City of Bulverde, Texas City Council Meeting Tuesday, January 10, 2023 Meeting Duration: to CALL THE MEETING TO ORDER Members of City Council Present: Council Member Yvonne Chapman, Place 2 Council Member Charles Hughes, Place 3 Mayor Pro Tem Clint Hays Place 4 Council Member David Bullock, Place 5 Council Member Mechelle Salmon, Place 6 Members of City Council Absent: Mayor Bill Krawietz Council Member Mark Morkovsky, Place 1 City Staff Present: City Manager Charles West, City Attorney Jason M. Rammel, City Secretary Maria Franco, Chief of Police Gary Haecker, Planning Director Susana Huerta, City Engineer Adrian Garcia, Finance Director Carol Goering, Mayor Pro Tem Clint Hays called the meeting to order at 6:30 PM. REPORTS AND PRESENTATIONS 2.I. Police Department: Monthly Report Chief Haecker presented the monthly Police Report 2.II. Finance Department: Monthly Report Finance Director Carol Goering presented the Fiancial Report 2.III. Public Works Update City Engineer Adrain Garcia presented the monthly Public Works Report 2.IV. Planning And Zoning Commission Update Planning Director Susana Huerta presented an update on current Planning and Zoning activities. 2.V. Parks & Recreation Update Planning Director Susana Huerta presented an update on Parks and Recreation. There was discussion about adding a handicap swing to the park and the Kiwanas would like to work on soliciting funds to make a donation for the purchase and installation of the swing. The Park Board will gather information and make a recommendation to the City Council. 2.VI. Economic Development Foundation EDF Board member Tom Hackleman updated the Council that there is not currently a director for EDF and that the board is seeking a replacement for Scott Wayman. REGULAR AGENDA ITEMS 3.I. Hold A Public Hearing And Consider A Request By Haywood Custom Builders For The Approval Of A Special Use Permit To Allow A Guest House As An Accessory Use On Lot 34, Block 10 Phase VI Belle Oaks Subdivision, Located At 771 Green Gate View. Motion: Council member Bullock made a motion seconded by council member Salmon to approve the Special Use Permit. Motion carried unanimously five (5) ayes to zero (0) nays. 3.II. Consider A Request By Phil Zaccaria,. For A Variance To Chapter 10, Subdivision Ordinance, Section 2.03(E)(V)4(B) Related To Parkland Dedication Requirements, Of The City Of Bulverde Code Of Ordinances, On An Approximately 193-Acre Tract Of Land, Generally Located Near The Intersection Of Highway 46 And Mitchell Drive. Motion: Council member Salmon made a motion seconded by council member Chapman to approve the request. Motion carried unanimously five (5) ayes to zero (0) nays. 3.III. Consider A Request By Phil Zaccaria,. For A Variance To Chapter 10, Subdivision Ordinance, Section 4.07 {4.08} Related To Riparian Buffer Requirements, Of The City Of Bulverde Code Of Ordinances, On An Approximately 193-Acre Tract Of Land, Generally Located Near The Intersection Of Highway 46 And Mitchell Drive. Motion: Council member Bullock made a motion seconded by Mayor Pro Tem Hays to approve the request. Motion carried unanimously five (5) ayes to zero (0) nays. 3.IV. Discuss And Consider Approving The City Council Meeting Minutes For December 13, 2022. Motion: Council member Salmon made a motion seconded by Mayor ProTem Hays to approve the minutes. Motion carried unanimously five (5) ayes to zero (0) nays. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST EXECUTIVE SESSION 6.I. Nanda Amendment LCR Pursuant To Texas Government Code § 551.071(2), The City Council Shall Convene In A Closed Session To Conduct A Private Consultation With The City’S Attorney On A Matter In Which The Attorney Has A Duty Of Confidentiality, Namely, Consideration Of A Development Agreement Pertaining To 28.549 Acres Generally Described As A- 88 Sur-764 G Bauer, Acres 20.0 And A- 88 Sur-764 G Bauer, Acres 8.549, Owned By Even Bossier LLC, Being Located Generally Southwest Of The Intersection Of State Highway 46 W And Old Boerne Road. At 7:31 P.M. the City Council convened into Executive Session to discuss the following: NANDA Amendment for the Lewis Creek Ranch project. At 7:55 P.M. the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. ADDITIONAL ITEM 7.I. Consider And Take Possible Action On Development Agreement Pertaining To 28.549 Acres Generally Described As A- 88 SUR-764 G BAUER, ACRES 20.0 And A- 88 SUR-764 G BAUER, ACRES 8.549, Owned By Even Bossier LLC, Being Located Generally Southwest Of The Intersection Of State Highway 46 W And Old Boerne Road. Motion: Council member Salmon made a motion seconded by council member Chapman to approve the proposed agreement. Motion carried unanimously five (5) ayes to zero (0) nays.
