THE NOVEMBER MEETING Conference Room In-Person and via Zoom Attendees: Gary Walker, Richard Gray, Bert Mayer, Jon Steelman, David Butler, Bruce Brown, Tim Joyner, Baxter Drennon, and Karen Ballard Gary Walker called the meeting to order at 6:30 P.M. Bert Mayer led the opening prayer. Jon Steelman made a motion to approve the minutes from September 23, 2021, 2nd by David Butler. Motion Carried unanimously. GENERAL MANAGER’S REPORT: Water Projects: Crews continue leak repairs, meter installations and meter changeouts. Hwy 321 Project tie-in to Hwy 89 south In-Progress. Dollar General tie-in to Candlewood and Kerr Rd – Complete. Tank painting and repairs, In-Progress. Wastewater Projects: Crews continue identifying I&I problems and correcting during inspections. Regions Bank Project - Sewer line replacement pending Bank remodel. Linden & Madison Project – Complete. Holland Bottoms Project – Crews have started laying 2600 ft. 18” sewer main pipe. Qualification Statements are due Friday 10/29 for Engineering Services related to ARPA. Bert Mayer made a motion to accept Baxter Drennon’s engagement letter with Hill, Booth and Smith law firm, 2nd by David Butler. Motion Carried unanimously. FINANCIAL REPORT: Bruce presented the September Financial Report. Bert Mayer made a motion to approve the Financial Report, 2nd by Richard Gray, Motion Carried Unanimously. BUSINESS ITEMS: Review of the preliminary Budget 2022 was discussed. Minutes- The Commissioners reviewed the minutes from the September 2021 meeting Motion to accept the minutes as written was made by Greg Jones Candace Tomboli making the second. The commission voted and the September 2021 minutes were accepted. Financial Report - Jay mentioned that collections are up a little from what we budgeted. Jay also mentioned possibly getting another CD, but the commission wasn’t interested at this time. It was asked when we will look at the potential 2022 budget and Gina Jones told him we do that in November. Motion to accept the September 2021 financial statements was made by Greg Jones 2nd was made by Bryan Williamson Chamber Report – Sarah Brown mentioned that it is chamber appreciation week and that mayor presented us with a proclamation at the city council meeting last night. We had a few new members. Cabotfest was great. Record crowds and all of our vendors and food vendors talked about how they made more than they ever had. Cabot Parks & Rec – Travis Young was here, and he said that they had finished spring baseball and softball seasons ended last night. Volleyball will end next week. We have already started basketball registration with our biggest issue being what we are going to do for uniforms. “There is a big, chaotic shipping world deal that everyone is running in to.” He said that their community center memberships are holding strong. We are taking care of some general maintenance around our parks. We compile a list all year and start knocking those things out now that it is slower and as time allows. General Discussion – Clint McGue said that since the commission talked at the last meeting, that they wanted to do a resolution to amend the bylaws to include remote attendance to our meetings, that he had written up the resolution and that any of it could be changed before approving it. He said that he left #5 blank so the commission could decide how many remote meetings a participant could have. He also mentioned that he put that no more than two commissioners could do remote participation at once, but that could be changed as well. Matt asked about point number 8 where it mentions that if the chairperson is out, that the vice chairperson or the secretary will run the meeting. Clint mentioned that we did not have those positions, but that could be voted on, or deleted from the resolution and the commission could just decide who would run the meeting in that case. It was discussed that they will allow a commissioner to participate in no more than 3 meetings by remote access within a calendar year, and to remove the vice chair and secretary wording from #8 in the resolution, Motion was made to approve the remote attendance with the changes mentioned above by Greg Jones and a 2nd was made by Candace Tomboli. All voted and it was accepted. The commission was reminded of Nachos and the Corner Store, both of whom signed for their certified letters reminding them of their delinquencies and telling them to pay and neither had called or paid. The commission voted to move forward to revoke both of their business licenses. They were also reminded that the gas station at the corner of Lincoln and Pine (Hwy 89), Sariah, LLC will not sign for or pick up their certified letters the last two times that we have sent them. The commission also decided to move forward to also revoke their business license. Motion to revoke the business licenses for Nachos, The Corner Store and Sariah, LLC was made by Greg Jones and the 2nd by Candace 41 Tomboli. All voted and it passed. The next A&P meeting will be November 16, 2021. The motion to adjourn the meeting was made by Greg Jones with Bryan Williamson making the 2nd. APPROVED ___________________________ 42  Exhibit E Planning Commission “There Is No Limit To The Amount Of Good You Can Do If You Don't Care Who Gets The Credit.” ~Ronald Reagan~ 43 Cabot Planning Commission Meeting Minutes October 26, 2021 – 7:00 p.m. Veterans Park Event Center 508 North Lincoln * Cabot, Arkansas 72023 AGENDA ITEMS In response to the 2020 COVID-19 outbreak and restrictions placed on social distancing by the Centers for Disease Control, the City of Cabot moved the monthly Planning Commission Meeting to the Veterans Park Event Center, 508 North Lincoln. This allowed for ten feet of spacing between chairs as suggested. The meeting was both open to the public and an online meeting with video through the web-based video conferencing tool Zoom. 1. Call to Order Chairman Young called to order the regular meeting of the Cabot Planning Commission at 7:00 PM, at the Veterans Park Event Center. Opening prayer and the Pledge of Allegiance were led by Chairman Young. 2. Roll Call A roll call was conducted. The following persons were present: Commission members Liz Bird, Chuck Prater, Mitch Ward, Jim Knaack, Matt Moudy, Ronny Loe, Chairman Young, City Attorney Ben Hooper and Halff – City Engineer Brian Vines. Attending via Zoom were Garver – City Planner Courtney McNair and Mayor Kincade 3. Approval of Minutes from Last Meeting and Other Matters The minutes of the September 2021 Regular Planning Commission meeting were approved with a motion by Mr. Ward and a second by Mr. Moudy, Motion passed unanimously by a Roll Call Vote 6-0-0. 4. Preliminary Plat – Caiden Place – (Lemons Engineering) The Engineer for the project, Tim Lemons, requested the item be tabled until the November 23, 2021 meeting. Motion to table by Mr. Knaack, second by Ms. Bird, motion was approved unanimously by Roll Call Vote, 6-0-0. 7. Final Plat- Autumn Brook Phase I – (Lemons Engineering) Commissioner Knaack recused himself. After a brief discussion, A Motion to approve with contingencies by Mr. Prater, second by Mr. Moudy, Motion was approved unanimously by Roll Call Vote, 5-0-1 with the 44 following contingencies: The surveyor’s signed stamp needs to be added  to the plat; the certificate of surveying accuracy must be signed and dated; asphalt must be installed prior to plat being signed by the Planning Commission Chairman; Add the centerline bearing and distance for Arkansas State Highway 89. Show the boundary line if the centerline is not the boundary of the property. The Right-of-Way for Arkansas State Highway 89 is 80’. Right-of-Way dedication is required; A floodplain development permit is recommended for all lots in the BLE Rick area. It is understood that this development may not have area with the SFHA, but there are concerns in the BLE risk area. 8. Final Plat- Lot 1, Rex and Sonia’s Place – (Bond Consulting Engineers) Motion to approve by Mr. Loe, second by Ms. Bird the Motion was approved unanimously by Roll Call Vote, 6-0-0. 9. Replat – Lots 24R & 25R, Mystery Lake at Greystone – (Bond Consulting Engineers) –Motion to approve by Ms. Bird, second by Mr. Loe. Motion was approved unanimously by Roll Call Vote, 6-0-0. 10. Replat – Lot 50R, Waters Edge at Cypress Creek – (Bond Consulting Engineers) –Motion to approve by Mr. Prater, second by Mr. Ward. Motion was approved unanimously by Roll Call Vote, 6-0-0. 11. Replat – Lots 14R and 15RR, Valhalla Subdivision – (Chris Maxwell) Motion to approve with contingencies by Mr. Moudy, second by Mr. Ward. Motion was approved unanimously by Roll Call Vote, 6-0-0 with the following contingencies: The lots should be labeled as 14R and 15RR; Add the existing Bill of Assurance recording information to the general notes; Add the names of the recorded subdivisions abutting the proposed subdivision with plat book and page number or instrument number; Add the zoning classification of the abutting properties; Ensure anywhere that states 14RR, that it is corrected to 14R. 12. Site Plan – Lot 2, Home Depot – Holiday Inn Express – (Bond Consulting Engineers) – After a brief discussion, Motion to approve with contingencies by Mr. Moudy, second by Mr. Prater with the following contingencies: Dimension the sign to the property line. The sign must be located 15’ behind the Right-of-way; Ensure that the lighting fixtures do not have light pollution and spillover onto the adjacent residential homes that are south of the property; On the paving plan, label the existing sidewalks; Indicate the base flood elevation (BFE) of the floodplain on- site. The building FFE is 292’. The general notes indicate the min FFE is 283’, but the BFE is listed as 287.4. (Structure shown has a FFE of 292’). Please clarify. 13. Site Plan – Meadowbrook Apartments – (Bond Consulting Engineers) After a lengthy discussion, Motion to approve with contingencies by Mr. Loe, second by Mr. Prater with the following contingencies: Since the 40- foot buffer strip has been encroached upon, a 15-foot buffer shall be maintained. Landscape trees must 45 be provided within this 15-foot buffer. Revise the landscape plan to show trees within this buffer; State the  method of irrigation on the landscape plan. Motion was approved 4-2-0, with Commissioners Bird and Prater voting no. 14.
