 and was used to defray costs of street maintenance. The budgeted Council Proceedings –December 11, 2017 1 amount from the Highway User’s Tax Fund for 2018, is $140,000. She added that there had been several opportunities for public input during the Budget process. A public hearing was held on September 25, 2017 where department heads presented line item requests. October 9, 2017, the proposed budget was presented. October 23, 2017, a public hearing was held and department heads presented capital improvement requests. A budget work session was held on November 13, 2017. There was no one present from the public to provide comments. Mayor Schonberger closed the public hearing at 6:03 p.m. Resolution No. 2017- 16 Adopt the 2018 Budget Councilor Quinlin offered a motion, second by Councilor Dykes to approve Resolution No. 2017- 16 to Adopt the 2018 Budget. Councilor Anderson asked if there were two police cars included in this budget. Finance Director Gosselink answered that was correct. The roll call vote was unanimous. Resolution No. 2017-17 Appropriating Funds Councilor Dykes offered a motion, second by Councilor Quinlin to approve Resolution No. 2017-17 Appropriating Funds. The roll call vote was unanimous. Resolution No. 2017-18 Set Mill Levy - Councilor Becker offered a motion, second by Councilor Dykes to approve Resolution No. 2017- 18 Setting the Mill Levy. The roll call vote was unanimous. Resolution No. 2017–19 Confirming the Denial of a Special Use Permit for Mastronardi Produce-USA, Inc., for Workforce Housing in an Industrial Zone at 1500 South Clayton Street, Brush, Colorado Councilor Becker offered a motion, second by Councilor Dykes to approve Resolution No. 2017- 19 Confirming the Denial of a Special Use Permit for Mastronardi Produce-USA, Inc., for Workforce Housing in an Industrial Zone at 1500 South Clayton Street, Brush, CO. The roll call vote was unanimous. Council Proceedings –December 11, 2017 2 English Annexation Petitions 1-4 – Council Authorizing Mayor to Sign Petitions Community Development Director Schminke presented the four annexation petitions to council which would initiate the process to annex the Brush Agri Park previously known as English Feedlot. Councilor Bain offered a motion, second by Councilor Dykes to authorize the Mayor to sign the four annexation petitions. The roll call vote was unanimous. Resolution No. 2017-20 Accepting the Petitions for English Annexation & Setting Hearing Date for January 22, 2018 Community Development Director Schminke presented the Resolution and previous mentioned petitions for Council consideration, setting the public hearing for January 22, 2018, for the annexation of Brush Agri Park property. Councilor Becker offered a motion, second by Councilor Quinlin to approve the resolution accepting the petitions for English Annexation and setting the public hearing for January 22, 2018. The roll call vote was unanimous. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Dykes to approve City bills from November 27- December 11, 2017. The roll call vote was unanimous. General Fund $ 68,359.01 Capital Improvement Fund $ 1,884.86 Capital Reserve Fund $ 813.97 Water Fund $ 47,311.59 Trash and Garbage Fund $ 9,360.70 Waste Water Fund $ 24,007.60 Storm Water Fund $ 1,043.29 Golf Course Fund $ 11,003.66 Police Forfeiture & Confiscation Fund $ 3,500.00 Payroll and Cafeteria $ 62,841.51 Payroll Liability $ 37,501.85 Disbursements Total $ 267,628.04 Council Proceedings –December 11, 2017 3 STAFF REPORTS Police Chief Anderson • Reported that last week the police department participated in a search warrant in Yuma, County that resulted in drugs being confiscated. Fire Department • Reported a successful bingo event, approximately 100 citizens participated and they raised $700. • Reminded everyone of the high fire danger. City Clerk Strand • Highlighted upcoming meetings on the calendar. City Administrator Torres • Reported that the bid opening and interviews were held for the fire department building expansion project. We received 5 bids, 3 were interviewed and the committee selected Buildings by Design, LLC as the successful bidder. The Rural Fire Board will approve this at their meeting and it will come before Council on December 18. • A decision has been made to handle the golf course parking lot in house, Lance will be working on this project. • At the next council meeting Chief Anderson can practice an emergency situation. MAYOR AND COUNCIL The Executive Sessions for the City Administrator and City Clerk will be held at the December 18, 2017, council meeting. Councilor Anderson reported that she had obtained a restraining order against Mayor Chuck Schonberger. City Attorney Chapin added that it excluded council business and council meetings. She also added that through an open record request she had obtained 18 emails between Glenda McNabb and City Clerk Andrea Strand. She was going to address these in the City Clerk’s evaluation.
