A.J. Tarman, Buellton, requested traffic enforcement along Highway 246 to slow vehicle speeds through Buellton. CONSENT CALENDAR Council Member Silva recused himself from Consent Calendar Item 4 due to the proximity of his residence to the project location listed in Resolution No. 23-21. 1. Vice Mayor Sanchez thanked Kathy Vreeland and the Buellton Chamber of Commerce for hosting a ribbon cutting event at Rock 12 Distillery on November 3. City Council Meeting Minutes Page 3 November 9, 2023 WRITTEN COMMUNICATIONS None COMMITTEE REPORTS Mayor King announced that he attended the Santa Ynez Valley Community Aquatics Foundation meeting and provided an oral report for the record. BUSINESS ITEMS 5. Discussion of Enchanted Garden Holiday Lights Festival and Cowboy Christmas Events RECOMMENDATION: That the City Council consider allowing deviations from adopted policy pertaining to size and frequency limits of events in River View Park, in order to allow both the Enchanted Garden and Cowboy Christmas events for 2023 and authorize the City Manager to review and approve future applications for both events. STAFF REPORT: Planning Director Keefer presented the staff report. SPEAKERS/DISCUSSION: The City Council discussed potential parking issues surrounding River View Park. Andres Nuño, with En Fuego Events discussed the Enchanted Garden Holiday Lights Festival and thanked the Council for their support. Bob Sweeney, representing SYV Horseback Rides spoke about the “Cowboy Christmas” event and thanked the Council for their support. Consideration of a Request for Funds to Purchase Decorations for Winter Fest RECOMMENDATION: That the City Council consider authorizing the expenditure of General Fund monies in an amount not to exceed $5,000 for the purpose of purchasing commercial-grade decorations for the annual Winterfest event. STAFF REPORT: City Manager Wolfe presented the staff report. SPEAKERS/DISCUSSION: The City Council discussed the potential of displaying a live Christmas tree in Buellton. Kathy Vreeland, Executive Director of the Buellton Chamber of Commerce and Visitors Bureau thanked the Council for their support of decorations for Winter Fest. MOTION: Motion by Council Member Silva, seconded by Vice Mayor Sanchez, authorizing General Fund monies in an amount not to exceed $5,000 for the purpose of purchasing commercial- grade decorations for the annual Winterfest event and requesting staff to prepare the necessary budget amendment to accommodate this expenditure. VOTE: Motion passed by a roll call vote of 3-1, with Council Member Hornick voting no. Council Member Hornick – No Council Member Sanchez – Yes Council Member Silva – Yes Mayor King – Yes 7. SYV Horseback Rides – Proposal to Modify License Agreement for Proposed Expansion of Use RECOMMENDATION: That the City Council consider use expansion for SYV Horseback Ride facility. STAFF REPORT: Planning Director Keefer presented the staff report. City Council Meeting Minutes Page 5 November 9, 2023 SPEAKERS/DISCUSSION: The City Council discussed the following issues: • License agreement process • How best to use the subject property in the future • Various concerns surrounding the proposed use expansion Bob Sweeney, representing SYV Horseback Rides spoke about the expanded uses at SYV Horseback Ride facility and thanked the Council for their support. MOTION: Motion by Council Member Silva, seconded by Council Member Hornick approving the proposed changes in operation for SYV Horseback Ride facility and authorizing an application to be filed with the Planning Commission to amend the Conditional Use Permit. McMurray Road/Highway 246 Improvement Project RECOMMENDATION: That the City Council consider upholding the bid protest filed by Taylor Jane Construction, reject the RDZ bid, and award the McMurray Road/Highway 246 Improvement Project construction contract to Taylor Jane Construction in the amount of $1,020,241.00, plus a contingency amount of 10% ($102,024.10), total contract amount of $1,122,265.10, and approve a budget adjustment of $922,265.10 to Project 092-307. STAFF REPORT: Public Works Director Hess presented the staff report. SPEAKERS/DISCUSSION: Pedro Rodriguez, Owner of Rdz Contractors, Inc., discussed his bid appeal, distributed handouts for the record, and answered questions from the Council regarding the project. City Attorney Murphy explained the bid appeal process, the confusion surrounding the project’s bid, and the recommended path going forward, including rebidding the project. MOTION: Motion by Council Member Silva, seconded by Council Member Hornick directing staff to rebid the McMurray Road/Highway 246 Improvement Project. City Council Meeting Minutes Page 6 November 9, 2023 VOTE: Motion passed by a roll call vote of 4-0. Establishment of City Council Priorities for 2024 The City Council agreed by consensus to move Item 9 to the December 14, 2023 agenda. 10. Consideration of Investigating Extended Library Hours RECOMMENDATION: That the City Council consider expanded Library hours and direct staff accordingly. STAFF REPORT: City Manager Wolfe presented the staff report. SPEAKERS/DISCUSSION: The City Council discussed conducting a study to expand Library hours and possibly incorporating “Friends of the Library” volunteers to assist at the Library. DIRECTION: The City Council agreed by consensus to conduct a study to determine whether Library hours should be expanded and the potential of adding volunteers to assist at the Library. CITY MANAGER’S REPORT City Manager Wolfe provided an informational report for the record.
