THE DECEMBER MEETING Conference Room In-Person and via Zoom Attendees: Gary Walker, John Woodall, Bert Mayer, David Butler, Baxter Drennan, Bruce Brown, Tim Joyner, David Langstaff and Karen Ballard. Gary Walker called the meeting to order at 6:30 P.M. Bert Mayer led the opening prayer. David Butler made a motion to approve the minutes from October 27, 2022, 2nd by Bert Mayer, Motion Carried unanimously. GENERAL MANAGER’S REPORT: Water Projects: Crews continue to repair leaks and main breaks, meter installations and meter changeouts. Water crews have been assisting with utility locates for City Fiber installation. Wastewater Projects: First Baptist Church – Pending final cleanup Elm to S Pine sewer replacement project –Pending final cleanup Fortson Trailer Park sewer main replacement - replaced 8” lateral. Waiting on 18” pipe to arrive. ADEQ performed an inspection at the wastewater treatment plant November 9th. Waiting on the report findings. Reviewed the process on locate (811) process. Discussed hours required of employees performing locates for Fiber Optic installation Contractors. Our attorney sent a letter denying damage claim on November 1 to the customer with claim for house settling. No response from customer. ARPA – Design Plans for the Candlewood sewer extension have been submitted to the Arkansas Dept of Health for approval. Will meet with Crist Engineering with intent to advertise for bid. ARPA State grant application was submitted and now waiting on response. Wolfsbridge Subdivision – Request Grand Prairie Water add fees to the water bill for providing meter readings to Cabot. FINANCIAL REPORT: Bruce presented the October Financial Report. David Butler made a motion to approve the Financial Report, 2nd by Bert Mayer, Motion Carried Unanimously. BUSINESS ITEMS: Reviewed the 2023 Preliminary Budget. David Butler made a motion to amend line item on meters and lids from $14,000 to $15,000. Will review and approve at December meeting. 41 NON-AGENDA ITEMS: David Butler discussed the current CD rates. Funding Request Recap- Denise Goforth with Arkansas Federal Credit Union was here to discuss the recap of the USAF Military Ball. Funds were used to pay for commemorative coins and table sponsorship. The funds also made it possible for 94 airmen to attend the ball free of charge. Gina Jones, Director and CEO of the Cabot Chamber of Commerce was in attendance to give the recap of Cabotfest. Expenses were $67,371.87. A funding recap was requested. Minutes- The commissioners reviewed the minutes from the October 2022 meeting. Motion to accept was made by Brian Knowles and the 2nd was made by Jay Lallu, all voted, and October 2022 minutes were accepted as written. Financial Report - No discussions were had. Motion to approve the Financials for October 2022 was made by Brian Knowles and second made by Jay Lallu. Minutes were accepted as written. Chamber Report – Gina Jones said that the Wall that Heals was an amazing event. It was a very emotional and moving week. It was manned 24 hours each day. There was a banner in place dedicated to the A&P Commission, because they paid for it to come to Cabot and it is much appreciated. Matt Webber stated that the Veteran’s Day presentation was the best he’s ever seen. Jay Lallu stated that he received many guests due to the Wall. Mrs. Jones stated that people visited from all over the state, as well as surrounding states. We had 9 new members since the last meeting. Cabot Christmas Open House will be this Sunday, with 38 participating businesses. Cabot Parks & Rec – Travis Young said that it is business as usual. They have almost 700 kids signed up for basketball, which is huge. It will start on the December 3rd. The all-inclusive playground is complete. The official ribbon cutting will be Thursday at 1:00pm. On December 3rd, we will have Celebrate the Season. Brian Knowles asked the progress on the new facility. Mr. Young stated the contract has been signed, and they are now in the submittal process for all the vendors. They now have one vendor that does all the flooring, goals, and all equipment inside the buildings. Ground Breaking should be sometime in December, with tentative opening date of January 2024. He stated that they are very close to budget. City of Cabot Economic Development- Alicia Payseno said there are a lot of projects going on. The city has experienced some difficulties with the CAS building. The city council and the mayor pulled back from Nabholz and is now doing a hard bid. On the restaurant side, Overtime has purchased the Dollar General building by Kroger. There is another restaurant finalizing their contract soon, as well as a fast service coffee finalizing their contract on Main Street. The Kmart building has secured an architect and engineer. The city hopes to make an announcement of the business(s) by the end of the year. Fiber internet is being laid in the Greystone area. It will continue to move towards the city. General discussion – The commission discussed potential commissioners. The positions open are restaurant owner/hospitality positions. Matt Webber stated he has two names. He passed around information of the potential 44 commissioners. Greg Jones asked what the typical process is once the bios are received. Clint McGue stated that they would go off recommendations. The positions are to be filled by the commission. After the commission approves the selection, it will go before the city council. The names given were Blake Lively and Johnny Campbell. Greg Jones stated we need to fill one of the positions immediately. Clint McGue stated that the commission needs to not assume that Jay Lallu is no longer to be considered and he is not excluded. Matt Webber asked if Jay Lallu wants to be considered again, and Mr. Lallu stated that he would like to be. Stephen Redd made the motion to add Blake Lively to the commission, with Brian Knowles making the second. Blake Lively was approved. Matt Webber stated he hoped all positions would be filled by the beginning of the new year. Jay Lallu’s position was discussed. Clint McGue stated that Mr. Lallu will hold the position until he is either reinstated or a successor has been appointed. The 2023 budget is up for discussion. Mr. Jones asked if they want to raise their monthly projections or leave as is. Stephen Redd said leave as is, as well as Jay Lallu. Motion to keep the budget the same was made by Stephen Redd, with the second made by Jay Lallu. Motion carries. 3 Flamingo’s officially sold last week. The new owners only bought the name and machines. Clint McGue stated that the new buyers are not liable for the previous owner’s past due taxes. This allowed for spacing between chairs, as suggested. The event was successfully streamed through YouTube. 1. Call to Order Chairman Young called to order the regular meeting of the Cabot Planning Commission at 7:00 PM, in the Veterans Park Event Center. Opening prayer was led by Commissioner Bird and the Pledge of Allegiance was led by Chairman Young. 2. Roll Call A roll call was conducted. The following persons were present: Chairman Chad Young, Commission members Liz Bird, Ronny Loe, Chuck Prater, James Knaack, City Attorney Ben Hooper, Halff – City Engineer Sam Kreimeyer. Absent were Matt Moudy and Mitch Ward. Chairman Young voted on all items. 3. Acceptance of Minutes from Last Meeting and Other Matters The minutes of the October 2022 regular Planning Commission Meeting were approved with a motion by Mr. Prater, and a second by Ms. Bird. Motion passed unanimously by a Roll Call Vote 5-0-0. 4. Planning Commission (Public Hearing) opened at 7:15 PM a) Rezone – Part of the NW ¼, NE ¼ , Section 18, T-4-N, R-9-W – From C-2 to C-3 with Special Use– (Bond Consulting Engineers) – Applicant requested the item be tabled until the next meeting because of publishing issues. Motion to table by Mr. Loe, Second by Mr. Knaack. Motion was approved unanimously by Roll Call Vote 5-0-0 with the following contingencies: Add the property owner and zoning information for the property located across the street; Add a label for each side setback or provide a note stating “Fire Marshal shall set aside yard requirements.” b) Site Plan – Lot 1, The Assembly – (Bond Consulting Engineers) –Motion to Approve with contingencies by Ms. Bird. Second by Mr. Prater. Motion was approved unanimously by Roll Call Vote 5-0-0 with the following contingencies: Add a label for each side setback or provide a note stating “Fire Marshal shall set side yard requirements”; Add the proposed building dimensions to all plan sheets (C2.0); Site lighting is required. Add lighting to the site plan. All lighting must meet Dark Sky guidelines; An opaque fence is required where C-2 zoning abuts R-1 zoning. Label the opaque fence on the site plan; Label on the site plan the proposed new sidewalk along AR Hwy 367/South 2nd Street. The sidewalk shall be located within the ROW and be parallel and adjacent to the ROW; The parking \calculations table is labeled incorrectly. Parking is based on maximum seating capacity in main assembly room. Please revise the parking calculations; The landscape shown does not meet landscape requirements. All existing tress that are to be considered shall be shown. Perimeter landscape requirements are 1 tree and 10 shrubs for every 50 linear feet of right-of-way frontage. Show the required landscaping that meet requirements; the drainage plan shown is not sufficient enough. The drainage report states the development will have an impact to the runoff from this site. On-site detention is required or you must apply for variance for detention. If you choose to submit a variance, the application must be submitted by noon, November 30, 2022.
