Adoption of Resolution No. 75, Series 2023, entitled, "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING THE PUBLIC IMPROVEMENT AGREEMENT WITH KRASNOW, LLC FOR THE PROPERTY KNOWN AS LOT 12, BLOCK NO. 2, SOUTH MAIN PUD, PHASE NO. 2." D. Adoption of Resolution No. 76, Series 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPOINTING RANDY POTTERSON AND JASON MAHER AS REGULAR VOTING MEMBERS OF THE TRAILS ADVISORY BOARD." This Agenda may be Amended Posted at Buena Vista Town Hall, Post Office and www.buenavistaco.gov on Wednesday, 22, 2023 VI. PUBLIC COMMENT Citizen participation where the public can sign up prior to the start of the meeting to speak during public comment. Three minutes for matters not on the agenda or for agenda items not scheduled for Public Hearing. You may also email the information to bvclerk@buenavistaco.gov. Neither the Town Board nor Town staff should be expected to respond to matters raised in the Public Comment segment of Board meetings. Nevertheless, Board members will always retain the right to ask questions of the speaker and respond then or later to remarks made by any citizen. Comments made in the Zoom Chatbox will not be discussed or included in the minutes. VII. PRESENTATION Chaffee County Fire Protection District Update VIII. BUSINESS ITEMS A. Public Hearing – 2024 Budget Final Prioritizations Chaffee County Community Foundation Executive Director Betsy Dittenber will present their 2024 Budget requests to the Trustees, and the Board will hold a public hearing on the proposed 2024 Budget to discuss budget requests. Interested persons from the general public may speak and address the Board (three (3) minute limit) as part of the public hearing. (Estimated time – 45 minutes) B. Introduction and First Reading of Building Code Ordinance The Board will have the first reading of the proposed Building Code Ordinance and set a Public Hearing date for the adoption of the ordinance. Should the Board of Trustees approve the adoption Ordinance No. 20, Series 2023, "AN ORDINANCE OF THE TOWN OF BUENA VISTA, COLORADO, REPEALING AND REENACTING ARTICLES II, III, IV, V, VI VII, XII, XIII, XV, XVI, XVIII, AND XIX OF THE BUENA VISTA MUNICIPAL CODE TO ADOPT BY REFERENCE THE 2021 INTERNATIONAL BUILDING CODE, 2021 INTERNATIONAL RESIDENTIAL CODE, 2020 NATIONAL ELECTRIC CODE, 2021 INTERNATIONAL MECHANICAL CODE, 2021 INTERNATIONAL PLUMBING CODE, 2021 INTERNATIONAL ENERGY CONSERVATION CODE, 2021 INTERNATIONAL FIRE CODE, 2021 INTERNATIONAL FUEL GAS CODE, 2021 INTERNATIONAL EXISTING BUILDING CODE, 2021 INTERNATIONAL PROPERTY MAINTENANCE CODE, AND 2021 INTERNATIONAL SWIMMING POOL AND SPA CODE, AND AMENDING CHAPTER 18 OF THE BUENA VISTA MUNICIPAL CODE BY THE ADDITION OF NEW ARTICLE XVIII TO ADOPT BY REFERENCE THE 2023 COLORADO MODEL ELECTRIC READY AND SOLAR READY CODE." (Estimated time – 15 minutes) C. Sportsmens Club Ground Lease Agreement Renewal Request Should the Board of Trustees approve the renewal request through adoption or Ordinance No. 21, Series 2023, "AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA, COLORADO, APPROVING A RENEWAL TERM OF A LEASE AGREEMENT WITH THE BUENA VISTA SPORTMENS CLUB." The Board will consider renewing the Sportmens Club Ground Lease Agreement. (Estimated time – 15 minutes) This Agenda may be Amended Posted at Buena Vista Town Hall, Post Office and www.buenavistaco.gov on Wednesday, 22, 2023 D. Draft of the 2024 Fee Schedule The Board will review the proposed Town Buena Vista 2024 Fee Schedule changes. Sections of the Fee Schedule with suggested changes/deletions/edits include Town Clerk, Airport, Public Works, Recreation, and Police Departments. (Estimated time – 20 minutes) E. 2024 Ballot Language Changing Municipal Elections from April to November Should the Board of Trustees approve the adoption of Resolution No. 77, Series 2023, entitled "A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA, COLORADO, SUBMITTING TO THE ELECTORS OF THE TOWN OF BUENA VISTA AT THE REGULAR MUNICIPAL ELECTION ON APRIL 2, 2024 A BALLOT QUESTION REGARDING WHETHER THE REGULAR ELECTION DATE OF THE TOWN SHALL BE CHANGED TO THE TUESDAY SUCCEEDING THE FIRST MONDAY OF NOVEMBER IN EACH EVEN-NUMBERED YEAR, EFFECTIVE 2026, AND PROVIDING THAT ELECTED OFFICIALS WHOSE TERMS OF OFFICE EXPIRE IN APRIL 2026 SHALL HAVE THEIR TERMS EXTENDED TO NOVEMBER 2026 AND ELECTED OFFICIALS WHOSE TERMS OF OFFICE EXPIRE IN APRIL 2028 HAVE THEIR TERMS EXTENDED TO NOVEMBER 2028 AND SETTING A BALLOT TITLE." The Board will consider approving the ballot language related to changing the date of the regular municipal elections from April to November and the elected official's terms of office. (Estimated time – 10 minutes) F. Engagement of Legal Services Town Attorney Jeff Parker will inform the Board on Per- and Polyfluorinated Substances (PFAS) and advise the Trustees concerning legal considerations in opting out of certain class action settlements with PFAS manufacturers and related PFAS issues. (Estimated time – 15 minutes) G. Communication from the Town Clerk – Topside Annexation The Clerk confirms for the record that the Topside Annexation Petition and all accompanying documents have been received by the Board. The annexation process will follow requirements identified in the Colorado Revised Statutes at subsequent meetings. (Estimated time – 10 minutes) IX. STAFF REPORTS 1. Town Administrator 2. Town Treasurer 3. Recreation Director 4. Airport Manager X. TRUSTEE INTERACTION The Board discusses items of interest for the community and staff. XI. INFORMATION ONLY XII. EXECUTIVE SESSION An executive session to hold a conference with the Town's attorney to receive legal advice on specific legal questions, pursuant to C.R.S. § 24-6-402(4)(b), concerning regulating tree pruning and destruction on private property.
