NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CABOT, ARKANSAS, THAT: SECTION 1: The rate of taxation of real and personal property in the City of Cabot, Arkansas for certain City purposes are hereby fixed, established and levied as set forth in Section 2 of this Ordinance. David Butler led the opening prayer. David Butler made a motion to approve the minutes from July 28, 2022, 2nd by Richard Gray, Motion Carried unanimously. GENERAL MANAGER’S REPORT: Water Projects: Crews continue to locate leaks and make repairs, meter installations and meter changeouts. Water & Sewer Relocation Hwy 89 and Hwy 5 Interchanges, pending ARDOT to issue permit. Wastewater Projects: Oak Meadows/Barnwell project - crews continue working on this project replacing sewer lines. First Baptist Church – crews are laying sewer pipe on last part of project since ground has dried up. ARPA – Reviewed plans for Sewer Extension through Candlewood up to Horton pump Station. FINANCIAL REPORT: Bruce presented the July Financial Report. Bert Mayer made a motion to approve the Financial Report, 2nd by David Butler, Motion Carried Unanimously. Funding Request – Building Bridges – Ashely Fugo was here asking for $2000 for their Golden Bridge Gala to celebrate their 50th year. Motion was made by – Bryan Williamson with 2nd being made by Stephen Redd – all voted, and it was accepted. City of Cabot/Cabot Christmas Committee – (BUDGETED) Travis Young was here to pick up the $10,500 check for the Cabot Christmas Parade. Minutes- The commissioners reviewed the minutes from the July 2022 meeting. Motion to accept was made by Brian Knowles only after the minutes were corrected and the city of Cabot funding request was taken off, that was mistakenly left on there after June’s meeting. The 2nd was made by Stephen Redd, all voted, and July 2022 minutes were accepted. Financial Report - Jay mentioned that the income was a little less this month because in June, a company had paid over $16,000 to catch their company up on taxes. Discussions were had about checking into changing companies from Pay Simple due to their fees. Motion to approve the July 2022 financials was made by Stephen Redd with a 2nd being made by Brian Knowles. All voted and the July 2022 financials were accepted. Chamber Report – Sarah Brown was here and said that we had 8 new members last month. She also mentioned that we have had several ribbon cuttings and some coming up as well. She mentioned that we are in full swing planning both Cabotfest and The Wall that Heals. Cabot Parks & Rec – Travis Young was here and said that it is business as usual. They have partnered with the school district with their fall football. They have 7 different fall sports. He mentioned that they had a ripped pad in the pool at the aquatic park. The all-inclusive playground will start in 2 weeks. Gearing up to host the NIT baseball tournament on the weekend of September 17th. This will be the first time one of these tournaments has been held in Arkansas. The wave pool is out to bid. They plan to add security cameras and lockers to the aquatic park next year. City of Cabot Economic Development- Alicia Payseno was here and said that the hotel was working on their 4th floor. Chick-fil-a has purchased property on Main Street where the strip mall is next to the CAS building. Because of them coming to Cabot, the city has received a lot of interest from other businesses. General discussion – The commission spoke about the 2 businesses that were 6 months behind. Gina mentioned that letters had ben sent to both, but all letters for one had come back to me. The other needed to be voted on to revoke their business license. Motion to revoke the business license for the one business 6 months behind was made by Matt Webber and a 2nd made by Stephen Redd. All voted and it was accepted. APPROVED ___________________________ 73  Exhibit E Planning Commission “There Is No Limit To The Amount Of Good You Can Do If You Don't Care Who Gets The Credit.” ~Ronald Reagan~ 74  CABOT PLANNING COMMISSION MEETING MINUTES August 23, 2022 – 7:00 p.m. Veterans Park Event Center 508 North Lincoln * Cabot, Arkansas 72023 AGENDA ITEMS In response to the 2020 COVID-19 Pandemic and restrictions placed on social distancing by the Centers for Disease Control, the City of Cabot moved the monthly Council Meeting to the Veterans Park Event Center, 508 North Lincoln, as advertised. This allowed for spacing between chairs, as suggested. The event was successfully streamed through YouTube. 1. Call to Order Chairman Young called to order the regular meeting of the Cabot Planning Commission at 7:00 PM, in the Veterans Park Event Center. Opening prayer and the Pledge of Allegiance was led by Chairman Young. Roll Call 2. A roll call was conducted. The following persons were present: Commission members Liz Bird, Ronny Loe, Mitch Ward, Matt Moudy, James Knaack, City Attorney Ben Hooper, Halff – City Engineer Sam Kreimeyer. Attending via zoom was Garver – City Planner Courtney McNair. Absent was Chuck Prater. 3. Acceptance of Minutes from Last Meeting and Other Matters The minutes of the July 2022 regular Planning Commission Meeting were approved with a motion by Ms. Bird, and a second by Mr. Loe. Motion passed unanimously by a Roll Call Vote 5-0-0. 4. Planning Commission (Public Hearing) opened at 7:21 PM a) Rezone – Part of the SE ¼ of Section 13 – (Davidson Engineering) - Motion to approve by Mr. Moudy, Second by Mr. Loe. Motion was denied by Roll Call Vote, 2- 3-0, with Bird, Ward and Loe voting no. A Special Use Permit for Self-Storage for this property was advised. 5. Planning Commission (Public Hearing) Closed at 7:41 PM 6. Planning Commission (New Business) a) Preliminary Plat – Wolfsbridge at Cabot, Phase 1A– Commissioner Knaack recused himself. Commissioner Young voted. Motion to approve with contingencies by Mr. Bird, Second by Mr. Moudy. Motion was approved unanimously by Roll Call Vote, 5-0-1 with the following contingencies: That a final plat will not be brought before the Planning Commission until the construction of Wolfsbridge Loop is connected to AR Hwy 89. This shall include but not be limited to the complete construction and platting the Right-of -Way of the street; Provide a preliminary Bill 75  of Assurance and/or POA documents. Ensure that the documents address who will be responsible for maintenance of the proposed Tracts A-E; Discuss with the Traffic Operations Director the location of ALL STOP intersections; Add a note to the preliminary plat to delineate the raised crosswalk; Add to the grading plan sheet the elevation of the finished grade for each lot; Provide evidence that structures near the creek with unmapped flood hazard are not at risk. This may be done by obtaining a LOMR or at minimum provide the city with a hydraulic model for the proposed conditions; The drainage report provided does not appear to take into account the proposed roadway with the pond storage. Additional storage is required for when the roadway is developed; Provide the geotechnical report to assure that the proposed pavements are structurally adequate. b) Final Plat- Autumn Brooke, Lots 1-11, 35-40, 44-57 and 60-63 – (Lemons Engineering)– Commissioner Knaack recused himself. Chairman Young voted. Motion to approve with contingencies by Mr. Ward, second by Ms. Bird. Motion was approved unanimously by Roll Call Vote 5-0-1 with the following contingencies: The portions of the asphalt that were laid over base material that was heavily saturated from rain need to be removed and density tests will have to be done to ensure the base has adequate compaction. The compaction tests and asphalt installation must be approved by the street department; A letter must be supplied from the Electric Utility company stating they will install street lights and give an approximate time frame for installation; The ditch line needs better establishment from Hwy 89, where the two 32-inch arch pipes drain to the 8-inch culvert that was installed between lots 4 & 5. The small basin needs better establishment where there is rip rap around the sides. Commissioner Knaack returned c) Final Plat – Lot 1, Central Arkansas Family Clinic Addition – (Bond Consulting Engineers) - Motion to approve with contingencies by Mr. Moudy, second by Mr. Loe. Motion was approved unanimously by Roll Call Vote 5-0-0 with the following contingency: Provide a proposed Bill of Assurance. d) Site Plan – Central Arkansas Family Clinic addition – (Bond Consulting Engineers) - Motion to approve with contingencies by Mr. Loe, second by Mr. Moudy. Motion was approved unanimously by Roll Call Vote 5-0-0 with the following contingencies: Add a light pole at the entrance/exit. Add a note to the electrical site plan stating the light must meet Dark Sky guidelines; Cabot WaterWorks requires an executed Developer Agreement for water and sewer extensions prior to construction; Sheet C3.0, the note for 6” Taping Sleeve & Valve is covered by another note for driveway. Confirm this is a 6” tap; Sheet C3.0, change note on sewer service to read – “Connect Sanitary Sewer at Manhole”. e) Final Plat – Cabot Indoor Storage Facility – (Davidson Engineering) – Applicant requested this item be tabled. Motion was approved unanimously by Roll Call Vote 5-0-0 with the following contingencies: A 5’ sidewalk shall be installed adjacent and parallel to the Right-of-Way of South Polk Street. This sidewalk shall be from Lueada Street to the Cabot Public Schools Administration building; Revise the landscape plan notes. The notes appear to be from another project; Provide a boundary survey of the property. The survey must be signed, sealed and dated by a licensed surveyor. The survey shall have a legal description of the proposed site and clearly label the point of beginning.
