City of Bulverde, Texas City Council Meeting Thursday, March 21, 2024 Meeting Duration: 08:19 PM to 10:51 PM CALL THE MEETING TO ORDER Mayor Bill Krawietz called the meeting to order at 8:19 PM. Consider approval of the City Council Meeting Minutes from February 13, 2024. 2.B. Consider approval of the Joint City Council and Planning & Zoning Commission Workshop Minutes from February 29, 2024. 2.C. Consider approval of a resolution authorizing submission of a grant application to the Office of the Governor for Patrol Vehicle Upgrade Grant #49832-01. 2.D. Acknowledge and receive the City of Bulverde Police Department 2023 Racial Profile Report. 2.E. Acknowledge and receive the City of Bulverde Monthly Departments Reports: February 2024 Bulverde Police Department Monthly Report and February 2024 Public Works Monthly Report.  Motion: Mayor Krawietz made a motion seconded by Council Member, Place 4 Hays to approve the Consent Agenda, with a correction to the February 13, 2024 City Council meeting minutes amending the Roll Call to reflect the attendance of Council Member, Place 5 Alexandre. Vote: Motion carried (6) ayes to (0) nays. REGULAR AGENDA ITEMS 3.A. Consider an ordinance granting a variance to Section 17.04, Code of Ordinances of the City of Bulverde, Texas, pertaining to cut and fill requirements on an approximately 2.22-acre tract of land, located at 18738 Forty Six Parkway, Bulverde, Texas. Motion: Council Member, Place 1 Morkovsky made a motion seconded by Mayor Pro Tem, Place 3 Hughes to approve an ordinance granting a variance to Section 17.04, Code of Ordinances of the City of Bulverde, Texas, pertaining to cut and fill requirements on an approximately 2.22-acre tract of land, located at 18738 Forty Six Parkway, Bulverde, Texas. Vote: Motion carried (6) ayes to (0) nays. Ordinance# 752 3.B. Consider an ordinance granting a variance to Section 17.03.005 & 17.03.006, Code of Ordinances of the City of Bulverde, Texas, pertaining to Disturbance of Slope Areas and Tree Preservation within Steep Slope Areas for approximately 2.22-acre tract of land, located at 18738 Forty Six Parkway, Bulverde, Texas. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 1 Morkovsky to approve an ordinance granting a variance to Section 17.03.005 & 17.03.006, Code of Ordinances of the City of Bulverde, Texas, pertaining to Disturbance of Slope Areas and Tree Preservation within Steep Slope Areas for approximately 2.22-acre tract of land, located at 18738 Forty Six Parkway, Bulverde, Texas. Consider approval of an ordinance granting a variance to Chapter 10, Exhibit A, Section 17.03.005 of the Code of Ordinances of the City of Bulverde Texas to allow construction within steep slopes exceeding 25% on the property generally located at 131 Bulverde Crossing, Bulverde, Texas 78163. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 4 Hays to approve an ordinance granting a variance to Chapter 10, Exhibit  A, Section 17.03.005 of the Code of Ordinances of the City of Bulverde Texas to allow construction within steep slopes exceeding 25% on the property generally located at 131 Bulverde Crossing, Bulverde, Texas 78163. Vote: Motion carried (6) ayes to (0) nays. Ordinance# 754 3.D. Hold a Public Hearing and consider an ordinance amending the zoning for approximately 52.5+/-acre tract of land to authorize a golf course with mixed restaurant and sports activity uses at 2780 Bulverde Road, Bulverde, TX 78163, to Planned Development District. Mayor Krawietz announced Council would hold the Public Hearing and consider the agenda item after the Executive (Closed) Session. 3.E. Discussion and consideration of bid award for Project No. 2024-1 City Hall Bridge to Police Headquarters to establish vehicular and pedestrian accessibility across a drainage channel that runs between the City’s Police Headquarters and the existing City Hall. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 1 Morkovsky to award bid for Project No. 2024-1 City Hall Bridge to Police Headquarters to E-Z Bel Construction, LLC with a base bid of $322,138. Vote: Motion carried (6) ayes to (0) nays. 3.F. Consider approval of a proposal by Levy Company for the City Park Lighting Project at 29815 Bulverde Lane in the amount of $256,705. Motion: Council Member, Place 4 Hays made a motion seconded by Mayor Pro Tem, Place 3 Hughes to approve a proposal by Levy Company for the City Park Lighting Project at 29815 Bulverde Lane in the amount of $256,705. Vote: Motion carried (6) ayes to (0) nays. 3.G. Consider approval of an Interlocal Cooperation Agreement between Comal County and the City of Bulverde for Animal Control Services. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 1 Morkovsky to approve an Interlocal Cooperation Agreement between Comal County and the City of Bulverde for Animal Control Services. Vote: Motion carried (6) ayes to (0) nays. EXECUTIVE (CLOSED) SESSION At 8:47 PM the City Council convened into Executive (Closed) Session to discuss the following: 5.A. The City Council will meet in closed session to seek the advice of legal counsel about pending or contemplated litigation, to discuss a settlement offer, or on matters in which the duty of the attorney to the City Council under the Texas Rules of Professional Conduct conflict with the Texas Open Meetings Act; to wit: i. Diamante Ranch TCEQ Matter, TCEQ Docket No. 2023-0955-MWD. ii. Catenary Vis, LLC Replatting, Corrective and Settlement Agreement iii. Johnson Ranch Subdivision Agreement ACTION ITEMS FROM EXECUTIVE (CLOSED) SESSION At 9:30 PM the City Council reconvened from Executive (Closed) Session and took the following action on items discussed in Executive (Closed) Session. 5.A. The City Council will meet in closed session to seek the advice of legal counsel about pending or contemplated litigation, to discuss a settlement offer, or on matters in which the duty of the attorney to the City Council under the Texas Rules of Professional Conduct conflict with the Texas Open Meetings Act; to wit: i. Diamante Ranch TCEQ Matter, TCEQ Docket No. 2023-0955-MWD. ii. Catenary Vis, LLC Replatting, Corrective and Settlement Agreement iii. Johnson Ranch Subdivision Agreement No Action Taken. Mayor Bill Krawietz opened the Public Hearing at 9:52 PM. Eight comments were received by Council. Mayor Bill Krawietz closed the Public Hearing at 10:30 PM. At 10:31 PM the City Council convened into Executive (Closed) Session to discuss the following: 551.071–Consultation with Attorney–Consider an ordinance amending the zoning for approximately 52.5+/-acre tract of land to authorize a golf course with mixed restaurant and sports activity uses at 2780 Bulverde Road, Bulverde, TX 78163, to Planned Development District. At 10:46 PM the City Council reconvened from Executive (Closed) Session and took the following action on items discussed in Executive (Closed) Session.  Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 5 Alexandre to table an ordinance amending the zoning for approximately 52.5+/-acre tract of land to authorize a golf course with mixed restaurant and sports activity uses at 2780 Bulverde Road, Bulverde, TX 78163, to Planned Development District, until a Special Meeting to be held on March 26, 2024, and subsequent Special Meeting to be held on March 28, 2024 if needed. Vote: Motion carried (6) ayes to (0) nays. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Bill Krawietz opened the meeting for public comments not related to posted agenda items at 10:49 PM. One comment was received by Council. Mayor Bill Krawietz closed the public comments at 10:51 PM.
