ORDINANCE NO. 4 OF 2020
AN ORDINANCE TO REPEAL ORDINANCE NO. 39 OF 2019; DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES
WHEREAS, the City Attorney recommends that Ordinance No. 39 of2019 be
repealed in its entirety.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
CABOT, ARKANSAS, THAT:
SECTION 1: Ordinance No. 39 of 2019 is hereby repealed, in its entirety.
SECTION 2: EMERGENCY. The proper and efficient operation of the City
of Cabot is of great importance to the health and welfare of its citizens. An emergency is
therefore declared and this Ordinance being necessary for the preservation of the public
peace, health, safety and welfare shall be in full force and effect from and after its
passage.

January 6, 2020
6:30 p.m.
The Cabot City Council held its monthly Work Session on Monday, January 6, 2020
in the City Annex Council Chambers. Council members present were: Ed Long,
James Reid, Damon Bivins, Ronald Waymack, Doug Warner, Kevin Davis, Norma
Naquin and Matt Webber. Others present: Mayor Ken Kincade, City Attorney Ben
Hooper, City Clerk & Treasurer Tammy Yocom, Deputy City Clerk Lisa Milam.
Mayor Kincade called the meeting to order at 6:30 p.m. Matt Webber led the
Pledge of Allegiance and Mayor Kincade led the opening prayer.
Motion to read legislation by title only by Kevin Davis, second by Ron Waymack.
Motion passed by a unanimous vote.
Municipal Services Committee Business:
1. Resolution No. 1 of 2020 – A RESOLUTION TO AUTHORIZE THE MAYOR
AND CITY CLERK/TREASURER TO ENTER INTO A CONTRACT WITH JCB OF
ARKANSAS FOR THE PURCHASE OF A 2019 JOHN DEERE 6105E TRACTOR;
AND FOR OTHER PURPOSES was read by City Clerk/Treasurer Tammy
Yocom. Discussion. Motion to adopt by Ed Long, second by Norma Naquin.
Motion passed with a unanimous Roll Call Vote.
2. Community Cats Proposed Ordinance - Discussion. No action.
3. Amended Sign Code - Discussion. James Reid requested the “red-line”
version. Mayor Kincade requested this legislation be codified soon. No
action.
4. Ordinance No. 1 of 2019 – Discussion. It was determined City Attorney, Ben
Hooper will write the council organizational legislation for 2020 and council
will make changes during the next council meeting. No vote taken. Ben
asked the council to determine when they will meet again since the regularly
scheduled meeting falls on a Holiday. Motion to move the January Council
Meeting to January 27th by Norma Naquin, second by James Reid. Motion
passed with a unanimous Roll Call Vote.
5. Resolution No. 3 of 2020 – A RESOLUTION TO AUTHORIZE THE MAYOR
AND CITY CLERK/TREASURER TO ENTER INTO A CONTRACT WITH REGAL
RESTORATION FOR THE CABOT PUBLIC LIBRARY ROOF REPLACEMENT;
TO AMEND THE 2020 SENIOR CITIZENS CENTER/HEALTH/LIBRARY
MAINTENANCE FUND BUDGET AND FOR OTHER PURPOSES was read by
City Clerk/Treasurer Tammy Yocom. Discussion. Motion to adopt by Matt
Webber, second by James Reid. Motion passed with a unanimous Roll Call
Vote.

Clerk/Treasurer Tammy Yocom. Discussion. Motion to adopt by Ed Long,
second by Norma Naquin. Motion passed with a unanimous Roll Call Vote.

Budget & Personnel Committee Business:
1. Budget & Personnel Committee Input – Discussion on who takes the Mayor’s
place in his absence. Mayor Kincade announced “just for the record,
Tammy Yocom is my replacement at City Hall”. City Attorney, Ben Hooper,
explained “the Mayor has two people who replace him in his absence for
each set of his duties. One for his administrative duties, which will be
Tammy, and one for his legislative duties which is presiding over meetings
and that is the one you guys will pick.” No action.
2. Budget & Personnel Committee Business: None
Community Development Committee Business:
1. Quarterly Report – Amy Williams, President/CEO Cabot Chamber of
Commerce gave a verbal report on the fourth quarter of 2019 Economic
Development. A copy of her talking points are attached to these minutes.
Discussion on the payment to the Chamber for the 2020 Economic
Development Contract. City Attorney Ben Hooper explained the invoice for
$100,000 from the Chamber immediately threw up a red flag with him since
the contract doesn’t mention an amount at all. We need something to
justify a $100,000 payment since the contract doesn’t mention the amount
or even making a payment up front. Kevin Davis recommended resolving
the issue somehow because the City has made a payment to the Chamber
in the past. He suggested running it by Municipal League.
2. McKinstry Energy Report Presentation – Jay Holstead with McKinstry Energy
presented a Power Point presentation. Please see attached for a printed
copy of the presentation.

I. Call to Order/Roll Call
Maggie Cope called the meeting to order at 6:31 pm.
Present: Maggie Cope, Greg Sled, Nick Whitaker, Tricia Ambeau, Adam Nobles.
Guests: Greg Crumpton, Doug Warner, Jeff Green
II. Minutes of Regular Meeting
The minutes of the regular meeting held on October 15, 2019 were presented. GREG SLED
MOTIONED TO ACCEPT THE MINTES OF OCTOBER 15, 2019, SECOND BY NICK WHITAKER, ALL
SAY AYE.
III. Financials
October and November 2019 financials were presented. TRICIA AMBEAU MOTIONED TO ACCEPT THE
FINANCIALS AS PRESENTED, SECOND BY ADAM NOBLES. General Director Travis Young stated the
months ended well. There was an overage due to correcting several maintenance issues at the
community center. Staff uniforms were purchased, and tablets were ordered for staff to enter time in
and out for payroll. Additional pay period from softball fell into November. Matching funds from a
grant for trail lights on Richie Road were also paid out. Assigner fees paid double due to all the rainouts.
Numbers are down by about 50 players in youth basketball due to teams leaving the rec league for
travel ball. ALL SAY AYE.
IV. Programs
Program Director Lorenzo Mendoza reported the basketball preseason tournaments were
played last weekend. Games are going well and will stop for two weeks due to the holidays and
resume the second week of January. Spring sports registration, baseball, softball, soccer,
volleyball, and tennis will begin January 20th.
BMX – The last race of the season was held the weekend before Thanksgiving. Glue was but
down on the track and more dirt was added Racing will resume when the weather warms. The
group had 30 riders represent at the Grands.
Flag Football – The group reported a great season and still has a couple of purchases to make
for the spring season, paying insurance and replacing some equipment for around $7500.00. A
tournament held in November was represented well and a trophy was brought back to Cabot.
The commission asked if there were any plans for the money since they have a high balance left
in their account. They talked about donating to some charity groups. The group stated that

some of the money not paid out was due to rainouts over the last two seasons and not having
to pay referees and purchasing equipment, which is typically about $20, 000.00 per year. They
would like to arrange to play more games, but the biggest obstacle is not having enough
referees available to add more games.
Cabot Football Association – Did not hold a meeting last month. Held board elections and have
about the same board as last season but missing the Director of Scheduling.
V. Construction/Facility Update
General Director Travis Young gave an update on facilities. Two sugar maples were donated for
the Community Pond Park. The floors at the community center were waxed and buffed and the
gym walls were painted. The lights around the walking track have yet to be updated. The turfs
on the fields are 100% completed. Any ruts created will be repaired by GEO. The maintenance
shop has been completed. The walking trails had new LED lights installed and the trails will be
resealed. Comp hours were held to 160 at most. We were not awarded the Outdoor Recreation
matching grants this year as we have the last couple of years. The trails at Regional Park are
coming along well with one boundary line issue being looked at for the proposed trail system at
the Regional Park.
VI. Old Business
ASE Contract/Rates – The commission had asked Greg Crumpton to look over the contract. No
discussion followed. The commission discussed the way different tournaments were operated
around the area. Most cities have a cleanup fee up to $1000.00 per day, some did away with
the fee. Paying clean up fees per field will be discussed with the tournament director. Make
sure we stock heavily with field dry as to not cancel a tournament. General Director Travis
Young stated that we need to lock in the dates for tournaments with Will Roark. NICK
WHITAKER MOTIONED TO APPROVE AGREED ON AMOUNT THAT WILL ROARK AND GENERAL
DIRECTOR TRAVIS YOUNG DECIDE UPON PER FIELD, PER DAY, TO INCLUDE CLEANUP, SECOND
BY GREG SLED. ALL SAY AYE.
VII. New Business
Audit – No issues were noted. Clean audit. Jeff Green gave the commission a summary of the
audit.

4th of July Celebration – The 4th falls on a Saturday this year and staff would like to get a date
set for the celebration in order to secure fireworks and start the planning process. July 2nd or
3rd are the dates suggested. Other cities around Cabot have already scheduled for the 4th. NICK
WHITAKER MOTIONED TO HOLD THE CELEBRATION ON JULY 3RD, SECOND BY ADAM NOBLES,
ALL SAY AYE.
Budget – General Director Travis Young discussed items in our budget. A&P tax should give us
75% of taxes collected. There is about $125,000.00 that we are missing by not receiving that
75%. Mr. Young stated he will ask questions about this issue at the next A&P meeting and will
give the commission an update. The numbers are pretty much hard numbers. Salaries for
employees were looked at. Four employees are topped out on the pay scale and will only
receive cost of living increase. Those four employees will receive a onetime check to cover the
cost of living instead of spreading the amount out through the year. NICK WHITAKER
MOTIONED TO APPROVE THE 2020 BUDGET AS PRESENTED. Mr. Young stated that our
beverage contract is up this year and will go out for proposals between Pepsi and Coke
Companies. A display board for the community center will be purchased with the money
received from the chosen company. Discussion lead to adding a therapeutic coordinator to
budget to head up programs for special needs children and adults. It will add about $52,000.00
a year to the budget if a full-time person is hired, a part-time position may be possible.
Discussion was held due the motion on the table, SECOND BY TRICIA AMBEAU. Discussion
continued. Tricia Ambeau stated that she had spoken with Mr. Young about adding a
Therapeutic Coordinator to staff to head the program. This may include after school programs,
sports and a variety of activities. We would need to research the needs in the community. Ten
percent of the school’s population is special needs, and this does not include adults. The need
for programs in the community is there. The commission would like to put a plan together
within the next three to six months and capture the surrounding communities in the plan. ALL
IN FAVOR OF PASSING THE 2020 BUDGET AS PRESENTED, ALL SAY AYE.
Lifeguard incentive – Lifeguards will work a certain number of hours and be reimbursed for
class cost if they commit certain hours to a full outdoor season. Incentives will be based from
1-year guards to 4-year guards. One half of the lifeguards that we currently certify go to other
pools to work. GREG SLED MOTIONED TO ACCEPT STAFF RECOMMENTION FOR THE
INCENTIVE FOR REIMBURSEMENT, SECOND BY ADAM NOBLES, ALL SAY AYE.
Officer elections – Per the bylaws of Cabot Parks and Recreation Commission, the officers shall
be chosen at the December meeting each year, the board shall select a Chairman and a Co-

VIII. Community Input
Doug Warner discussed the Suicide Prevention Program for veterans that will be presented at
the Event Center on Thursday, November 19th at 1:00pm a task force panel will be available to
answer questions and testify.
Travis Young invited the commission members to the annual Christmas lunch/meeting
tomorrow at noon. Mr. Young thanks Crown Trophy and Red River Dodge for sponsoring the
event.
The next meeting will be held January 21, 2020.

GENERAL MANAGER’S REPORT:
Water Projects:
Well pump was put in service this week. Contract will chemically clean well next week.
Tank Rehab is complete.
Crews continue water main relocations for Hwy 321 widening.
Wastewater Projects:
Crews are continuing to relocate sewer at the Sports Complex for the Hwy 321 widening.
Contractor will begin replacement of clarifier drives at the wastewater plant late January or early
February.
Collins St – emergency sewer main replacement.
FINANCIAL REPORT:
Bruce reported the November Financial Report. Bert Mayer made a motion to approve the Financial
Report, 2nd by Richard Gray, Motion Carried Unanimously.
BUSINESS ITEMS:
Tim Lemmons from Lemmons Engineering requested to release water service territory on Maggie
property. Further discussion with ANRC on service boundaries.
Discussed 2020 Preliminary Budget in detail. Bert Mayer made a motion to amend the 2020 budget to
move Holland Bottoms project cost of $750K and Deer Creek at $400K from 2019 Budget. 2nd by Jim
Burk, Motion Carried Unanimously.
Bert Mayer made a motion to adopt the 2020 Budget as amended, 2nd Richard Gray. Motion Carried
Unanimously.

The minutes of the September 2019 Regular Planning Commission
meeting were approved with a motion by Mr. Prater and a second by Ms.
Bird, Motion passed unanimously by a Roll Call Vote.

a. Preliminary Plat, Deanna’s Place (Lemons Engineering)
Motion to adopt by Mr. Prater, second by Ms. Bird, by a Roll Call Vote
motion passed 5-0-0, upon the contingencies they revise ‘Typical
Cross Section’ on Street Layout Sheet to reflect he Cross Section
Standard ‘C6.0 for local roads –p. 32 of the City Master Street Plan;
Determine if stop sign at north-east quadrant/intersection of Peace
Ln. and Comfort Ln. will adversely affect queuing onto Hwy. 89 South;
Any and all on-site wells must be properly capped and certified as
abandoned per ADH standard practices; Add a concrete installation
detail to the Erosion Control plan; Victory Lane must be renamed and
verified per local Emergency 911 standard practices.

b. Preliminary Plat, Augusta Estates Phase I (Whitlow Engineering)
Motion to adopt by Mr. Carlisle, second by Mr. Prater by a Roll Call
Vote motion passed 5-0-0, upon the contingencies that, note on plan
waiver for sidewalks, and line note indicating date of approval by City
Council; The applicant has requested the City Council to waive
sidewalk requirements along the proposed interior road. As such, the
preliminary plat will need revisions based on the outcome of this
request,
If approved, additional notations on the plat specifying the
waivers requested, code reference, as date approved;
If not approved or partially approved, adjust roadway cross
sections as applicable based on degree of waivers applied to the
project
UDC Section 5.5.2 regarding required half-street improvements may
only be waived if one or two conditions are met. 1) The development
entails four lots or less; or 2) The public roadway is not slated for
future improvement. Given that the State Statute allows Cities’ to
plan and implement improvements in their defined Planning Area
Boundary, requiring half-street improvements in line with adopted
Mater Street Plan is warranted here. This is especially the case given
that an increase in development beyond the ‘Phase 1’ (as platted) area
is likely in the future, which will result in increased utilization of the
local road onto the minor arterial (Mt. Tabor Road). Otherwise, an In-
lieu contribution may be requested to Municipal Services; Temporary
easement must be placed on preliminary plat for purposes of
fire/safety apparatus to service the lots as platted; water service
confirmation letter from Grand Prairie Bayou prior to final plat
approval; unless the applicant can demonstrate otherwise, the use of
ADS (HDPE) materials may not be used to convey stormwater
underneath roadway. AS recommended by engineering review,
reinforced concrete should be utilized instead, and noted as such on
the plans street layout and cross section; plans must be revised to
show the installation of additional inlets upstream from Mt. Tabor
Road; move fire hydrant at the end of lot 17 to the lot line between lot
15 and lot 17; sheet 3 of 5/ Street Profile must be changed and edited
accordingly from 50’ to 60’ R/W.
c. Revised Planning Commission bylaws
Motion to adopt by Ms. Bird, second by Mr. Irvin by a Roll Call Vote
motion unanimously passed 5-0-0.
