CITY OF BRUSH! MINUTES OF THE JUNE 25, 2018 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on June 25, 2018. Mayor Charles R. Bain called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Charles R. Bain Councilor Jeanine Anderson Councilor Marlene Baker Councilor Heath Becker Councilor Vicky Quinlin Councilor Daniel R. Scalise Absent: Councilor Dana Sherman Also present were City Administrator Monty Torres, City Attorney Bo Chapin, Assistant Administrator Karen Schminke, Finance Director Joanne Gosselink, Community Service Director Lance Schwindt, Police Chief Travis Anderson, and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of the June 11, 2018, were approved as corrected. VISITORS AND DELEGATIONS Police Chief Travis Anderson introduced City of Fort Morgan Public Safety Officer Paul Schultz who together commented on the semi-truck event that occurred throughout Morgan County thanking all of the officers involved. Corporal Ross Blank was presented the Award of Merit for his acts during the event. He accepted the award along with his wife and son. Corporal Blank then presented a special coffee mug and other items to citizen, Brady Sittner, who came to his aid that night. Jeanette Corbin who resides at 16200 Co Rd 28.5, Brush, stated her concern with Councilor Jeanine Anderson’s FB page. She stated that individuals are being blocked or banned from the page. Concerned that freedom of speech is not being allowed. Kat Hall who resided on South Curtis Street also spoke of Councilor Anderson’s FB page being posted as a Government Page and using the City logo. She felt if this was a private page it should not have the City logo or Government wording on it. She has been blocked from Councilor Anderson’s page and she would like to communicate her concerns of the lack of water at the dog park. She also felt the majority of posts on the page were about hate and not relevant to the citizens in Ward 3. Council Proceedings – June 25, 2018 1 Councilor Anderson read her etiquette posting on her FB page that she says is private as she has not been able to remove the Government site from her page. She read: The public page is a courtesy and a privilege for my Ward 3 constituents, not part of my duties as a councilor, but as a means to post information, and to separate my private from public life. The page is not subject to CORA. Threats, intimidation, bullying, personal attacks, harassment, crap flooding or inciting violence aren’t tolerated. Put another way, if it’s against the law outside of FB, it’s not allowed here either. East Morgan County Library can find you resources on proper etiquette. If you can’t be civil, you’ll be banned without a warning. She went on to say that the page provides contact information as she was having problems getting messages from citizens. Mayor Bain asked the City Attorney to research this issue. MANAGEMENT Approve Final Settlement with Buildings By Design for the Completion of The Course at Petteys Park Parking Lot Project Councilor Quinlin offered a Motion, second by Councilor Becker to approve the final settlement with Buildings By Design for the completion of the Course at Pettey’s Park Parking Lot Project. It was approved by unanimous roll call vote Approve Final Settlement with Premier Earthworks & Infrastructure, Inc. for the Completion of English Water Lines Project. This item will be placed on the next agenda. First Reading of Ordinance No. 872-18 An Ordinance Approving that Certain Lease Between the City of Brush, Colorado, and Commnet Cellular Inc., DBA Verizon Wireless, Dated June 25, 2018, for an Initial Term of Five Years With up to Three Addition at Five Year Terms, for an Area of Approximately 900 Square Feet, for an Initial Base Rent of $18,000 Annually. The Ordinance was introduced by Councilor Scalise a motion made by Councilor Quinlin, second by Councilor Baker to approve on first reading Ordinance No. 872-18 An Ordinance Approving that Certain Lease Between the City of Brush, Colorado, and Commnet Cellular Inc., DBA Verizon Wireless, Dated June 25, 2018, for an Initial Term of Five Years With up to Three Addition at Five Year Terms, for an Area of Approximately 900 Square Feet, for an Initial Base Rent of $18,000 Annually, and publish in full in the Brush News Tribune. The motion was approved unanimously by roll call vote. Council Proceedings – June 25, 2018 2 Revised Engagement Letter from Lauer, Szabo and Associates Finance Director Gosselink presented a revised engagement letter for the annual City audit by Lauer, Szabo and Associates. They found it not necessary to prepare a single audit so the quote was reduced by $2,700. Councilor Scalise offered a motion to approve the revised engagement letter, second by Councilor Quinlin. It was approved unanimously by roll call vote. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Becker to approve City bills from June 11-25, 2018. The motion was approved unanimously by roll call vote. Finance Director Gosselink responded no, that large purchases had been made for the English Waterline project and fire department expansion. STAFF REPORTS Community Service Director Schwindt  Reviewed the last few weeks activities; golf tournaments, Brush Rush, Summer Sizzler Tournament. City Clerk Strand  Announced upcoming meetings and other announcements.  The Local Liquor Licensing Authority has received a transfer of ownership for the liquor license at Kart Liquors.  Reported that ordinances will be published in the Brush News Tribune after the Council meeting which will cause a later date for second reading. Council Proceedings – June 25, 2018 3 City Administrator Torres  Reported on the status of the fire department building. October is the estimated completion date.  Reported that during the CML Conference he attended a ADA session and will work on updating our policy. MAYOR AND COUNCIL REPORTS Councilor Becker  Inquired on the status of the ballot issue. It was discussed that it would be on the next agenda. Councilor Scalise  Provided a report on sessions he attended at the recent CML Conference. DOLA, Tax cut bill, HSA exemptions, affordable housing, Harassment in the work place, school safety and HEAL City Campaign. Mayor Bain  Reported that he attended a session on municipal court indigent jail sentencing. He asked that ordinances be reviewed to remove jail time for offenses.
