Police & Fire Community Input General Community Input Adjournment This Page left Blank Public Works This Page left Blank  ORDINANCE NO. __ OF 2018 AN ORDINANCE TO AMEND ARTICLE IV.: DOGS AND CATS § 4 -114 PITT BULLS OF THE CABOT CODE OF ORDINANCES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, it is the desire of the Cabot Animal Services to amend Article IV: Dogs and Cats § 4-114 Pitt Bulls of the Cabot Code of Ordinances as delineated in Exhibit “A” attached hereto and incorporated herein by this reference, subject to the approval of this governing body. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT: SECTION 1: ADOPTION. Article IV.: Dogs and Cats § 4-114 Pitt Bull Dogs of the Cabot Code, as delineated in Exhibit “A” attached hereto and incorporated herein by this reference, is hereby amended and restated by the City of Cabot and the same provisions thereof shall be controlling from the date on which this ordinance shall take effect. SECTION 2: SEVERABILITY. If, for any reason, any portion or portions of this ordinance shall be held invalid, such invalidity shall in no way affect the remaining portions thereof which are valid, and that such valid portions shall be and remain in full force and effect. SECTION 3: REPEAL. Any portion or portions of the amendment to this Code adopted herein which are contrary to existing Ordinances of the City of Cabot, Arkansas shall prevail, and all Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of the conflict. SECTION 5: EMERGENCY. It is the utmost urgency that the City of Cabot, Arkansas, to be in full compliance with the United States Constitution to protect the rights of the citizens of our city, therefore an emergency is hereby declared to exist and this ordinance being necessary for the immediate protection of the public peace, health and safety shall take effect immediately upon its passage and approval. (a) General. It shall be unlawful to keep, harbor, own, allow to run at large, or in any way possess a Pit Bull dog within the corporate city limits, with the following exceptions: (1) Any dog used for law enforcement or governmental operation, (2) Any dog while transporting to a veterinarian office (restrained and muzzled) within the corporate city limits, unless the Pit Bull dog was properly registered with the city prior to August 20, 2007. Arkansas Code Annotated > Title 3 Alcoholic Beverages > Chapter 9 On-premises Consumption > Subchapter 2-- Alcoholic Beverages Generally 3-9-222. Private clubs -- Procedure for obtaining permit. (a) (1) Application for a permit to operate as a private club may be made to the governing body of the county or municipality in which the private club seeks to be located. (2) If the governing body of the county or municipality approves by ordinance an application for a permit to operate as a private club under subdivision (a)(1) of this section, the Alcoholic Beverage Control Division may issue a permit to operate as a private club to the applicant for the proposed location. (b) (1) The application for a private club shall be submitted to the division and accompanied by an annual permit fee of one thousand five hundred dollars ($1,500). (2) The application for a bed and breakfast private club shall be submitted to the division and accompanied by an annual permit fee of seventy-five dollars ($75.00). (3) In an area in which the sale of intoxicating liquor has not been authorized by local option as provided under § 3-8-201 et seq., the application for a private club permit shall be submitted to the division and accompanied by an additional application fee of one thousand five hundred dollars ($1,500). (c) (1) After filing an acceptable application with the Director of the Alcoholic Beverage Control Division, the applicant shall cause to be published at least one (1) time each week for four (4) consecutive weeks in a legal newspaper of general circulation in the city in which the premises are situated or, if the premises are not in a city, in a newspaper of general circulation for the locality where the business is to be conducted, a notice that the applicant has applied for a permit to dispense alcoholic beverages on the premises. (2) The notice shall be in such form as the director shall prescribe by rule or order and shall be verified. (3) The notice shall give the names of the managing agent and the nonprofit corporation or, in the case of a bed and breakfast private club, the name of the business owner, and shall state: (A) That the manager, or in the case of a bed and breakfast private club, the owner, at least one (1) partner, or the majority stockholder is a citizen of Arkansas; (B) That he or she is of good moral character; (C) That he or she has never been convicted of a felony or had a license to sell or dispense alcoholic beverages revoked within the five (5) years preceding the date of the notice; and (D) That he or she has never been convicted of violating the laws of this state or of any other state governing the sale or dispensing of alcoholic beverages. (d) JIM TAYLOR  Page 2 of 4 A.C.A. § 3-9-222 (1) Within five (5) days after filing an application for a permit to dispense alcoholic beverages on the premises, a notice of the application shall be posted in a conspicuous place at the entrance to the premises. (2) The applicant shall notify the director of the date when the notice is first posted. (3) No permit shall be issued to any applicant until proper notice has been so posted on the premises for at least thirty (30) consecutive days. (4) (A) The notice shall be in such form as the director shall prescribe by rule or order. (B) The notice shall be: (i) At least eleven inches (11") in width and seventeen inches (17") in height; and (ii) Printed in black lettering on a yellow background. (e) (1) Upon receipt by the director of an application for a permit, written notice thereof, which shall include a copy of the application, the application shall immediately be mailed by the director to the sheriff, chief of police, if located within a city, prosecuting attorney of the locality in which the premises are situated, and city board of directors or other governing body of the city in which the premises are situated if within an incorporated area. The provisions of this section shall be retroactive to July 28, 1995. (2) No license shall be issued by the director until at least thirty (30) days have passed from the mailing by the director of the notices required by this section. (3) Upon receipt by the director within the thirty (30) days of a protest against the issuance of a permit by a governing official of the city or county to whom the notice of an application for permit has been mailed, the director shall not issue the license until he or she has held a public hearing. (f) Upon the director's determining that the applicant is qualified hereunder and that the application is in the public interest, a permit may be issued as authorized in this section. I graduated from Cabot High School in 2008. After graduation, I attended Arkansas Tech University in Russellville where I finished with a Bachelor of Science in Agriculture Business. Later, I attended the University of Arkansas at Fayetteville where I earned a Master’s degree in Economics and Finance. In June of 2014, I moved to Paragould after being offered a job with Centennial Bank as a commercial loan officer. In early 2016 I transferred to Jacksonville, then 15 months later achieved my goal of returning to Cabot for a job at Centennial’s Main branch. Recently I’ve taken enough accounting courses to receive my Bachelor’s degree in accounting later this month. I’m a lifelong member of Cabot United Methodist Church where I actively serve and currently sit on their finance committee. (FORMERLY TASER INTERNATIONAL) FOR THE PURCHASE OF ELECTRONIC DEVICES FOR THE CABOT POLICE DEPARTMENT; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, Ark. Code Annotated § 14-58-303 et al., provides that competitive bid requirements may be waived by the governing body of a municipality for purchases that are clearly and legitimately limited to a single source of supply, and WHEREAS, the Cabot Police Department desires to new purchase electronic control devices as the current devices in use with the department are considered obsolete and Axon will no longer support the repair of the current devices or provide replacement power sources; and WHEREAS, the total purchase price of the new electronic control devises is approximately $87,632.85 which will be paid over a period of five years, with the first payment being paid in 2018 at a rate of $13,847.37 and the remaining balance to be paid on an annual basis at a rate of $18,446.37; subject to the approval of this governing body. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CABOT, ARKANSAS, THAT: SECTION 1: Axon Enterprises, Inc. is a sole source provider that can meet the needs for the City’s purchase of the electronic control devices, 5-year warranty on said devices, and duty cartridges and all bidding requirements are hereby waived. SECTION 2: The Mayor and Clerk~Treasurer are hereby authorized to enter into a contract with Axon Enterprises, Inc. and execute any and all documents necessary to effectuate the purchase of the electronic control devices. SECTION 3: EMERGENCY. The Cabot Police Department’s current electronic control devices are obsolete and can no longer be supported with repairs or replacement power sources.
