Also present were Vice Chair Tony LaGreca, Commissioners Thomas Brown, Craig Brown, Blake Bennetts, and alternates Tina Bennetts, and Michael Westheimer (via Zoom). Staff Present: Principal Planner Joel Benson, Planning Technician Jamie Graves (via Zoom) and Planning Administrative Assistant Ally Kennedy. PLEDGE OF ALLEGIANCE Chair Larimer led in the Pledge of Allegiance. ROLL CALL Kennedy proceeded with the roll call and declared a quorum. AGENDA ADOPTION Larimer called for approval of the agenda. Commissioner LaGreca motioned to adopt the agenda as presented, Motion #1 seconded unanimously. Motion carried. APPROVAL OF MINUTES Commissioner B. Bennetts motioned for approval of the October 16, 2024 minutes as presented. Motion #2 was seconded by Commissioner T. Brown. Motion carried. PUBLIC COMMENT Public comments opened at 7:02 pm. With no comments, public comment was closed at 7:03 pm. NEW BUSINESS Public Hearing: AN ORDINANCE AMENDING MULTIPLE SECTIONS OF CHAPTERS 11, 16 AND 17 OF THE BUENA VISTA MUNICIPAL CODE TO UPDATE AND CLARIFY UNIFIED DEVELOPMENT CODE PROVISIONS: Benson presented proposed changes to the Town’s Municipal Code, reasoning behind proposed changes. The proposed changes are as follows: Section 16.02.2 Summary tables of Dimensional Standards, Table 2.2: For consistency, it is proposed to change building coverage, max. from 50% to 60 % and required landscaping from 20% to 25% under the R-1 Old Town Overlay column to be consistent with other parts of the code. Section 16.04.4.6(E). Prohibited Fencing and Screening Materials: It is proposed to prohibit ‘slab lumber’; it is a building material that is inconsistent. Section 16.07.7.2 Definition of Live-Work: Proposal is to remove the word ‘accessory’, it is misleading as accessory dwelling unit falls under the accessory structure section and a live-work unit is not considered accessory. B. Bennetts amended to change ‘an’ to ‘a’. Section 16.03.3.3.4 Standards for Specific Accessory Uses and Structures, Accessory Dwelling Units, Site Standards: It is proposed that an ADU must have a unique address as required by the International Fire Code. Section 16.04.7.6.F.4 Comprehensive Sign Plan Review Procedures: It is proposed to change the comment period to the Town Administrator be adjusted from within 7 days of the date the application was filed with town to within 7 days of notification to the public. Section 17-71: Deposits—Development/PUD review and processing fees: It is proposed that applicants for both major and minor subdivisions post a deposit toward the payment of review and processing fees at the time of application (Minor and Major Site plan: planning fee/hour: 10 hours, engineering fee/hour: 10 hours, legal fee/hour: 3 hours); and applicants for minor development/PUD approval shall post a deposit at the time of application equal to: planning fee/hour: 5 hours, engineering fee/hour: 2 hours, legal fee/hour: 1 hour. Section 16.02.2.8.2 (C)(2) Measurements and Exceptions. Projections into Setbacks: It is proposed to change ‘fireproof’ to specify metal or concrete to provide greater clarity. Section 16.04.7.2.C.3(b) Banners Applicability: It is proposed to remove the extraneous word ‘the’. Section 11-118 Encroachments on public property-license required: It is proposed that rather than completed encroachment licenses being reviewed by, forwarded from and signed off by the Public Works Department, to be changed to the Planning Department. Larimer opened public comment at 7:15, with no public comments brought forward, public comment was then closed. Motioned to recommend approval of the ordinance with amendments (changing “an” to “a” and staff-recommended removal of a sentence prohibiting wood as a building material for the encroaching stairways) approved by B. Bennetts, seconded by LaGreca, Motion approved unanimously. Public Hearing: AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA AMENDING SECTION 16.05.5.3.6 OF THE BUENA VISTA MUNICIPAL CODE CONCERNING WATER DEDICATIONS Benson proposed changes to the Town’s Municipal Code concerning water dedications. The proposed changes are as follows: Section 16.05.5.3.6(C)(5) Calculation of Water Dedications for Residential Site Plans or Building Permits: It is proposed to replace ‘a meter size larger than three quarter inch (3/4”)’ in paragraph 5 with ‘the meter serving the subject property to be larger than the existing meter serving the subject property. The water that must be dedicated shall be the amount necessary to serve the additional demand resulting from the change in use or alteration. The fee-in-lieu shall be the difference between the fee-in-lieu in the Town’s fee schedule for the existing meter and the new meter.’ Section 16.05.5.3.6(C)(6) Calculation of Water Dedications for Non-Residential and Mixed-Use Site Plans or Building Permits: It is proposed to change the wording from, ‘for the non-residential component of the development’ to now state ‘necessary to serve the development as proposed by the site plan or building permit. Upon receipt of an application for a mixed-use site plan or building permit…’ to clarify that nonresidential and mixed use will pay according to the fee schedule. Additionally, under the preceding section, it is proposed to replace, “the owner shall only be required to dedicate water or pay a fee-in-lieu if the fixtures subject to the building permit application require a meter size larger than three quarter inch (3/4”)” with ‘that requires a change in meter from ¾” to 1”, the water that must be dedicated shall be the amount necessary to serve the additional demand resulting from the change in use or the alteration, and the fee-in-lieu shall be the difference between the fee-in-lieu in the Town’s fee schedule for the existing meter and the new meter. For non-residential or mixed use building permits that involve a change in use or alteration to an existing building that require a meter larger than 1’ the water that must be dedicated shall be the amount necessary to serve the additional demand resulting from the change in use or the alteration, and the fee-in-lieu shall be per-acre-foot of new water demand as set forth in the Town’s fee schedule.’ There was no public comment. LaGreca motioned to recommend approval of the ordinance. Motion was seconded by T. Brown and was unanimously approved. STAFF / COMMISSION INTERACTION 1. It was proposed to move meetings time from 7:00 pm to 6:00 pm → will require changes to website, etc.; suggested to maintain a consistent rotation to align with the end of daylight savings time. This new time will begin in two weeks (11/20/2024). 2. Joel explained to P&Z his current situation; shifting position out of Planning Director and step back into previous role (interviews for Planning Director happening on Nov. 15). 3. Up to two (2) alternate member positions may also be appointed. While alternate members may attend all meetings and participate in the discussion of matters coming before the Commission, alternate members are not entitled to vote unless a regular member is absent or otherwise unable to vote on such matters. Currently there are two (2) alternate member vacancies and one (1) applicant. Given the quasi-judicial nature of the review demands of the Commission, Staff have invited the applicant to present to the Commission. Planning and Zoning Commission Action: Staff request that the Commissioners review the enclosed application, followed by a recommendation for the Board of Trustees to approve the applicant and/or to continue seeking applicants. I was a member and ultimately chair of the Green Mountain Falls, CO Planning commission, member and short term President of Girl Scouts Wagon Wheel Council BOD, and managed the Downtown Colorado Springs Business Improvement District. I learned that understanding code, understanding process, and clear and respectful communication is key to success in any such position. 2. Growth and green land development are major concerns. I believe the town has done a good job of adapting to the challenges presented by growth, but feel we need to be ever vigilant as circumstances develop. The large development projects are a huge part of the equation, but overseeing and (unfortunately enforcing) smaller projects on the individual property owner level is an area where I would be most interested in focusing. As an example, in my neighborhood (Sunset Vista) landscape and land use regulations have evolved over the years, but enforcement of them over taxes Code Enforcement's capacity. Communicating clearly with individual property owners over what is expected could lighten Code's load. 3. If appointed I would like to be instrumental in maintaining a high level of integrity to the code while perpetuating the respectful and clearly communicated relationships within our community that we all enjoy! 4. The Town has a responsibility to respectfully enforce code and be able to adapt code as needed through our growth. The recent change to allow camping for seasonal employees is a prime example. In order to remain economically and environmentally viable we constantly need to see the whole picture. In the day to day workings we need to know the code, communicate the code, and recognize that there are times when we must update the code. STAFF REPORT MAJOR SITE PLAN REVIEW CAMPING IN HIGHWAY COMMERCIAL DATE: November 20, 2024 PROPERTY: Temporary Camping Deerhammer– Site Plan 105 Barnwood Drive APPLICANT: Lenny Eckstein REQUEST: Site Plan Review for Temporary Camping in the Highway Commercial Zone District for the purpose of allowing up to two (2) RVs through the year. TOWN STAFF: Joel Benson, Planning Director ___________________________ SUMMARY OF REQUEST The Deerhammer would like to allow workforce housing on its warehouse and distributing property via the Town’s Temporary Camping Permit process. The applicant, Lenny Eckstein of 105 Barnwood Drive LLC, states a request to approve year-round RV workforce living on the property located at 105 Barnwood Drive. The request would allow for the permitted placement of two (2) RVs for two (2) employees. The process established the Municipal Code follows a Minor Site Plan review with specific referral agency input and a mandated public hearing. The public hearing is atypical for a minor site plan review, although any plan can be called up to the Planning and Zoning Commission and/or Board of Trustees. The Planning and Zoning Commission shall review the proposed site plan, any referral agency comments, and the Municipal Code and make a recommendation for the Town Administrator to Approve, Approve with Amendments, or Deny the camping permit. The Commission may also continue the hearing. ATTACHMENTS TO THE REPORT Attachment A - Vicinity Map Attachment B – Site Plan Attachment C – Management Plan HISTORY AND BACKGROUND The property was annexed into town in 1975 as part of the Mountain View Subdivision. The first zoning map that incorporates this area is from 1982 when this was zone as B-2 (Highway Business District). All subsequent zoning maps maintain this zoning until the adoption of the UDC and the Highway Business (B- 2) zone district was reclassified as Highway Commercial (HC), keeping largely the same intent and intended uses. November 20, 2024 105 Barnwood Temporary Camping Permit Review Lenny Eckstein Page 2 of 10 Regarding development, lot #2 of the Mountain View Subdivision was originally developed in 2005-6 as a retail tire store (Vista Tire and Wheel). In 2011, the property was converted to a warehouse and online operation for Colorado Kayak Supply. In 2019, the property was sold to the Amy Eckstein Living Trust and a change of use allowed for the Deerhammer Distilling Company, LLC to operate as a “storage warehouse for wooden casks filled with spiritous liquor; light manufacturing and bottling spiritous liquor into containers less than 1 gallon.” The land was since sold to 105 Barnwood Drive, LLC, also represented by Amy and Lenny Eckstein. The Distillery has operated continuously since. The area has grown with additional commercial and industrial uses throughout that part of town, as well as with residential growth in the Farm. The lot under question is surrounded by Highway Commercial to the south (BV Police Dept and the Business Center), east (Rocky Mountain Biking), and west (HRRMC) with high-density residential to the north (The Farm subdivision). PROCESS The Town process for a Minor Site Plan review applies to this project, although the review criteria differ. This is a review for the initial 12-month permit. Subsequent reviews shall take place administratively after staff have received a renewal application and after a conference with referral agencies, code enforcement, police, or other agencies. Review: Applicants shall complete an application on a form provided by the Town for the initial permit approval and for subsequent renewal permits. Any application must be signed by both the property owner and the business owner and shall serve as authorization from the property owner for said use of the property. Applications shall be reviewed by the Town Administrator for compliance with the provisions within the Code, below. Review of the proposal has been carried out by Planning staff. Referral agencies, including Chaffee County Building and Safety (for electric), Fire, Sanitation, Public Health and Public Works have had the opportunity to review and provide comments on the proposed management plan. No comments to adjust the plan have been received. After a review of the following report, staff request that the Planning and Zoning Commission move to recommend approval, approval with conditions or denial (or continuation) of the Temporary Camping Permit for 105 Barnwood Drive. • The application is complete and complies with Section 16.03.3.2.4(C) of the Buena Vista Unified Development Code (UDC), ratified via Ordinance 14 Series 2024. • The Property is zoned Highway Commercial (HC) and the request is consistent with the intent of the District. • No public improvements are required for this temporary use. The proposed camping is located at 105 Barnwood Drive. Presently, the Deerhammer Distillery operates a bottling, warehousing and distribution operation for its liquors and spirits. An RV had been used on site for several months. The request would formally allow the use of the property for camping in much the same November 20, 2024 105 Barnwood Temporary Camping Permit Review Lenny Eckstein Page 3 of 10 way that had been carried out. The code now supports such activity in the Highway Commercial Zone District. The Site Plan includes • Locations of the RV sites • Location of designated parking spot (1 each) for the RVs • Location of the nearest fire hydrant, which is within 600’ of the camping, as the hose is laid out • Ingress and egress route including width • Location of proposed screening (which would need a separate fence permit) • Location and amperage of electric hook ups • Location of trash and recycling • Distance to property lines • Location of the wooden snow fence containment area’ to store personal equipment The Management Plan includes • Rules for which the campers must abide • Contact information • A description of the power supply, trash disposal, toilet access, water access and commentary on the backflow preventer, a plan for showers, and considerations for winter use including the type of RV so that winter specs can be verified. Evaluation and Applicability of Code In a duly noticed Public Hearing, the Planning and Zoning Commission shall review the initial application and proposal against the criteria and provide a recommendation to the Town Administrator based on compliance with the criteria, as authorized by Section 16.03.3.2.4(C) of the UDC. Review Criteria (Staff review in Bold): a. Screening sufficient to block the camping area from view of neighboring properties and public property at street level. Screening shall meet the standards for storage in Section 16.03.3.3.4(D)(2) of this Code. Screening described in the Site Plan would comply with this criterion. A separate fence permit would be required to ensure that the code requirements are followed. b. Screened, Town-approved toilet facilities sufficient to serve the number of employees camping on the property that has unrestricted, 24-hour access. 24-hour access to toilet facilities is indicated. One neighbor raised a concern that the campers would urinate outside of the campers instead of going inside. There may be in- unit facilities. The applicant is prepared to discuss any questions. c. Waste facilities sufficient to manage all garbage, including food waste, for the employees camping on the property. Waste and Recycling bins are indicated on the site plan. The Commission may recommend November 20, 2024 105 Barnwood Temporary Camping Permit Review Lenny Eckstein Page 4 of 10 that the bins are enclosed, as per municipal code. d. Potable water from the Town water distribution system sufficient to provide for the needs of all employees camping on the property. e. The Management Plan indicates a hose hookup with a backflow preventer already installed. f. All electrical hookups must be inspected and approved by the Chaffee County Building and Safety Department. This would need to happen, as per code. This would be up to the applicant supply proper notification of approval to the Town. g. Camping may only occur on the same parcel or adjoining parcel upon which the primary business activity is located. The property upon which the camping occurs must be owned or leased by the same business for which the employees work. This is consistent. h. Site plan. A site plan showing the camping area, allocated camping spots, all facilities, distance to fire hydrant, distance to fencing, and emergency services ingress and egress, signed by the business and property owner. The initial approval constitutes a Minor Site Plan that must be referred to the Planning and Zoning Commission and requires review and approval from the Fire Department, Sanitation District, Public Health, and Public Works. This is consistent. Designated parking spaces have been included as well. i. Management/Operations Plan. A written management plan explaining how the camping area will be managed along with all rules for employees utilizing the camping area. The management plan shall include name, phone, direct messaging and email information for a local point of contact that will be available 24 hours per day 7 days per week. The management plan shall include the applicant’s rules for its camping area applicable to its employees and shall demonstrate how impacts to the neighboring businesses and surrounding area will be minimized. The management plan shall include, without limitation, information on quiet hours, pets, and how the business will enforce any violations of its policies and violations of the Municipal Code. This is consistent, although the enforcement of any violations merely sates, “If any of these rules are broken, your permission to dwell on this property may be revoked.” The applicant is prepared to discuss any questions j. Camping shall not occur within 250’ of Highway 24, as measured from the centerline of the highway. Camping shall only be permitted on parcels with an existing primary structure on the property being used for camping. No camping may occur within 15’ of an adjoining property. The number of campers permitted on a parcel shall be limited to a number that can reside on the parcel without unreasonably interfering with the character of the area after November 20, 2024 105 Barnwood Temporary Camping Permit Review Lenny Eckstein Page 5 of 10 consideration of factors such as the size and configuration of the parcel, distance to neighboring structures and residential areas, access, parking, and similar factors. ZONING AND LAND USE The property that is included in the Site Plan is zoned HC. The use as proposed is a permitted temporary use in the HC Zone District (UDC §3.1-Table 3.1). The Site Plan complies with the purpose of the HC Zoning District (UDC §2.4.3.A): The HC district is intended to: Strengthen the Town’s economic base, and provide employment opportunities close to home for residents of the Town and surrounding communities; Minimize the impact of commercial development on residential uses; and Provide for retail sales and services that require good automobile access, and for other uses not requiring a centralized location but that do require highway frontage, comparatively large lot areas, and open sales yards or unenclosed storage areas. Comments have either been addressed through the staff review process or are listed as conditions for approval in the following review. Referral Agencies: Buena Vista Public Works Department Chaffee County Fire Department Buena Vista Sanitation District Chaffee County Health Department CONCLUSIONS AND RECOMMENDATION Based upon the information and materials provided by the applicant and included in the staff report, staff support the requested Temporary Camping Permit to allow temporary camping in the Highway Commercial Zoning District at 105 Barnwood Drive. Therefore, staff recommend that the Planning and Zoning Commission finds that: 1. The applicant has requested approval of a Temporary Camping Permit Site Plan including the site improvements identified in the Site Plan. The site plan meets the HC zone district design standards. 2. The applicant has submitted a complete Site Plan and Management Plan; and 3. The application is consistent with the applicable standards set forth in the UDC for a Temporary Camping Permit Site Plan; and, THEREFORE If the Planning and Zoning Commission accepts the conclusions and recommendation as presented in this staff report, the Commission should recommend APPROVAL of the Temporary Camping Permit for 105 Barnwood Drive with the following conditions: 1. The applicant shall address all comments supplied to the Planning Department to the Town’s satisfaction prior to final approval of the Temporary Camping Permit. 2. The applicant shall address all comments supplied by all referral agencies to the Town’s satisfaction prior to final sign off on the Temporary Camping Permit, including comments that have yet to be submitted by referral agencies. 3. Any fence may be built only after the approval of a Fence Permit and must comply with the Town’s Unified Development Code. 4. No camping is permitted until all improvements depicted in the Site Plan are complete to the satisfaction of the Town. Requested Use: We are asking for the permitted placement of 2 RV’s for 2 employees on our property for an anticipated immediate need. As future workforce housing needs might arise. Management Plan: Since the property at 105 Barnwood Drive is used as a consistent of ce and ongoing site of Deerhammer's production processes, oversight by owners/management would be ongoing and consistent. Furthermore, any employees of Deerhammer always have an open line of communication to the owners for any and all matters that might arise. The following ‘rules & requirements’ will be provided to Deerhammer employees residing on the property and will be signed by employees: Deerhammer Workforce RV Campground Rules & Requirements Contact: Lenny Eckstein / 720.480.8786 / lenny@deerhammer.com Deerhammer campground rules: • Area surrounding the RV must remain clear of clutter and trash. • Ensure that your RV is maintained and kept in a sightly manner. • Any personal items (ex: bike, kayak, skis) must be stored within wooden snow fence containment area implemented by Deerhammer, either in front of or behind your RV. • Please take any and all precautions to ‘tread lightly’ on this property and never be a nuisance to the surrounding businesses and residents. This living situation is granted to you as a privilege - not a right. • Any trash/recycling must be disposed of within provided receptacles. Do not utilize dumpsters on neighboring properties. • 1 vehicle may be parked in an approved parking spot on the property as designated on site plan. • Restrooms are available 24/7 for employee use within the building. • Noise should never exceed reasonable levels during any hour, and extra attention to maintaining a noise-free living area should be exercised between the hours of 7pm-7am. Furthermore, there should never be any noise emitted that would fall out of compliance with Buena Vista’s municipal code. Please do not exceed 50 decibels at any time. • Any pets must receive owner/manager approval before being brought on the property. • No extension cords may be utilized for your RV beyond a “temporary use” per re code. • No external lighting may be implemented beyond that which is oem equipped on your RV. This lighting should not exceed 3 foot-candles. • If any of these rules are broken, your permission to dwell on this property may be revoked. RV Location and Screening: RV locations are notated on the site plan as well as requisite screening. Power Supply: There is a 20amp power outlet on the exterior south side of our building which will be within 10’ of the RV and used to maintain a fully charged battery on the RV. Additionally, there is another 50amp external outlet on the West side of our building that could be used for another RV if placement of a 2nd RV is required. fi fi  Trash Disposal: Trash and recycling toter will be on site at the property. Sewer: Deerhammer employees will have a key to unlock the exterior man door and access interior restrooms located inside the warehouse. Access would be 24/7. Fire Hydrant: Nearest re hydrant (#258) appears to be approximately 200’ away (as measured with gps) from the proposed location of any RVs on the property. Water: water can be supplied via RV commercially available heated RV hoses from two external faucets (one located on the west side, and one on the south). Back ow preventer is already present in the property at 105 Barnwood Drive and is inspected annually. Shower: Current plan for anticipated limited employee use would be to secure membership to Peak Fitness located 1 block away for 24hr use of tness facilities and shower. Additional considerations for winter use: Any RV’s that would be occupied year-round would be suitably insulated for such use. The current unit that is owned by Deerhammer (Dutchmen Adirondack 26rk Travel Trailer) and in place awaiting use is built with suf cient insulation on all sides and does not require skirted insulation. If an additional RV was to be implemented for year-round habitation, it would be of similar build quality or out tted with insulate skirting. Commercially available heated RV water hoses would be implemented as needed — these hoses are used to ensure that water-building will not freeze. fi fl fi fi fi
