CALL TO ORDER
A regular meeting of the Planning and Zoning Commission was called to order at 6:00 pm, Friday, March
4, 2022 via Zoom video conferencing by Chair Preston Larimer. Also present were Vice Chair Lynn Schultz-
Writsel, Commissioners Thomas Doumas, Craig Brown, Blake Bennetts, Thomas Brown and Tony
LaGreca.
Staff Present: Planning Director Joseph Teipel, Principal Planner Mark Doering, and Planning Technician
Doug Tart.
PLEDGE OF ALLEGIANCE
Chair Larimer led in the Pledge of Allegiance.
ROLL CALL
Doering proceeded with the roll call and declared a quorum.
AGENDA ADOPTION
Larimer called for approval of the agenda. Commissioner Brown motioned to adopt the agenda as
amended, Motion #1 seconded by Commissioner Doumas. Motion carried.
APPROVAL OF MINUTES
Commissioner Larimer motioned for approval of the February 16, 2022 minutes as amended. Motion #2
was seconded by Commissioner LaGreca. Motion carried.
Commissioner Schultz-Writsel motioned for approval of the February 23, 2022 minutes as amended.
Motion #3 was seconded by Commissioner LaGreca. Motion carried.
PUBLIC COMMENT
Public comments opened at 6:03 pm. With no comments, public comment was closed at 6:03 pm.
NEW BUSINESS
A public hearing for a request for a Minor Subdivision and Preliminary Condominium Plat by Joseph and
Ashley Teipel to consolidate 4 lots into 2 lots and to create 4 condominium units in the MU-1 zone district
for the property located at 124 Mill Street.
Teipel presented his request to the Commission. He stated it was intent to provide ownership of long-term
housing, and if needed they would have the ability to sell them in the future. He also stated that they were
seeking to prevent short-term rentals as part of the condominium documents.
Joy McGee, with RG and Associates, presented the staff report on behalf of the staff.
The Planning and Zoning Commission approved a Special Use Permit for this development at the February
23rd meeting, as well as recommended that the Board of Trustees approve the site plan or the 4-unit small
multifamily residential building in the MU-1 zone district.
While this application meets the threshold for an Administrative Review, the Town Administrator has
referred the applications to the Planning and Zoning Commission for a recommendation prior to final
decision by the Board of Trustees.
After reviewing the application, staff recommended that the Board of Trustees approve the Minor
Subdivision and Condominium Plat with the following condition:
1. Any remaining comments shall be addressed prior to final approval and recordation of the Minor
Subdivision Plat.
Commissioner Doumas motioned to approve the Minor Subdivision with the conditions as stated in the staff
report. Motion #4 seconded by Commissioner Schultz-Writsel. Motion carried.
Commissioner Craig Brown motioned to approve the Preliminary Condominium Plat with the conditions as
stated in the staff report. Motion #5 seconded by Commissioner Larimer. Motion carried.
STAFF / COMMISSION INTERACTION
Doering thanked the Commission for taking the time to have a Friday evening meeting. The
recommendations from the meeting will go to the Board of Trustees on Tuesday, March 8th.
Next Wednesday will be a public hearing for The Farm Phase II Apartments on March 9, 2022. The packet
will be sent out Monday.
On Wednesday March 16th there will be another public hearing for the Stackhaus zoning application.
ADJOURNMENT
There being no further business to come before the Commission, Commissioner Schultz-Writsel motioned
to adjourn the meeting at 6:27 p.m. Commissioner Doumas seconded. Motion #6 was unanimously
approved.

STAFF RECOMMENDATION:
Staff recommends that the Planning and Zoning Commission approve (with conditions) the attached Major
Site Plan for The Farm Phase II Apartments.
• The application is complete and complies with Section 6.5.1 – Site Plan Review of the Buena Vista
Unified Development Code (UDC).
• The request falls within the threshold for a Major Site Plan Review (§16.6.5.1 Table 6.3) for more than
10 dwelling units.
• The property is zoned R-3, and the request is consistent with the intent of the zone district.
• The property is within the Suburban context of improvements. Public improvements are required by
the Developer. The public improvements and the associated Agreement will be reviewed by the Board
of Trustees. That agreement shall be executed prior to the building permit being issued.
The Site Plan covers 136,784 square feet (3.14 acres), described as Lot 1, Block 9, and Tract P. Lot 1 is
121,375 square feet (2.79 acres) in size and proposed to be built with 77-units. Tract P is 15,409 square
feet (0.35 acres) in size and was platted as public use open space for the overall Farm community and
contains a drainage detention infiltration pond for The Farm – Phase II.
The site is currently undeveloped. The development of the 77 dwelling units is proposed to be phased in
conjunction with the related improvements to support the residential development. The improvements
proposed include the installation of sidewalk, curb, gutter, asphalt paving, the infiltration pond,
stormwater facilities and drainage control structures, sanitary sewer, a private water main, and
landscaping.

SITE PLAN CONDITIONS:
1. Any remaining review comments by referral agencies that remain outstanding at the time of this public
hearing shall be addressed prior to final approval of the Site Plan.
2. The proposed uses for purposes of this site plan are large multifamily residential units (77 units) in
three apartment buildings on Lot 1 and open space on Tract P. Any changes to those proposed uses,
including changes to the number of units, will be subject to all applicable Town regulations at that
time, and must be approved by the Town prior to those proposed changes being allowed on the
property.
3. The Site Plan for the residential buildings shall be corrected for any building code requirements, if
needed. Prior to a Certificate of Occupancy, all corrected drawings shall be digitally submitted to the
Town for its records, including any changes affecting the approved Site Plan drawings.
4. All lighting shall be downcast and shielded to comply with Town requirements and shall be inspected
and approved by the Town prior to the issuance of the certificate of occupancy. If any lighting issues
are identified (glare, light spill, intensity, etc.), the Owner shall be responsible for making corrections
as needed to minimize light pollution.
5. Prior to building permit being issued, the Owner shall execute a Public Improvements Agreement with
the Town for the public improvements required by this approval.
6. Prior to any vertical construction, all infiltration galleries and detention facilities shall be installed and
inspected for compliance with the approved construction plans by the Town.
7. Prior to Certificate of Occupancy, the public improvements for Barnwood Drive and Weathervane
Lane shall be installed, inspected, and preliminary accepted by the Town.
8. Prior to the installation of any sign(s) or any change of sign face, the Owner or tenant must obtain a
sign permit in accordance with the applicable provision of the Code.
9. Cash-in-lieu payments are required. A school fee-in-lieu will be paid for each new residential dwelling
unit at the time of building permit.

1. SUMMARY OF REQUEST
The development request is for Lot 1, Block 9, and Tract P of The Farm – Phase 2and is 3.14 acres of the overall
9 acres subdivided as the Farm Subdivision, Filing No. 1, Amendment No. 3. Block 9 is proposed with 77
multifamily units with related infrastructure in to be installed in sub-phases, over a period of 2 years, as
identified on sheet 2 of the Site Plan submittal.
The Site Plan proposes the development of three multi-family buildings:

• Proposed Building #1: Three-stories, 31.75’ in height, 42-units (12 studio units, 21 one-bedroom units,
and 9 two-bedroom units)
• Proposed Building #2: Three-stories, 31.75’ in height, 30-units (12 studio units, 12 one-bedroom units,
and 6 two-bedroom units)
• Proposed Building #3: Two-stories, 25.56’ in height, 5-units (3 two-bedroom units, and 2 three-bedroom
units)
Following the approval of a Major Site Plan, the development of the property is subject to building permit
review and approval. Prior to building permits being issued, the Owner shall execute a Public
Improvements Agreement with the Town for the public improvements required by this approval. Prior to
a Certificate of Occupancy, staff will require the public improvements for Tract P, Barnwood Drive, and
Weathervane Lane to be installed, inspected, and preliminary accepted by the Town.
Per the applicant: Fading West Properties (FWP) will begin pre-leasing the Farm Apartments in 2022.
Initially we will notify the large workforce employers in Chaffee County – such as Heart of the Rockies
Medical Center, Sangre de Cristo Electric, Chaffee County School districts, Buena Vista Correctional Complex
as well as other local businesses that have a large workforce presence (such as Fading West and Mt.
Princeton Hot Springs). We will then open the units up to the general public with the intent of pre-leasing
the entire complex.
2. HISTORY AND BACKGROUND
Title work was provided and reviewed for the subject property to confirm:
• the ownership and authority to process the application,
• the legal description used in the chain of title for the property, and
• to review title exceptions (schedule B-II).
The area subject to this site plan (owned by Wayfarer Development, LLC) is currently described by the Chaffee
County Assessor records as:
• LOT 1 BLOCK 9 THE FARM MAJOR FILING AMENDMENT NO 3

The property is zoned R-3 (High Density Residential). It was rezoned in 2017 from R-2 to R-3 to support the
overall proposed development of the Farm Subdivision. The initial development of Block 1 (ten lots) was
created through the Farm Major Subdivision. The plat was reconfigured through three amendments to
adjust the corner lot configurations, adjust the lots in Block 1 to add individual lots for one five plex, and
to plat the lots in Lot 1, Block 6 (the Farm Major Subdivision, Phase 1 platted the subject property as one
large lot (Lot 1, Block 6) when it was approved in 2018).
The Phase 1 development consists of 90 single-family detached and attached units. The Phase 2
development (as approved in 2021) consists of 51 single-family detached and attached residential units. As
noted in the Phase 2 approval, a separate Site Plan review is required for the subject property and will add
an additional 77-units within Phase 2.

3. PROCESS
The site plan application is subject to Section 6.5.1 of the Town of Buena Vista’s Unified Development Code
(UDC). The Site Plan procedures provide a major site plan review process for the Planning and Zoning
Commission to evaluate a residential site plan that is more than 10 dwelling units. A review has been
completed. Noticing requirements have been met and the Planning and Zoning Commission has
jurisdiction to hear and review the case.
The public improvements and the associated Agreement will be reviewed by the Board of Trustees. That
agreement shall be executed prior to building permits being issued.
4. ZONING AND LAND USE
The property is zoned R-3 (High Density Residential). The small and large multi-family dwelling uses
proposed are allowed uses within the R-3 District. The site plan demonstrates compliance with the purpose
of the R-3 District (UDC §2.3.4):
• A broad range of residential use types, including single-family and multi-family residential development
at medium- and/or high-densities.
• Locations close to commercial and mixed-use areas, near downtown, and may serve as a transition
between lower-density residential districts and commercial or other non-residential areas.
• Have connected streets, and accessibility to public uses such as parks, open spaces, and schools.
The Site Plan demonstrates compliance with the dimensional standards for the R-3 District (UDC §2.3.4 – Table 2.7).

5. ANALYSIS – Major Site Plan
Staff has reviewed and referred the development to the appropriate service providers and review agencies
for review comment and have conducted a thorough review of the civil plans for compliance with the
Town’s standards.

The Planning and Zoning Commission shall review the Major Site Plan pursuant to the criteria below and
can:
• make a determination to approve, approve with conditions or deny the application.
• remand the Major Site Plan back to the Town Staff for further consideration and/or additional
information.
• refer to the Board of Trustees, in which case the Planning and Zoning Commission shall provide a
recommendation of approval, approval with conditions, or denial of the major site plan to the
Board of Trustees.
Section 6.5.1 of the UDC provides specific review criteria for Major Site Plans. Each criterion for the Major
Site Plan is shown below in bold text with staff’s analysis following each criterion in standard text.
i. The site plan is consistent with the Comprehensive Plan and other adopted Town policies and plans.
The proposed site plan supports the Goals of the Comprehensive Plan and Town policies. The proposed
site plan provides for development of new housing that is using vacant and underdeveloped parcels
within the community and for the creation of housing with a range of opportunities and choices.
The list of goals and policies from the Comprehensive Plan that the proposed Major Site Plan is
consistent with are:
• Support the development of workforce housing to incentivize good employees relocating to and
remaining in Buena Vista.
• Development should generally pay its own way…
• Buena Vista will promote the development of a range of housing opportunities and choices.
• New housing quality will be governed by building and site design standards in the municipal code
which will be informed by the community’s values and history.
• Buena Vista will maintain and enhance the community’s overall appearance. Land uses shall be
compatible with adjacent uses and respect historic properties.
• Encourage density, infill, and adaptive reuse of structures.
• Encourage public-private partnerships and clearly define required fees for expansion of
infrastructure.
• New and existing development will closely consider accessibility, parking, and alternative
transportation.
• The Town will consider new and existing development for its environmental impacts and seek to
minimize the environmental footprint of development to the greatest extent possible.
The proposed site plan supports the following intentions of the Unified Development Code:
• Guide the future growth and development of the Town in accordance with the Comprehensive
Plan.
• Promote in-fill development with adequate public facilities in existing neighborhoods and non-
residential uses.
• Ensure that public facilities and services are available with sufficient capacity to serve proposed
development, and that development provides its fair share of capital facilities needs generated
by the development.

ii. The site plan is consistent with any previously approved plan, planned unit development, and/or any
other precedent land use approval.
The proposed site plan is consistent with the previously approved sketch plan for The Farm Subdivision
that was reviewed before the overall subdivision was created. It is also consistent with the approved
final plats for Phase 1 and Phase 2. No changes to the roads or open spaces have been created that
reduce the open space or alignment of the future roads within Phase 2, and no additional units have
been requested over the total number of units within the approvals for the subdivision.
iii. The site plan complies with applicable standards in this UDC.
The site plan was submitted and accepted subject to Section 6.3.2. The plan was prepared by licensed
professionals and was subject to a thorough review by referral agencies and determined by staff to
meet the requirements of the UDC.
The High-Density Residential (R-3) district is intended for a broad range of residential use types, including
single-family and multi-family residential development at medium- and/or high-densities. It is intended for
locations close to commercial and mixed-use areas, near downtown, and may serve as a transition between
lower-density residential districts and commercial or other non-residential areas. It is also intended to have
connected streets, and accessibility to public uses such as parks, open spaces, and schools.
The following statement of purpose appears on the Major Site Plan: The intent of this project is to
construct a multifamily development. The Site consists of 3.6 acres (more or less) generally located at
Barnwood Circle and Antero Circle, Buena Vista, CO 81211. The total of proposed units included in this
site plan is 77.
The site plan has addressed the R-3 zone district standards listed in the Unified Development Code.
Trash screening and lighting have also been addressed to meet code standards with the site plan review
for this development. The R-3 zone district standards and the proposed development as shown in the
Major Site Plan are shown in the site data on Sheet 1 and in the chart below.

The open space within Tract P will be owned and maintained by the subdivisions’ homeowner’s
association, and not by the Town, as authorized by the Board of Trustees with the first subdivision
approval. The following statements on ownership and maintenance appear on the Major Site Plan:
Each building permit will be reviewed to ensure that the applicable minimum parking, maximum
height, and minimum setback standards of the R-3 zone district are met prior to issuing a building
permit.
6. DEVELOPMENT REVIEW REFERRAL
This application was submitted to the Town of Buena Vista, Chaffee County, and affiliated review agencies,
including all public utilities serving the site. All comments were addressed through the staff review process.

In addition, public notice of the administrative decision was sent to property owners within 300 feet of the
site at least 15 days ahead of the Planning Commission’s review and decision on the application. 38 public
notice postcards were sent February 16th with a deadline of March 9th (Attachment C).
The Board of Trustees will review the Public Improvements Agreement. If the Planning and Zoning
Commission approve the Major Site Plan, no additional public meetings in front of the Board of Trustees
are required.

7. CONCLUSIONS AND RECOMMENDATION
Based upon the information and materials provided by the applicant and included in the staff report, staff
supports the requested Major Site Plan. Therefore, staff recommends that the Planning and Zoning
Commission approve with conditions The Farm Phase II Apartments Major Site Plan.
1. The applicant has requested approval of a Major Site Plan for a multi-family development with 77 units
and one open space tract; and
2. The applicant has submitted an application meeting the submittal requirements of the UDC; and
3. The request was reviewed by the appropriate referral agencies for their review and final comments
are being addressed; and
4. Notice of the public hearing was posted on the property and published in the newspaper as required
by the Unified Development Code, and
5. The Major Site Plan is consistent with the 2015 Comprehensive Plan; and
6. The Major Site Plan is consistent with the previously approved plans and/or other precedent land use
approvals for The Farm Subdivision; and
7. The Major Site Plan complies with applicable standards in this UDC.
THEREFORE
If the Planning and Zoning Commission accepts the findings, conclusions, and recommendations for this
Major Site Plan as presented in this staff report, the Planning and Zoning Commission should APPROVE
The Farm Phase II Apartments Major Site Plan, with the following conditions:
1. Any remaining review comments by referral agencies that remain outstanding at the time of this public
hearing shall be addressed prior to final approval of the Site Plan.
