Community Development Input General Community Input Adjournment ThisPageleft Blank Public Works ThisPageleft Blank ORDINANCE NO. __ OF 2018 AN ORDINANCE ACCEPTING A PORTION OF HIGHWAY 367, SECTION 14, BETWEEN HWY 321 AND HIGHWAY 38 INTO THE STREET SYSTEM FOR THE CITY OF CABOT, LONOKE COUNTY, ARKANSAS FROM THE ARKANSAS STATE HIGHWAY AND TRANSPORTATION DEPARTMENT; DELCARING AND EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, a portion of Highway 367, specifically Section 14, between Highway 321 and Highway 38 will be widening to five lanes upon completion of Job 061509 by Arkansas Department of Transportation (ARDOT); and WHEREAS, the City of Cabot desires to partner with ARDOT to expedite the design and construction of said project; and WHEREAS, the City of Cabot agrees to accept all ownership and full responsibility for the maintenance of that portion of Highway 367, Section 14, between Highway 321 and Highway 38 with the roadway constructed by ARDOT Job 061509, in the City of Cabot, which is to be transferred to the City of Cabot, in accordance with Arkansas Code Annotated § 14-301-102; and WHEREAS, acceptance of the proposed change and transfer is practical and will be in the best interest of the City of Cabot and the public. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF CABOT, ARKANSAS: SECTION NO. 1: The City of Cabot, Arkansas, hereby agrees and accepts Highway 367, Section 14, between Highway 321 and Highway 38 with the roadway constructed by ARDOT Job 061509, in the City of Cabot, into the City of Cabot’s City Street System. SECTION NO. 2: Pursuant to Arkansas Code Annotated § 14-301-102, this change to the State Highway System and the Cabot City Street System, reflected on attached Exhibit "A", is hereby accepted and authorized by the City Council of the City of Cabot, Arkansas. SECTION NO. 3: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Lonoke County and recorded in the deed of said county. SECTION NO. 4: Upon completion of the roadway constructed by ARDOT Job 061509, that portion of Highway 367, Section 14, between Highway 321 and Highway 38, in the City of Cabot, Lonoke County and after the City of Cabot receives official notification from the Deputy Director and Chief Engineer with ARDOT that said portion of Highway 367 is removed from the State Highway System by the State Highway Commission, this Ordinance shall take effect and be in force immediately thereafter. SECTION NO. 5: A copy of this Ordinance shall be submitted to the Arkansas State Highway and Transportation Department for their records. SECTION NO. 6: Emergency Clause. ARDOT will advance the bid letting date to start construction of the Highway 321 widening from May 2020 to May 2019, 1 full year earlier. The widening of that portion of Highway 367, Section 14, between Highway 321 and Highway 38, in the City of Cabot, is of proper and beneficial use for the City of Cabot, Arkansas and is of great importance to the health and welfare of its citizens. An emergency is therefore declared and this ordinance being necessary for the preservation of the public peace, health, safety and welfare shall be in full force and effect. SPONSOR: PASSED: William A. “Bill” Cypert, Mayor EMERGENCY CLAUSE: DATE: APPROVED: _____________________________ William A. “Bill” Cypert, Mayor APPROVED AS TO FORM: ATTEST: ________________________________ ________________________________ Jim Taylor, City Attorney Tammy Yocom, City Clerk-Treasurer RESOLUTION NO. __ of 2018 A RESOLUTION EXPRESSING SUPPORT FOR APPLICATION TO THE ARKANSAS DEPARTMENT OF PARKS AND TOURISM FOR ITS OUTDOOR RECREATION GRANT PROGRAM; AUTHORIZING THE MAYOR AND CITY CLERK-TREASURER TO EXECUTE ANY NECESSARY DOCUMENTS AND TO EXPEND FUNDS, IF NECESSARY; AND FOR OTHER PURPOSES WHEREAS, Cabot, Arkansas seeks to improve the recreation facilities and wishes to seek grant funding assistance; and WHEREAS, in order to obtain the funds necessary to develop and/or improve the site for such a recreation area, it is necessary to obtain a 50/50 Matching Grant from the Arkansas Department of Parks and Tourism’s Outdoor Recreation Grant Program; and WHEREAS, the plans for such recreation areas have been prepared and the price therefore has been established; and WHEREAS, this governing body understands the grantee and grantor will enter into a binding agreement which obligates both parties to policies and procedures contained in the Land and Water Conservation Fund Grants Manual including, but not limited to the following: the park area defined by the project boundary map submitted in the application, must remain in outdoor recreation use in perpetuity, regardless if the property is bought or developed with matching grant funds and; all present and future overhead utility lines within the project boundary must be routed away or placed underground and; the project area must remain open and available for use by the public at all reasonable times of the day and year; facilities can be reserved for special events, league play, etc. but cannot be reserved, leased or assigned for exclusive use, and; the project area must be kept clean, maintained, and operated in a safe and healthful manner. WHEREAS, the City Council is well aware and apprised of the above-mentioned project and will provide the local portion of the development cost of the entire project. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT: SECTION 1: The Mayor is hereby authorized to make application to the Arkansas Department of Parks and Tourism for assistance with park improvements at Richie Road Park and the Highway 321 Sports Plex for the City; therefore, such application shall be submitted as expediently as possible. SPONSOR: PASSED: William A. “Bill” Cypert, Mayor DATE: APPROVED: _____________________________________ William A. “Bill” Cypert, Mayor APPROVED AS TO FORM: ATTEST: __________________________________ _____________________________________ Jim Taylor, City Attorney Tammy Yocom, City Clerk-Treasurer Police & Fire This Page left Blank ORDINANCE NO. __ of 2018 BE IT ENACTED BY THE CITY COUNSEL OF THE CITY OF CABOT, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE CABOT FIRE DEPARTMENT TO OPERATE BEYOND THE CORPORATE LIMITS OF THE CITY OF CABOT, ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, the citizens of the City of Cabot, Arkansas, have an interest in securing and providing fire protection services to benefit those portions of Lonoke County that are underserved or not served; WHEREAS, the Cabot Fire Department wishes to provide fire protection services to benefit those portions of Lonoke County that are underserved or not served; WHEREAS, the Cabot Fire Department wishes to provide a method to collect costs of providing services outside the city limits of the City of Cabot, Arkansas; WHEREAS, Ark. Code Ann. § 14-53-102 (the “Authorizing Legislation”) states in pertinent part: In order to prevent the destruction by fire of property located outside the corporate limits of cities and towns and in order to lessen the loss caused on account of insufficient means to combat fires and as a protection against such loss, the city council or other governing body of any city or town having an organized fire department may provide by ordinance that the firefighting machinery and equipment, with the necessary firefighters to operate it, may be used to combat fires beyond the corporate limits of any city or town, upon such terms, conditions, and restrictions as may be prescribed in the ordinance[;] WHEREAS, the City Council of the City of Cabot finds that there exists an immediate need for fire protection services for portions of Lonoke County and desires to authorize the Cabot Fire Department, to use the firefighting machinery and equipment, with the necessary firefighters to operate it, along with all other reasonable actions necessary, to combat fires beyond the corporate limits of the City of Cabot and within the borders of Lonoke County and to otherwise comply with the requirements of the Authorizing Legislation by the adoption of this ordinance; NOW THEREFORE, be it enacted by the City Council of the City of Cabot, Arkansas: Article I: Authorization. The Cabot Fire Department is hereby authorized, pursuant to Ark. Code Ann. § 14-53-102, to use the firefighting machinery and equipment, with the necessary firefighters to operate it, along with all other reasonable actions necessary, to combat fires beyond the corporate limits of the City of Cabot, Arkansas. The Cabot Fire Department shall have the right to refuse to respond to any request for service outside the corporate city limits if, in the judgment of the fire chief, or authorized representative, the services within the city limits would be impaired. Article II: Service Area. The Cabot Fire Department is authorized, but not required, to operate in all unincorporated areas within the borders of Lonoke County. Article III: Payment. A. Schedule of Payment The person outside the city limits receiving the services of the city fire department as contained herein shall, upon presentation of a bill for service, pay to the City of Cabot, Arkansas: (1) An hourly charge equivalent to the regular hourly pay for each hour that each on-duty employee of the department is involved in response, and the overtime rate or off-duty rate of any off-duty employees who respond; (2) Administrative costs plus employee benefit costs; (3) Equipment depreciation costs; (4) The replacement costs of all equipment damaged or made unusable by contamination; in managing and mitigating the incident; (5) Any costs incurred by the fire department with any labor, materials, or supplies provided by a third party at the request of the fire department. B. Mutual Aid, Automatic Aid, or Interlocal Agreements If services are provided in accordance with a written mutual aid, automatic aid, or interlocal agreement, charges, if any, will be issued as outlined in the applicable agreement. Article IV: Severability. If any provision of this ordinance is held invalid, such invalidity shall not affect other provisions of the ordinance which can be given effect without the invalid provisions, and to this end the provisions of the ordinance are declared to be severable. Article V: Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this Ordinance are hereby repealed to the extent of such conflict. Article VI: Emergency Clause. In order to provide fire protection for underserved Lonoke County residents, to preserve the health, welfare, and safety of the underserved citizens of the County, an immediate need exists for the adoption of this ordinance. Therefore, an emergency is declared and this ordinance being necessary for the immediate preservation of the public peace, health, and safety shall be in full force and effect upon its enactment and approval.
