Page 2 of 2  Joint City Council & Planning Commission Special Workshop Meeting Agenda Report Agenda Item No. 1 SUBJECT: LAND USE AND ENTITLEMENT WORKSHOP MEETING DATE: April 22, 2023 PREPARED BY: Will Kolbow, City Manager Kelly Lucia, Planning Director Brendan Kearns, Assistant City Attorney RECOMMENDATION: That the City Council and Planning Commission receive and file the workshop report. BACKGROUND: The City of Calimesa has been experiencing unprecedented growth over the past several years, with our Planning Department receiving applications weekly for development and redevelopment projects, both large and small. Land use decisions are one of the most important City functions, as it impacts our communities as well as how and at what levels the City can provide services. Therefore, we believe it is in the best interest of the City Council, Planning Commission, and the public to thoroughly understand all that goes into the land use process, from initial application to Public Hearing. Further, a review of fundamental planning topics is necessary to provide full context. The goal of this workshop is to ensure all those interested in land use decisions are fully informed of the process so meaningful dialogue can take place in conjunction with those decisions. DISCUSSION: The workshop is structured such that the City Council, Planning Commission, and the public will understand the overall process, regardless of what type of application is under consideration. Additionally, it is important to note that, because no particular application is agendized for discussion nor has been noticed for a public hearing, it would be improper and inconsistent with the Brown Act to discuss any pending application during this workshop. However, prior project applications may be used to provide context or clarification of particular aspects of the entitlement process. Topics that staff plans to cover include: • Fundamental planning topics such as the General Plan and Specific Plans, zoning and land use, and the California Environmental Quality Act (CEQA) • The entitlement process, including: o Types of development projects (residential, retail, industrial, institutional) o Types of applications (ministerial vs. discretionary, development plan reviews, conditional use permits, variances, subdivisions) o Process overview and flowchart o Statutes and case law that govern bias in the entitlement process  • Public Meetings o Types of public meetings (workshops, CEQA-required meetings, public hearings) o Brown Act as it applies to public hearings o Public comments (EIR, during public hearings, etc.) • Roles of the City Council, Planning Commission, City staff, applicants, and the public • Land use decisions and their effects on the community, economic development, and public infrastructure Staff will provide a detailed presentation covering these topics, as well as others that may come up as a result of questions and further refinement on our presentation. After the staff presentation, the public will be invited to ask questions about the process. As mentioned previously, since no applications are on the agenda for discussion, we are prohibited from discussing those applications. After the public asks their questions, members of the City Council and Planning Commission will be given time to ask questions of staff as well as provide their input and insight on the process from their perspective. The City is fortunate to have several members of both the Council and Commission that have been through this process many times, and that experience can provide further context and understanding. The City is committed to educating the public on how the city government operates, and we hope that this workshop is the first of many opportunities to provide insight into what we do.
