Conference Room In-Person and via Zoom Attendees: Gary Walker, Bert Mayer, Baxter Drennon, Karen Ballard, Bruce Brown, Tim Joyner, and David Langstaff Visitor: Wes Cobb David Butler by phone. John Woodall absent. Gary Walker called the meeting to order at 6:30 P.M. Bert Mayer led the opening prayer. David Butler made a motion to approve the minutes from September 28, 2023, 2nd by Bert Mayer, Motion Carried unanimously. GENERAL MANAGER'S REPORT: Water Projects: Crews continue with leak repairs, meter installations and utility locates for the City Fiber installation. Elm St Project – crews have completed the water line relocation. Total cost $38,521. Hwy 5 widening project – Crews will move water lines along Hwy 5 Wastewater Projects: Crews continue final cleanup on sewer replacement through Fortson Trailer Park. Crews have been mowing sewer easements and repairing damage from Fiber installation. ARPA grant – Hwy 321 sewer extension — Crews will complete the remainder 50 ft section next week. Water Maintenance Building – Planning Commission approved drawings. Architect will prepare cost estimates. FINANCIAL REPORT: Bruce Brown presented the September Financial Report. Bert Mayer made a motion to approve the Financial Report, 2nd by David Butler, Motion Carried Unanimously. BUSINESS ITEMS: A motion was made by David Butler to approve the purchase of a trench roller compactor from Hugg and Hall at $35,700, 2nd by Bert Mayer. Motion Carried unanimously. A motion was made by Bert Mayer to change 2023 Budget line item from ¾ ton to a 1 ton from $49,620 to $65,569, 2nd by David Butler. Motion Carried unanimously. A motion was made by Bert Mayer to approve the purchase of an F-350 diesel truck from state bid in the amount of $65,569, 2nd by David Butler. Call to Order Chairman Young called to order the regular meeting of the Cabot Planning Commission at 7:00 PM, in the Cabot City Annex, located at 208 South 1st Street, Cabot, AR. The opening prayer was led by Senior Pastor Jacob Lynn, with Cabot United Methodist Church and the Pledge of Allegiance was led by Chairman Young. 2. Roll Call A roll call was conducted. The following persons were present: Chairman Chad Young, Co-Chairman Ronnie Loe, Commission members Liz Bird, Chuck Prater, James Knaack, Mitch Ward, and James O’Gwynn and. Absent was City Attorney Ben Hooper. 3. Acceptance of Minutes from Last Meeting and Other Matters The minutes of the September 2023 regular Planning Commission Meeting were approved with a motion by Mr. Prater, and a second by Mr. Ward. Motion passed unanimously by a Roll Call Vote 6-0-0. 4. Planning Commission (Public Hearing) opened at 7:08 a) Rezone – North Lincoln Street from C-2 & R-1 to R-4H (Davidson Engineering) After citizen input and a long discussion, a Motion to approve the rezone request from R-1/C-2 to R-4H by Mr. Loe, Second by Mr. Prater. Motion was denied unanimously by Roll Call Vote 0-6-0. The commission felt the property being rezoned to R-4H in its entirety was not the best fit for this property. They suggested a PUD with single-family homes or garden homes and a few multi- family apartments is better fit for the property. b) Rezone – Part of Lot 1, McClellan Storage Addition from C-2 to I-1 (Bond Engineers) Motion to approve with no contingencies by Ms. Bird, Second by Mr. Loe. Motion was approved unanimously by Roll Call Vote 6-0-0. Planning Commission (Public Hearing) Closed at 7:58 PM 35 5. Planning Commission (New Business) a) Final Plat – Lot 1, Higginbotham Estates (Bond Engineers) Motion to approve with contingencies by Mr. Prater, Second by Ms. Bird. Motion was approved unanimously by Roll Call Vote 6-0-0, with the following contingencies: Provide a copy of deed showing Tim Higgenbotham is the owner of the property being proposed for platting; A floodplain development permit is required prior to any construction; All certifications must be signed and dated. b) Final Plat – Lot 1, Raul Estates (Bond Engineers) Motion to approve with contingencies by Mr. Ward, Second by Mr. Loe. Motion was approved by Roll Call Vote 4-3-0, with the following contingencies: A 10’ Utility Easement must be provided along the north side of Greystone Blvd; All certifications must be signed and dated. c) Preliminary Plat – Lot 1, DHR Sonic Addition (Davidson Engineering) Motion to approve with contingencies by Mr. Loe, Second by Mr. Prater. Motion was approved unanimously by Roll Call Vote 6-0-0, with the following contingencies: The easements shown on the preliminary plat will need to be tied down and bearing and distances will need to be added to any lines that are not parallel to the ROW lines; The building setback line and the easement line along the westerly lot line (Hwy 321 ROW) needs to have additional dimensions; All certifications and stamps must be signed and dated. d) Site Plan – Lot 1, DHR Sonic Addition (Davidson Engineering) Motion to approve with contingencies by Mr. Loe, Second by Ms. Bird. Motion was approved unanimously by Roll Call Vote 6-0-0, with the following contingencies: Please ensure there is only ONE site plan sheet and not TWO sheets. The site plan is to be a part of the entire set of plans. There should not be 2 different sheets for the site plan; Add pavement marking arrows to delineate traffic patterns through the site; The sidewalk along South First Street is not shown in the ROW. If the sidewalk isn't going to be installed in the ROW, then the sidewalk must be located within an easement; The sidewalk along South Firest Street needs to extend to the property. Ensure this shown on all sheets; Add a detail for an enclosed dumpster with gates shown; The proposed sign is shown on the site plan. Add sign dimensions and dimension sign location from ROW. The proposed signage must meet city of Cabot's sign regulations; Add to all plan sheets parking lot lighting. Lighting is required to be installed at all entrances/exit drives. Lighting shall meet Dark Sky guidelines; Add to the site plan a complete legend that indicates all information shown on the site plan; Add to all plan sheets sidewalk connectivity from the proposed project site to AR Hwy 321 sidewalk and to South First Street sidewalk; Provide exterior elevations of the proposed building listing the type of façade material and percentages of each façade material. The exterior elevations must meet the city of Cabot building design standards; A grading permit is required prior to any construction; A demolition permit is required prior to any construction; All certifications and stamps must be signed and dated. 36  e) Site Plan – Cabot Waterworks Facility (Bond Engineers) Motion to approve with contingencies by Mr. Knaack, Second by Mr. Prater. Motion was approved unanimously by Roll Call Vote 6-0-0, with the following contingencies: Provide a drainage report and drainage analysis. Provide Detention; Provide details on the detention structures within the drainage system; The ADA spaces shown are incorrectly drawn for VAN accessibility. Ensure the spaces meet ADA requirements; A grading permit is required prior to any construction; All certifications must be signed and dated. f) Site Plan – Lot 1R Hampton Commercial Addition (Bond Engineers) Motion to approve with contingencies by Mr. Prater, Second by Ms. Bird. Motion was approved unanimously by Roll Call Vote 6-0-0, with the following contingencies: Provide an approved ARDOT driveway permit; Provide detention area. Please see drainage report comments; Provide details on the detention structure within the drainage system; This site is subject to FEMA LOMR Case No. 14-06-4776A, where Determination Letter outcome states that a portion of the property was removed from the SFHA. The area described in the Determination Letter should be referenced on the site plan in order to verify if the proposed parking expansion area is still within the FEMA SFHA. Calculations will need to be provided to ensure there will not be an adverse impact to the downstream properties during flooding events; A floodplain development permit is required prior to any construction; A grading permit is required prior to any construction; All certifications must be signed and dated.
