Community Development Input General Community Input Adjournment This Page left Blank Budget & Personnel RESOLUTION NO. ___ OF 2018 A RESOLUTION APPOINTING JAYESH LALLU TO POSITION 3 OF THE CABOT ADVERTISING AND PROMOTION COMMISSION; AND FOR OTHER PURPOSES WHEREAS, Arkansas Code Annotated § 26-75-605(d) provides that appointment to the Advertising and Promotion Commission shall be made through appointment by the remaining members of the Commission with approval of the governing body of the City; and WHEREAS, at the Advertising and Promotion Commission meeting held on August 21, 2018 and passed a Resolution to reappoint Jayesh Lallu to Position 3 of the Advertising and Promotion Commission due to the expiration of his current term; and WHEREAS, the City Council of Cabot agrees with the Advertising and Promotion Commission in that Jayesh Lallu is qualified to continue to serve on the Advertising and Promotion Commission and possesses the character and ability to serve the best interest of the citizens of Cabot. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT: SECTION 1: The appointment of Jayesh Lallu to Position 3 on the Advertising and Promotion Commission is hereby approved for a term to expire July 2022. SECTION 2: This resolution shall be in full force and effect from and after the date of its passage. In 2004 Purchased the Days Inn – Fordyce that was under Construction, helped finish the project, and opened the hotel in July 2004, since then have Owned, managed the daily operations of the hotel. This Page left Blank ORDINANCE NO. __ OF 2018 AN ORDINANCE TO APPROVE A CPI ADJUSTMENT REQUESTED BY WASTE CONNECTIONS (PREVIOUSLY PROGRESSIVE WASTE SOLUTIONS OF ARKANSAS, INC.) DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, on June 13, 2012 the City and IESI Corporation, now Waste Connections, Inc., entered in a contract for waste services and said contract was renewed on July 20, 2015; and WHEREAS, Section 5.04 Modification to Rates (a) CPI states that Waste Connections, Inc., shall be entitled to an increase in the base rate from time to time during the term of the contract to offset any increase in costs, so long as, the written request is submitted to the City with a 30 day notice and subject to the approval of this governing body; and WHEREAS, on August 28, 2018 Waste Connections submitted its written request, to the City of Cabot, for a CPI adjustment of 2.8%, which totals $0.49 increase per customer per month. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT: SECTION 1: The request by Waste Connections for a CPI adjustment which totals $0.49 increase per customer per month (for a grand total of $18.04 per month per customer) is hereby approved. SECTION 2: Ordinances and prior actions in conflict herewith are hereby repealed to the extent of the conflict. SECTION 3: The provisions of this Ordinance are hereby declared to be severable and if any section, phrase or provision shall be declared or held invalid, such invalidity shall not affect the remainder of the sections, phrases, or provisions. SECTION 4: Emergency. It is of great importance to the citizens of Cabot that the waste materials collection services are not delayed due to increased costs to Waste Connections and an emergency is therefore declared and this ordinance being necessary for the preservation of the public peace, health, safety and welfare shall be in full force and effect from and after its passage. August 1st 2018 marked the anniversary date of our contract and we are due a CPI-U (Consumer Pricing Index-Urban) increase. This allowance is in our contract on page 20 in section 5.04 CPI Adjustment. The current CPI-U is 2.8%. The new price will go in affect September 1st 2018 for the billing at the end of the month. This should allow you time to make any notifications the city needs to get all parties informed along with all members of the Cabot City Council.
