Rammel Regular Agenda Items 2.A. Approval of the May 11, 2023 Planning & Zoning Commission meeting minutes Motion: Chair Alexandre made a motion seconded by Commissioner Molina to Approve. Motion carried (6) ayes to (0) nays. 2.B. Consider a request from Brazos De Santos Partners, LTD. for a variance to 17.04 Cut & Fill Requirements of the City of Bulverde Code of Ordinances, which requires a limit to the amount of cut and fill within slope areas: four (4) feet in depth for "cut" and four (4) feet in depth for "fill". Motion: Commissioner Burrier made a motion seconded by Commissioner Cartier to Table. Motion carried (5) ayes to (1) nays. 2.C. a) Consider a request from Brazos De Santos Partners, LTD. for a variance to 17.06.009 (C) of the City of Bulverde Code of Ordinances, which requires: tree removal cannot exceed 60%. b) Consider a request from Brazos De Santos Partners, LTD. for a variance  to 17.06.009 (d)(3) of the City of Bulverde Code of Ordinances, which requires: at least 50% of the replacement trees. c) Consider a request from Brazos De Santos Partners, LTD. for a variance to 17.06.009 (d)(3) of the City of Bulverde Code of Ordinances, which requires: "cash in lieu" of replacement trees. Consider a request from Brazos De Santos Partners, LTD. for a variance to 17.03 Disturbaance Within Steep Slope Areas of the City of Bulverde Code of Ordinances, which requires: improvemnts shall not disturb more than: 1. 15% to 20%: 30% of the surface area 2. 20% to 25%: 15% of the surface area 3. Greater than 25% No disturbance permitted Motion: Commissioner Burrier made a motion seconded by Chair Alexandre to Table. Motion carried (5) ayes to (1) nays. 2.E. Hold a Public Hearing and Consider a request from 5675 HWY Development, LLC for a Special Use Permit for the property located at 5675 US Highway 281 Spring Branch, Texas, Legal Description - A-153 SUR 75 S FREECHILD, 66.466 acres. The SUP would allow the operation of a Brewery. The property is currently zoned C-2 Commercial. The public hearing closed at 6:25 PM. Motion: Chair Alexandre made a motion seconded by Commissioner Prescott to Approve. Motion carried (6) ayes to (0) nays. 2.F. Consider a Final Plat for PARRISH HWY 46 located on Hwy 46 across (South) of Bentwood Drive. Motion: Commissioner Molina made a motion seconded by Commissioner Prescott to Approve. Motion carried (6) ayes to (0) nays. 2.G. Hold a Public Hearing and Consider a Zone Change Request from C-2 to a PDD, Retail Center with outdoor storage for 4510 US Hwy 281 Bulverde, TX 7863; Legal Description - Ten Thousand Pots, Lot 1 Motion: Commissioner Prescott made a motion seconded by Commissioner Molina to Approve. Motion carried (6) ayes to (0) nays. 2.H. a. Consider a request from J. Thompson Professional Consulting, for a  sign variance to 3.08.102(b) 2(B) Roads with a speed limit greater than or equal to fifty (50) mph. Fourteen (14) feet, excluding the monument base. The monument base may be an additional two (2) feet in height measured from ground level at the center of the base to the top of the base. The sign structure (including base) shall not exceed sixteen (16) feet. b. Consider a request from J. Thompson Professional Consulting, for a sign variance to 3.08.102(b) 3(B) Roads with a speed limit greater than or equal to 50mph. One hundred forty (140) square feet per sign, with a maximum area per sign face of seventy (70) square feet. The maximum area for the sign structure shall not exceed ninety (90) square feet. Motion: Commissioner Cartier made a motion seconded by Commissioner Burrier to Approve. Motion carried (6) ayes to (0) nays. 2.I. Consider a request from Aetna Sign Group for a variance to 3.08.102 (a)(2) City of Bulverde Code of Ordinances which requires: Maximum area.0.75 square feet for every one foot of width of building, not to exceed 100 square feet for roads with a speed limit less than fifty (50) mph and 150 square feet for roads with a speed limit greater than or equal to fifty (50) mph. For the lease spaces in a strip mall, 25% of the facade area between the uppermost window or awning to the roof or top of the parapet shall be the maximum sign [size] of the sign or 32 square feet, whichever is lesser. (A) Exception.For lease spaces in strip centers with existing legal, nonconforming signs, the maximum area allowed may be increased to the size of the immediately adjacent signs, or 40 square feet, whichever is lesser. Consider a request from Aetna Sign Group for a variance to 3.08.132 (8)(B) City of Bulverde Code of Ordinances which requires: Directional Sign. Modifications to general regulations: (i) Monument: a. Maximum height: Three (3) feet. b. Maximum area: Eight (8) square feet with a maximum of four (4) square feet per sign face. c. Number of signs: Maximum of two (2) signs per site. (ii) Attached: a. Minimum letter height: Three (3) inches. b. Maximum letter height: One (1) foot. c. Number of signs: Maximum of one (1) sign per facade, not to exceed five signs. Consider a request from Aetna Sign Group for a variance to 3.08.132 (8)(B) (i) City of Bulverde Code of Ordinances which requires: Directional Sign.  Modifications to general regulations: (i) Monument: a. Motion: Commissioner Prescott made a motion seconded by Chair Alexandre to Approve - Sign C, with the recommendation to design the sign width to stay between the existing windows. Motion carried (6) ayes to (0) nays. Motion: Commissioner Cartier made a motion seconded by Commissioner Prescott to Approve - Sign E, with the recommendation to design the sign at 4.5 feet tall by 2 feet wide.
