Warrants NEW BUSINESS MOTION: SECOND: VOTE: RESOLUTION 23-52 L. Gutierrez City Manager A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALIPATRIA APPROVING THE JOB DESCRIPTION OF THE CITY TREASURER WHEREAS, the City of Calipatria has re-established the position of City Treasurer; and WHEREAS, with the re-established position there needs to be a current job description; THEREFORE, BE IT RESOLVED, that the City Council approved attached job description; 102423AGN 2/5 MOTION: SECOND: VOTE: RESOLUTION 23-53 L. Gutierrez City Manager RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALIPATRIA RELATING TO BILLING FOR SEWER, SOLID WASTE AND STATE AB 939 WHEREAS, Ordinance 17-007 of the City of Calipatria authorizes the establishment of user charges for sewer, and Ordinance 10-001 of the City of Calipatria regulating refuse disposal; and WHEREAS, the City Council is adopting this resolution relating to matters such as due dates, delinquency charges, and discontinuance of service for non-payment with terms set forth herein. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. Billing Date and Due Date: All charges for City of Calipatria (“City”) services (sewer, solid waste, state AB939) will be billed on or near the 1st working day of each month for the previous month’s services (“Billing Date”) and are due on the 15th day of each month (“Due Date”). The customer is responsible for the bill even if the customer does not receive the bill. 2. Delinquent Date and Penalty: The bill becomes delinquent if not paid by close of business on the last working day of the month following the Due Date specified on the bill (“Delinquent Date”). If a bill becomes delinquent, the following penalties will be assessed: a. A basic penalty of ten percent (10%) of each month’s charges for the first month delinquent; and b. A penalty of one-half of one percent (.5%) per month for nonpayment of the charges and basic penalty. 3. Discontinuance of Services: Services are cumulative of all charges (i.e. sewer, sewer/trash, sewer expansion, etc.). Sewer connection may be disconnected when account becomes excessively delinquent at owner’s expense. Cost may be in excess of $5,000. Before services can be restored, total cost of disconnect plus services billed must be paid. 4. All New Accounts: All applications for sewer/trash require a Social Security Number, Federal Identification Number, Valid Driver’s License Number, or Department of Motor Vehicles Identification Number. Owners must provide proof of ownership. Realtors/Property Manager’s must provide proof of listing. Tenants must provide a signed rental/lease agreement or signed authorization form. 5. Connect Fee: A $25.00 connect fee is charged for all new accounts set up after adoption of this Resolution. 6. Deposit: A $50.00 deposit is required for all new accounts set up after adoption of this Resolution. 7. Owner / Property Manager / Realtor / Tenant Account: An owner may authorize an account to be established in the name of the Property Manager / Realtor / Tenant. The owner shall guarantee payment of all bills. All previous charges on account must be paid in full before sewer service is established in the new Property Manager / Realtor / Tenant name. 8. Returned Checks: A fee of $25.00 will be charged for the first returned check and $35.00 for each additional check returned from the bank for any reason for which the bank refused payment. The check is to be replaced in cash or by money order within five (5) calendar days of receiving notice. If the City receives three (3) returned checks within a twelve (12) month period, the City will no longer accept personal/business checks for any City service from that same party for the next twelve (12) month period. 9. Closed Account: An account without payment activity for two (2) consecutive months is subject to termination without further notice. The account holder and/or authorized signer is responsible for all charges accrued, plus Item 3 will apply. 102423AGN 3/5 10. Collections: At the discretion of the City, any balance remaining on a closed account after thirty (30) days will be forwarded to a collection agency or may be submitted to the County for a lien on the property without further notice. 11. Acceptance of Loose Coins and Rolled Coins for Payment of Utility Bill: The City will not accept more than five dollars ($5.00) in unrolled coins as payment. If over five dollars ($5.00), coins must be rolled in coin sleeves. Any payment made in coin to the City will also need to have the customer’s name and account number on each roll before the rolls can be accepted. 12. Drop Box Payments: Payments dropped off after 3:00 pm in Payment Drop Boxes outside of City Hall will be posted the following working day. MOTION: SECOND: VOTE: RESOLUTION 23-54 L. Gutierrez City Manager A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALIPATRIA APPROVING THE FIRST AMENDMENT TO FIRE CHIEF EMPLOYMENT AGREEMENT WHEREAS, the position of Fire Chief initial agreement was approved on August 13, 2019 for fiscal year 2019/2020; and WHEREAS, the Fire Chief needs a current contact with the “City” for fiscal year 2023/2024; and THEREFORE BE IT RESOLVED, the city council of the city of Calipatria approve the amendment; MOTION: SECOND: VOTE: RESOLUTION 23-55 L. Gutierrez City Manager A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALIPATRIA APPROVING THE SECOND AMENDMENT TO POLICE CHIEF EMPLOYMENT AGREEMENT WHEREAS, the position of Police Chief initial agreement was approved on May 11, 2017: and WHEREAS, the Police Chief needs a current contact with the “City” for fiscal year 2023/2024; and THEREFORE BE IT RESOLVED, the city council of the city of Calipatria approve the second amendment for the position of Police Chief; MOTION: SECOND: VOTE: RESOLUTION 23-56 L.
