Adoption of Resolution No. 51, 2023, entitled “A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, ACCEPTING AN AGREEMENT WITH JVA, INC FOR TOWN OF BUENA VISTA INFILRATION GALLERY EXPANSION PROJECT BIDDING, CONSTRUCTION ADMINISTRATION AND ENGINEERING SERVICES.” VI. Public Hearing – Water Dedication and Allocation Policy Should the Board of Trustees approve the adoption of Ordinance No. 16, 2023, entitled "AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA AMENDING CERTAIN PROVISIONS OF THE BUENA VISTA MUNICIPAL CODE CONCERNING THE DEDICATION OF AN ADEQUATE WATER SUPPLY TO SUPPORT DEVELOPMENT, THE PROCESS AND REQUIREMENTS FOR EXTRATERRITORIAL SERVICE, AND THE EVALUATION OF ADEQUATE WATER SUPPLY FOR DEVELOPMENT BASED UPON THE TOWN’S WATER ALLOCATION POLICY.” The Board will consider approving amendments to Chapter 13 and 16 of the Municipal Code related to water allocation, dedication, and reservation. (Estimated time – 30 minutes) B. Public Hearing – The Crossing Major Subdivision Preliminary Plat and Rezoning Should the Board of Trustees approve the adoption of Resolution No. 47, 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING THE PRELIMINARY PLAT FOR THE CROSSING MAJOR SUBDIVISION, PHASE NO. 1.” Should the Board of Trustees approve the adoption of Ordinance No. 17, 2023, entitled " AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA REZONING CERTAIN PROPERTY KNOWN CERTAIN PORTIONS OF BLOCKS 7 AND 11 CROSSMAN’S ADDITION AND ADJACENT RIGHTS OF WAY, TOWN OF BUENA VISTS FROM GENERAL RESIDENTIAL, OLD TOWN OVERLAY (R-2-OT) DISTRICT TO HIGH DENSITY RESIDENTIAL (R-3) DISTRICT AND AMENDING THE TOWN’S OFFICIAL ZONING MAP.” The Board will consider approving a request to rezone The Crossing Major Subdivision and the Preliminary Plat for Phase I. (Estimated time – 45 minutes) C. Carbonate Street – Final Approval Phase I Should the Board of Trustees approve the adoption of Resolution No. 48, 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING A DECLARATION OF AFFORDABILITY COVENANTS FOR THE OCCUPANCY OF CARBONATE STREET PHASE I This Agenda may be Amended Posted at Buena Vista Town Hall, Post Office and www.buenavistaco.gov on Friday, July 21, 2023  DWELLING UNITS WITH CARBONATE STREET APARTMENTS, LLC AND THE CHAFFEE HOUSING AUTHORITY." Should the Board of Trustees approve the adoption of Resolution No. 49, 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING A DEVELOPMENT AGREEMENT WITH CARBONATE STREET APARTMENTS, LLC." The Board will consider passing Resolutions No. 48 and No. 49 to approve a Development Agreement, Restrictive Covenants (deed restriction), and authorizing the Town Administrator to close on the conveyance of property to Fading West. (Estimated time – 30 minutes) D. Public Hearing – Dedication of Portions of South Main Street and proposed changes to Block 25 Alley Right of Way Should the Board of Trustees approve the adoption of Ordinance No. 18, 2023, entitled "AN ORDINANCE OF THE TOWN OF BUENA VISTA, COLORADO, VACATING THE ALLEY LOCATED IN BLOCK 25, TOWN OF BUENA VISTA, COLORADO." Should the Board of Trustees approve the adoption of Resolution No. 50, 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING THE DEDICATION OF A PORTION OF SOUTH MAIN STREET AND THE ALLEY LOCATED IN BLOCK 25, TOWN OF BUENA VISTA AS SHOWN ON THE MINOR SUBDIVISION PLAT OF BLOCK 25, AMENDMENT NO. 2, TOWN OF BUENA VISTA, COLORADO." The Board will consider the dedication of a portion of South Main Street via Resolution No. 50, as well as proposed vacation and re-dedication of portions of the Block 25 alley right of way via Ordinance No. 18. (Estimated time – 5 minutes) IX. TRUSTEE/STAFF INTERACTION The Board discusses items with staff and staff can bring up matters not on the agenda. X. EXECUTIVE SESSION "An executive session pursuant to C.R.S. § 24-6-402(4)(e) to determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and/or instruct negotiators concerning the Town Administrator candidates."
