Adjournment Minutes of the Regular Meeting of the Buena Vista Planning and Zoning Commission April 3rd, 2024 CALL TO ORDER A meeting of the Planning and Zoning Commission was called to order at 7:00 p.m., on Wednesday, April 3rd, 2024, at the Community Center by Vice Chair Tony LaGreca. APPROVAL OF MINUTES Commissioner Blake Bennetts motioned to approve meeting minutes from March 20th, 2024, as presented. Commissioner Thomas Brown seconded. Motion #2 passed. PUBLIC COMMENT Public comment was opened at 7:05 p.m. With no comments, public comment was closed at 7:06 p.m. NEW BUSINESS LaGreca introduced new business item #1 at 7:07 p.m. by opening the Public Hearing for the Rezoning of 150 Gregg Circle from I-1 to H-C by applicants James Weiner of Buena Vista, CO and Justin Burns of Howard, CO. Planning Director Benson presented an overview of the application documents, the process for reviewing the Rezoning application, and the criteria for approval. The Applicants gave a presentation describing their background of ownership in relation to the Colorado Center PUD and goals for development under the proposed H-C zoning criteria, with an understanding that the Airport Protection Overlay District could present some additional requirements if a Special Use Permit and/or Site Plan are pursued at a future date. Benson gave a staff report providing further details on the application, an overview of the existing zoning, the Airport Protection Overlay District requirements, Colorado Center PUD background, public noticing, application review process, and Municipal Code criteria for approval of a Rezoning application. Public Comment for the Public Hearing was opened at 7:32 p.m. With no public comment, this portion of the hearing was closed at 7:33 p.m. Commissioners then asked clarifying questions. At 7:51 p.m. LaGreca closed the public comment portion of the Public Hearing to allow for Commissioner deliberation. At 7:53 p.m. Thomas Brown made a motion to recommend to the Board of Trustees of the Town of Buena Vista that they approve the rezoning at 150 Gregg Circle from Light Industrial (I-1) to Highway Commercial (H- C). Blake Bennetts seconded the motion. Motion #3 carried. At 7:56 p.m. LaGreca opened Business Topic #2, the review and selection of the 2025 Comprehensive Plan firm. Benson presented a summary of the top 2 firms as rated by Staff and Commissioners. Discussion ensued including topics such as the process of review and selection, firm qualifications, water integration requirements and how they relate to DOLA’s grant, 2025 Comprehensive Plan goals, and community engagement needs. At 8:36 p.m. Blake Bennetts made a motion to recommend to the Board of Trustees of the Town of Buena Vista that the firm SE-Group be named as the leading candidate, with Community Builders as a secondary choice, and the option to reevaluate Cushing-Terrell and RICK Engineering pending contract negotiations should either of the first two options fail to reach contractual agreement. Respectfully submitted: Preston Larimer, Chair Caroline Mahoney, Planner I DATE: April 9, 2024 TO: Planning and Zoning Commission FROM: Grant Bryans, Code Enforcement Officer RE: Zoning changes to the Industrial Zone MEMO Background Over time, my office has noticed a gap between what our Municipal Code has in it and what is needed from its citizens in the Industrial (I) Zone of Buena Vista. What we have currently does not allow for a place of manufacturing to store their goods after they are made but before delivery. Currently, if a factory were to procure another vacant lot to store their goods on, this would not be in compliance with the Town’s code. Screening of goods cannot be the primary use of a vacant lot; the lot would need primary use to store its goods. The way the Code is currently set up, a business would have to make significant investments to store its goods. The code allows building materials and storage as a use-by-right in nonresidential districts but does not allow storing manufactured goods. If the Town were to continue seeing industry and manufacturing enter Town, changing this would help those businesses see their goals. We propose changing the uses in the (I) zone to allow the storage of manufactured goods as a special use permit. Code Enforcement sees no issues with this code change. This change makes it more attractive for factories and gives the Town the freedom to look at each case individually to make recommendations for each case. Policy What is being proposed is a simple code change to Chapter 16, section 3.1.4 of the Buena Vista Municipal Code in the table of allowed uses through a special use permit. The change would be to add “Screened storage of finished manufactured products” for industrial use. This would come with an asterisk: "Only manufactured products finished at manufacturing facilities located in the Town of Buena Vista may be stored for special use. Screening and fencing standards outlined in Section 4.4.6 shall apply subject to modification as a part of the final approved special use permit.” This means we would allow for the storage of manufactured goods but not in a blanket policy. This policy allows the Planning and Zoning Commission to look at each case individually and make recommendations that make sense for the use and impact that each manufacturer would have. Conclusion We ask the commission to motion to provide a recommendation to the Board of Trustees to approve, approve with amendments, or deny this Ordinance, or otherwise give feedback to staff to continue the Hearing. Thanks, TOWN OF BUENA VISTA, COLORADO ORDINANCE NO. ___ (SERIES OF 2024) AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA AMENDING SECTION 3.1.4 OF ARTICLE 16.03 OF CHAPTER 16 OF THE BUENA VISTA MUNICIPAL CODE TO ADD THE SCREENED STORAGE OF FINISHED MANUFACTURED PRODUCTS AS A SPECIAL USE IN THE I-1 ZONE DISTRICT WHEREAS, the Buena Vista Unified Development Code currently permits enclosed and screened storage as an accessory use in the I-1 zone district, but does not permit outdoor storage of any kind as a primary use in the I-1 zone district; WHEREAS, the Board of Trustees recognizes that certain manufacturing activities in the I-1 zone district may require substantial outdoor storage for finished manufactured products and that property other than the property where the manufacturing occurs may be required for such storage; WHEREAS, the Board of Trustees desires to support manufacturing operations in the I-1 zone district while limiting its impact on the surrounding area and the aesthetics of the Town; WHEREAS, allowing parcels of land to be used for the storage of finished manufactured goods as a special use in the I-1 zone district will support the needs of manufacturers in the Town while allowing the Town to consider the specific impacts and needs of individual manufacturers and while further allowing the Town to tailor any conditions to the specific application and the surrounding area; and WHEREAS, therefore, the Board of Trustees desires to amend Table 3.1 (Table of Allowed Uses) in Section 3.1.4 of Article 16.03 of Chapter 16 of the Buena Vista Municipal Code to allow the storage of finished manufactured products as a use permitted pursuant to the special use provisions of the Buena Vista Municipal Code. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA, COLORADO, THAT: Section 1. Screening and fencing standards set forth in Section 4.4.6 shall apply subject to modification as part of the final approved special use permit.” Section 2. Severability. If any article, section, paragraph, sentence, clause, or phrase of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of 1 Trustees hereby declares that it would have passed this Ordinance and each part or parts hereof irrespective of the fact that any part or parts be declared unconstitutional or invalid. The Owner shall obtain a liquor license prior to and during its use as a bar or tavern. Process: • This is a Public Hearing. • The Chair of the Commission shall open the Public Hearing. • Staff shall give a very brief rundown of the request and introduce the applicant. • The Applicant is invited to give a short presentation. • Staff shall give a presentation about the request and the criteria for review, including staff interpretation of the fulfillment of the review criteria. • The Commission may ask clarifying questions of the Board or Applicant – to understand some element that was not clear. • The Chair will open the public comment portion of the public hearing. Members of the public may address the proposal. (in person or via Zoom). • The Chair will close the Public Comment portion of the Hearing. • If there are no further clarifying questions, the Chair shall close the public hearing and the Commission shall deliberate and make a motion. SUMMARY OF REQUEST The applicant, Byron Brown, has submitted a Special Use Permit application to be able to serve drinks at the Brown’s Canyon Rafting facility at 28395 CR 317. The applicant states, “Our goal is to provide an additional service to our guests by being able to sell alcoholic beverages to our and Nani’s Bowls (the food truck on property) current clientele. Our clientele are returning from white water rafting trips that we provide, we have a retail store with souvenirs as well as photos displayed from their trips for viewing. These clients typically are families, couples and groups of friends. We want to create a social environment that guests would like to spend time at. Nani’s Bowls rent space on property and sell meals. Their guests are there to dine and may want an alcoholic beverage with their lunch or dinner. These customers consist of locals and out of town tourists as well as our guests returning from rafting trips. We are only planning on being open and selling alcohol through our season which is typically May 1st until Labor Day (September 2nd this year). April 24th to September 22nd would be the maximum date range. Retail shop is open typically from 8am – 6pm. This is dependent on when our last trip returns which varies dependent on water levels and specific trip. Alcohol sales hours will start after all morning rafting trips have departed, approximately 11am until close, typically around 6pm. 10am to 9pm would be our maximum hours of operation daily for alcohol sales. We will sell the beverages from our sales counter and/or the sales window inside our retail building. We are planning on selling canned beverages and having a couple of pre made cocktails. We will use disposable/recyclable drinkware. The pre batched cocktails will be prepared in Nani’s Bowls commercial kitchen/food truck. No modifications to the building will be made. No alcohol will be sold to any guests prior to their trips if they are signed up to go rafting or adventuring with us. We will be actively screening all customers for this. No alcohol will be sold or consumed by any employee that is on duty or scheduled to be on duty for the day. The alcohol area will be inside our retail building and an outside area with a clear alcohol boundary located behind/in between the two buildings on property and the western property line marked by a fence. This area will have picnic tables and seating options. Currently we do not have any planned entertainment. This is something that we would like to grow into one day to possibly have music on location from time to time and be able to set up a April 17, 2024 28395 CR 317 Page 3 temporary outside alcohol sales table at such events. We would abide by all laws and go through the correct channels/permitting prior to such events or outside alcohol sales.” II. HISTORY AND BACKGROUND Brown’s Canyon Rafting has been operating in that location since at least 2019. The property has been used by several other businesses entities. The site is not yet hooked up to water or sewer and further development would trigger connecting to these utilities. The site is currently used as a rafting company and operates during the summer season. A food truck, Nani’s Bowls, also has a temporary vendor permit and has been operating in the parking lot since the fall. There is some storage on the property as well. The bar or tavern use is a special use for the I-1 zone district. The sale of alcohol, which would require a liquor license, is proposed to complement the rafting business by providing guests with libations after a day on the river. III. PROCESS – REQUIRED APPROVALS The applicant submitted a Special Use Permit (SUP) application for the “Bar or Tavern” use as specified in Section 16-6.5.2. of the Town of Buena Vista Unified Development Code (UDC). Staff has reviewed the SUP application and is recommending approval by the Planning and Zoning Commission. Special Use Permit approvals are decided by the Planning and Zoning Commission via public hearing. IV. ANALYSIS – SPECIAL USE PERMIT CRITERIA Section 16-6.5.2. of the Buena Vista Municipal Code provides specific review criteria for a SUP. The Code states that, “the Planning and Zoning Commission shall consider whether” the following criteria are met. There is no language specific to how many criteria or the degree to which. Therefore, the decision is based on inference of the code, standards, and comprehensive plan. The Commission can deliberate and decide accordingly. Each criterion is shown below in bold text and the staff analysis follows each criterion in standard text. I.) The proposed use is consistent with the Comprehensive Plan and the purposes of the UDC. Developing the Economy: April 17, 2024 28395 CR 317 Page 4 • Goal #1: Buena Vista desires to maintain, expand, and promote local businesses and entrepreneurs • Goal #2: Buena Vista will support and expand the role of tourism and tourist-related business in the local economy.  The proposed use expands an existing business and promotes tourist- related business in the local economy. While the policies specific to this Goal relate to Town’s working relationship with other entities and shoulder season/winter activities, an action item does specifically call out that Buena Vista shall “continue to support and promote whitewater-related tourism”, for which this project fits very well. II) The proposed use complies with applicable use-specific standards. Section 3.2.J of the UDC lists use-specific standards for the “Bar or Tavern” use, as follows: 1. Bars and Taverns shall adhere to liquor license requirements regarding hours of operation, location, and other matters regulated by the State. 2. Outdoor dining facilities on private property shall be permitted provided it complies with all other local and state requirements. 3. Outdoor dining facilities in the public right-of-way shall require an encroachment permit from the Town Administrator. 4. A bar or tavern may include provision of live entertainment and/or dancing; however, a bar or tavern shall not include any sexually oriented business use. There is nothing in the proposed use that is inconsistent with these standards. III) The proposed use complies with all other standards in this UDC. The addition of this use to this existing business utilizes existing infrastructure and does not require a building permit nor review of a site plan, outside of the requirements for a liquor license. Currently the property is not served by Town water and this would need to come into compliance with further development of the property. The addition of a special use permit together with the proposed plan would not trigger a correction of the nonconformity, according to the Municipal Code. IV) The proposed use is consistent with the purpose statement of the underlying zoning district. “The I-1 district is intended to allow for the fabrication, assembly, processing, storage, and manufacture of goods and materials with related retail and wholesale activities. The I-1 district is intended for uses and operations within enclosed buildings and in a manner that avoids dangerous, noxious, or unsightly land uses.” This would be a related retail activity to support the rafting business, a use by right in I-1. V) Impacts of the use on the surrounding neighborhood have been adequately minimized. The property meets the parking requirements as specified in UDC Section 16.4.3.4. There are no residences nearby and the surrounding properties would not be impacted. The traffic already April 17, 2024 28395 CR 317 Page 5 entering and leaving the premises would not change. Liquor laws would prevail for any alcohol consumed. VI) The proposed use does not adversely impact the public health, safety, and welfare of the Town. Due to the enforcement of liquor laws, the proposed use will not adversely impact the public’s health, safety, and welfare. However, even with enforcement, there may be an elevated potential for adverse impacts when alcohol is introduced to a situation. VII) There is adequate water available from Town's water system to serve the subject property pursuant to the Town's water allocation policy and subsection 16.04.4.8.1 at the time of application. . Adequate Water is available for the proposed Special Use. CONCLUSION AND RECOMMENDATION Based upon the information and materials provided by the applicant and in the staff report, staff supports the Special Use Permit application for the “Bar and Taven” use at 28395 CR317. Therefore, staff recommend that the Planning and Zoning Commission approve the SUP with the conditions listed in this staff report. 1. Applicant has requested approval of a Special Use Permit to allow for the “Bar or Tavern” use in the I-1 zone district. 2. Notice of the public hearing was posted on the property and published in the newspaper as required by the Unified Development Code; and 3. The request is consistent with the Comprehensive Plan 4. The application is consistent with the applicable standards for a Special Use Permit. THEREFORE A. If the Planning and Zoning Commission accepts the conclusion and recommendation as presented in the staff report, it should APPROVE AS PRESENTED the Special Use Permit in the I-1 zone district for the “Bar or Tavern” located at 28395 CR 317 with the following conditions: 1. The Owner shall obtain and maintain a liquor license prior to and during its use as a bar or tavern. WHEREAS, Mountain River LLC (“Owner”) owns the property described as 28395 CR 317, Town of Buena Vista, Colorado, (“Property”), located in Light Industrial (I-1) Zone District; WHEREAS, pursuant to Table 3.1 in Section 16.03.1.4 of the Buena Vista Municipal Code (the “Code”), in the I-1 Zone District, bars and taverns require a special use permit; WHEREAS, Byron Brown (the “Applicant”) filed an application, on behalf of the Owner, for a special use permit to allow a “Bar or Tavern” use to be located on the Property; WHEREAS, on April 17, 2024, the Planning and Zoning Commission conducted a duly noticed public hearing on the application; and WHEREAS, after reviewing all materials provided to it, and hearing staff and public testimony, the Planning and Zoning Commission desires to approve the special use permit, subject to the conditions set forth herein. BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE TOWN OF BUENA VISTA, COLORADO, as follows: Section 1. The Planning and Zoning Commission, having reviewed the criteria for approval of a Special Use Permit as set forth in Section 16.06.5.2.5.b of the Code, finds that: 1. Subject to the conditions imposed herein, the proposed use is consistent with the Comprehensive Plan and the purpose of the UDC. The proposed use complements existing retail and supports whitewater rafting and the tourism industry. 2. The proposed use complies with the applicable use-specific standards in Section 16.03.2.3.J, subject to the conditions below. 3. The proposed use compliance with all other standards in the UDC shall be evaluated through the Special Use Permit, the approval of which must be obtained prior to use of the property for the Bar or Tavern use. 4. The I-1 zone district is intended to allow for the fabrication, assembly, processing, storage, and manufacture of goods and materials with related retail and wholesale activities. The district is intended to encourage commercial activities such as general retail and sales and storage, including related retail elements to support the economy. The 1 proposed use is consistent with the purpose of the I-1 zone district as proposed. 5. Impacts of the use on the surrounding neighborhood have been adequately minimized. 6. The proposed lodging use of a the limited use ancillary to the seasonal rafting business will not adversely impact the health, safety, and welfare of the Town. Section 2. The Planning and Zoning Commission hereby approves the Special Use Permit, subject to the following conditions: 1. The Owner shall obtain a liquor license prior to and during its use as a bar or tavern. Section 3. As per Section 10.06.5.2, any expansion or enlargement of a special use shall require a new application. The special use permit may be transferred to another person to operate the same use, in the same building(s), on the same property, and under the same terms of the permit. Such transfer shall require approval by the Town Administrator upon a written request by holder and transferee. ADOPTED this ____ day of ________________, 2024.
