Consultants and City Staff present: D. Visitors present: III. Consent Agenda A. Minutes of Past Meetings: To approve the minutes of the Regular Meeting held Monday, July 25, 2005. Addendum #1 B. Seminars – Electric Department: Roger Schmitz, Electric Department Superintendent, recommends the following seminars for his staff. 1. 2005 Substation School: To be held August 23 – 25 at the Rochester Public Utilities. (Matt Blocker) Expenses will include the registration fee of $350, mileage, and other miscellaneous expense such as parking fees, if any. Addendum #2 2. Arch Flash Hazard Analysis: To be held at the Rochester Public Utilities. (Matt Blocker and Tim Evans) Expenses will include a registration fee of $175 each plus mileage and any miscellaneous expense. Addendum #3 3. 2005 Overhead School: To be held September 27 – 30, at the MMUA Training Center in Marshall. (Matt Blocker and Tim Evans) Expenses will include the registration fee of $375 each, hotel room expense for 3 nights, mileage, meals and any miscellaneous expense. Addendum #4 C. 1  D. Council Action: IV. Visitors and Communication A. Multi-Family Housing: Enclosed with the Agenda is a copy of the letter sent to landlords. Also enclosed are certain pages from the Zoning Ordinance describing the permitted uses and conditional uses for R-1, Suburban Residential Districts and R-2, Urban Residential Districts. Also included at pages 121, 122 and 123 are the sections pertaining to conditional use, the criteria for conditional use and the obligation to conduct a public hearing to consider an application for conditional use permit. Follow the arrow. If an arrow points to a chapter heading or section heading the entire following section is in intended to be read. If it points to a section heading, then to a one of the sub paragraphs below, the intent is merely to point out that particular sub paragraph. Understand that the obligation, according to the Zoning Ordinance, to receive a conditional use permit for a multi-family housing has existed in the Zoning Ordinance since its writing. This is not something new, but is now to be newly enforced. The reasons for requiring a Conditional Use Permit are outlined in Section 153.415 and 153.416 on pages 121, 122 and the top of 123. There are additional requirements in the Zoning Ordinance concerning the area of apartments, off street parking and several other issues, but the intent for this meeting is merely to inform landlords that the obligation to obtain a conditional use permit is now going to be enforced and the requirements, all requirements, of the Zoning Ordinance shall apply to converted structures as well as to new structures. The Council need not make any motions on this issue since all criteria is in place in the ordinance. Again, this meeting is merely to inform all interested parties that the city shall now institute enforcement of the ordinance to all intended multi- family facilities not just new multi-family facilities. Addendum #5 B. C. D. Communications 1. The Wheel, August 2005. Addendum #6 V. Claims A. Prepaid Claims: Consideration of the Prepaid Claims for July 2005. Addendum #7 Council Action: 2  C. Claims Payable: Consideration of the Claims Payable for July 2005. Addendum #8 Council Action: VI. Old Business A. STH 44/76 Flashing Lights: Report on the current status of the application for flashing lights in advance of the pedestrian crossing. No action is required on this topic. B. School Concession Stand: The City Council approved a Zoning Application for the school concession stand at the past Council Meeting on July 25. Typically, a $100 Zoning Permit fee would be chargeable for such building. Since the City Council authorized a $500 contribution from the Liquor Store toward the construction cost of the concession stand, does the Council wish to waive the $100 permit fee? Council Action: C. Pool Fencing: A proposal was received Moe Fencing to extend the chain link fence on the west side of the pool to enclose a grassy area for an amount of $3,235. Council Action: D. E. VII. New Business A. LaCrosse Home Show: Mayor Morey will present. Council Action: B. Fire Barn: Overhead Door Company took the low bid in 2003 to install two new overhead doors for $2,894. The price quote at this time to complete the two remaining doors is $3,800. The increase is predominately due to steel cost increases. The budget does contain an amount of $11,300 for work to be performed on the garage, landscaping and driveway replacement. If the driveway replacement were postponed until 2006, we maybe able to install the 3  doors and not over spend the budgeted amount. I recommend you accept the quote and install the doors before this style of door changes and they no longer match those already installed. Council Action: C. Mid-Year Fire District Meeting: The Mid-Year Fire District Meeting was held July 26. Perhaps Mayor Morey and Member Fisch could review the topics discussed at the meeting. I will complete minutes of the meeting and present them at a later time. No action is required at this time. D. Police Department: I request the Public Safety Committee (Morey and Fisch) set a date to meet with Chief Shefelbine and myself to discuss office staffing during Amy Hoscheit’s maternity leave expected to start the end of September. E. Fair Booth Schedule: Joyce Iverson is still looking for volunteers to man the fair booth. Addendum #9 (Council Packets Only) F. G. VIII. Clerk’s Report A. Employee Time Record: Enclosed is the Employee Time Record for pay period July 18 – 31, 2005. Addendum #10 B. Minimum Wage: The minimum wage in the State of Minnesota increased to $6.15 per hour for “large-employers” effect August 1, 2005. C. Tree Inspection – Tewes: Mr. Gerardy will inform the Council of the recent tree inspection at Royce Tewes residence made by himself and Valerie Green, State Forester. D. Disconnection of Electric Meter: Just recently we became aware of a Minnesota Statue prohibiting disconnection of electric meters during an excessive heat watch, heat advisory, or the like. We were well aware of the winter disconnect prohibition, but the extreme heat conditions which was apparently passed in 2003. See MS 216B.0975. Addendum #11 E. Sales Tax Exemption: Enclosed is a letter to energy survey consultants, regarding a claim for sales tax exemption from a partial amount of electrical usage and 100% of water usage for the S & S Super Wash. Certain businesses and industries are exempt from sales tax whole or in part and the car wash was inspected and reviewed by energy survey consultants who found that the electrical usage should be 74% exempt from Minnesota Sales Tax. Based on 4  that, S & S Super Wash is requesting reimbursement of a portion of the sales tax paid for the past 3.5 years. Addendum #12 F. Police Department Activities: Enclosed is the Police Department Activities List and Summary Report for July 2005. Addendum #13 & 13a G. EDA Activities: Enclosed is a detail of Joyce Iverson’s activities during the months of May and June 2005. Addendum #14 H. Street Lighting Fee: Enclosed is a copy of a letter submitted to Mrs. Klug who inquired about termination of the street lighting fee which was implemented July 1, 2003. Included also is a copy of that portion of the Council Meeting Minutes of June 16, 2003. Addendum #15 I. Recent Revenues: 1. First Half Taxes, Special Assessment and TIF Distribution: $218,783.80. 2. First Half State Aids: $348,005. 3. Ace Telephone First and Second Quarter Franchise Fees: $5,080.80. J. Local Government Aid: The 2006 Local Government Aid projected for the City Of Caledonia is $747,863. Addendum #16 K. Houston County Meeting – Jail Location: Addendum #17 L. LMC Inspection: The League of Minnesota Cities annual inspects certain departments of the City to find safety hazards, which may result in a claim against the municipality. This is a preventative measure to find and repair problem areas before an incident occurs. The City recently had an inspection by Mark Casey, LMC.
