City of Bulverde, Texas City Council Meeting Tuesday, September 12, 2023 Meeting Duration: 06:30 PM to 08:51 PM CALL THE MEETING TO ORDER Mayor Bill Krawietz called the meeting to order at 6:30 PM. Members of City Council Present: Mayor Bill Krawietz Council Member Yvonne Chapman, Place 2 Mayor Pro Tem Charles Hughes, Place 3 Council Member Clint Hays Place 4 Council Member David Bullock, Place 5 Council Member Mechelle Salmon, Place 6 Members of City Council Absent: Council Member Mark Morkovsky, Place 1 City Staff Present: City Manager Charles West, City Attorney Jason M. Rammel, City Secretary Sandra V. Ham, Chief of Police Gary Haecker, Planning Director Suzzane Williams, Public Works Director Tim Parker, and Executive Assistant Ashley Gohlke REPORTS AND PRESENTATIONS 2.A. Proclamation for World Teachers' Day Mayor Bill Krawietz presented the Proclamation on behalf of World Teachers' Day. 2.B. Proclamation for National Night Out Mayor Bill Krawietz presented the Proclamation to City of Bulverde Police Chief Gary Haecker. 2.C. Police Department: Monthly Report Report given by Police Chief Gary Haecker. 2.D. Finance Department: Monthly Report Report given by City Manager Charles West. 2.E. Public Works Update Report given by Public Works Director Tim Parker. 2.F. Planning Department Update Report given by Planning Director Suzanne Williams. 2.G. Parks & Recreation Update Report given by Board Member Daniel Schrubb. 2.H. Economic Development Foundation Report given by Executive Committee Member Paula Stakes. CONSENT AGENDA ITEMS 3.A. Consider approval of the City Council Meeting Minutes from August 8, 2023. Motion: Council Member, Place 5 Bullock made a motion seconded by Council Member, Place 6 Salmon, to approve the City Council Meeting Minutes from August 8, 2023, as amended to include the additional language of "Musik in the Park" to item 4.D. Vote: Motion carried unanimously (6) ayes to zero (0) nays. REGULAR AGENDA ITEMS 4.A. Discussion and possible approval of an Ordinance granting a Special Event Permit to Provisions Food Pantry to hold its Holiday Hunger 5K Run / Walk at the City of Bulverde Community Park on December 2, 2023. Motion: Mayor Krawietz made a motion seconded by Mayor Pro Tem, Place 4 Hughes to approve an Ordinance granting a Special Event Permit to Provisions Food Pantry to hold its Holiday Hunger 5K Run / Walk at the City of Bulverde Community Park on December 2, 2023. Vote: Motion carried unanimously (6) ayes to zero (0) nays. Ord #741 4.B. Consider recommending for approval a task order for Freese & Nichols to review and update the City of Bulverde Sunrise 2025 Comprehensive Plan. Motion: Council Member, Place 6 Salmon made a motion seconded by Council Member, Place 4 Hays to approve a task order for Freese & Nichols to review and update the City of Bulverde Sunrise 2025 Comprehensive Plan, to include the preparation of new impact fees or impact fee updates for water, wastewater, roadway or drainage under Chapter 395, with both projects to run concurrently. Vote: Motion carried unanimously (6) ayes to zero (0) nays. 4.C. Discuss and consider an Ordinance amending Articles 3.05 and 3.06 Code of Ordinances of the City of Bulverde, Texas to remove fences as an exemption from building permits. No action taken. 4.D. Public hearing on the proposed 2023 tax rate. Mayor Bill Krawietz opened the public hearing at 7:24 PM. There being no one wishing to speak, the public hearing was immediately closed. 4.E. Public hearing on the proposed 2023-2024 budget. Mayor Bill Krawietz opened the public hearing at 7:26 PM. There being no one wishing to speak, the public hearing was immediately closed. 4.F. Discuss and consider an Ordinance approving and adopting a budget for operating the municipal government of the City of Bulverde for the Fiscal Year beginning October 1, 2023 and ending on September 30, 2024. Motion: Council Member, Place 5 Bullock made a motion seconded by Mayor Pro Tem, Place 3 Hughes to approve an Ordinance approving and adopting a budget for operating the municipal government of the City of Bulverde for the Fiscal Year beginning October 1, 2023 and ending on September 30, 2024. Vote: Mayor Krawietz took a roll call vote: Council Member, Place 1 Morkovsky – ABSENT Council Member, Place 2 Chapman – AYE Mayor Pro Tem, Place 3 Hughes – AYE Council Member, Place 4 Hays – AYE Council Member, Place 5 Bullock – AYE Council Member, Place 6 Salmon – AYE Mayor Krawietz – AYE Motion carried unanimously (6) ayes to zero (0) nays. Ord #742 4.G. Discuss and consider a Resolution ratifying the recently adopted budget that contains a property tax rate that raises more total property taxes than last year. Motion: Council Member, Place 5 Bullock made a motion seconded by Council Member, Place 4 Hays to approve a Resolution ratifying the recently adopted budget that contains a property tax rate that raises more total property taxes than last year. Vote: Motion carried unanimously (6) ayes to zero (0) nays. 4.H. Discuss and consider an Ordinance adopting the tax rate and levying a tax upon all property subject to taxation within the City of Bulverde, Texas, for the 2023 Tax Year for the use and support of the municipal government of the City of Bulverde. Motion: Council Member, Place 5 Bullock made a motion seconded by Council Member, Place 4 Hays to approve an Ordinance adopting the tax rate and levying a tax upon all property subject to taxation within the City of Bulverde, Texas, for the 2023 Tax Year for the use and support of the municipal government of the City of Bulverde. Vote: Motion carried unanimously (6) ayes to zero (0) nays. Ord #743 PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Bill Krawietz opened the meeting for public comments not related to posted agenda items at 7:30 PM. REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST EXECUTIVE SESSION At 7:40 PM the City Council convened into Executive Session to discuss the following: 7.A. Pursuant To Texas Government Code § 551.071(1), The City Council Shall Convene In A Closed Session To Seek Advice From The City’s Attorney Regarding Pending Litigation Styled City Of Bulverde, Texas V. Pesado Construction Company And Pape-Dawson Consulting Engineers, LLC, Cause No. C2023-1008E, 466th District Court, Comal County, Texas. 7.B. Pursuant to Texas Government Code § 551.071(2), the City Council shall convene in a closed session to conduct a private consultation with the City’s attorney on a matter in which the attorney has a duty of confidentiality, namely: i. Wastewater treatment plant planned for Diamante Ranch. ii. Johnson Ranch MUD and proposed development within Johnson Ranch. iii. Subdivision of property abutting Stahl Lane by Lennar Custom Homes and Catenary VIS LLC. iv. For removal from the City’s extraterritorial jurisdiction regarding the following properties: 1275 Stoney Ridge Road; 490 E. Ammann Road; 1010 Rainbow Drive; 1450 Bulverde Road; 5727 FM 1863; 204 Rodeo Drive. v. An encroachment on public right of way on Bulverde Road by Gloria Deo Academy, 1110 Bulverde Road. 7.C. Pursuant To Government Code 551.074, The City Council Will Deliberate In Executive Session Regarding Personnel Matters Pertaining To Performance and Review of the City Manager. At 8:51 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. No Action Taken.
