RECOMMENDATION Adopt resolution. SUMMARY The Centers for Disease Control and Prevention (CDC) has been responding to an outbreak of respiratory disease caused by a novel (new) coronavirus that was first detected in China and which has now been detected in more than 100 locations internationally, including the United States. The virus has been named “SARS-CoV-2” and the disease it causes has been named “coronavirus disease 2019” (COVID-19). Government Code §8630 and Calistoga Municipal Code (CMC) §2.18.050 designates the City Manager as the Director of Emergency Services and CMC §2.18.060 empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency. City Manager Michael Kirn, acting in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency due to the conditions of extreme peril to the safety of persons and property within the City caused by COVID-19 (Exhibit A to Attachment 1). CMC §2.18.060 further requires the Council to take action to Page 5 of 16 ratify the proclamation within seven days thereafter or the proclamation shall have no further force or effect. The public can access up-to-date information about COVID-19 directly from the CDC at cdc.gov/coronavirus. The CDC’s website contains information about the risks and what a person should do if they feel sick, as well as answering common questions about COVID-19. The public can also obtain more localized information by accessing the County of Napa website at countyofnapa.org/coronavirus. The spread of COVID-19 across the world has resulted in the following emergency response actions: 1/30/2020 The World Health Organization (WHO) declared the outbreak a “public health emergency of international concern” 1/31/2020 The Health and Human Services Secretary declared a Public Health Emergency for the United States 3/4/2020 The Governor of the State of California declared a State of Emergency 3/11/2020 The WHO publicly characterized COVID-19 as a pandemic 3/12/2020 The Napa County Health Officer declared a Local Health Emergency 3/13/2020 The President of the United States declared a National Emergency 3/18/2020 The Napa County Health Officer issued a Shelter at Home Order restricting activities to only those defined as essential through 11:59 PM April 7, 2020 Consistent with these actions, City Manager Michael Kirn, acting in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency due to the conditions of extreme peril to the safety of persons and property within the City caused by COVID-19 (Exhibit A to Attachment 1). Government Code §8630 and Calistoga Municipal Code (CMC) §2.18.050 designates the City Manager as the Director of Emergency Services and CMC §2.18.060 empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency. Pursuant to CMC §2.18.060, staff requests the City Council ratify the City Manager’s Proclamation of Local Emergency thereby positioning the City to work with federal, state, and local partners to respond to the threat posed by COVID-19 and to protect the people and the property of Calistoga from the threat of extreme peril caused by this global pandemic. ANALYSIS The United States of America has confirmed cases of individuals who have a severe acute respiratory illness caused by COVID-19. The WHO has reported that sustained human-to-human transmission of COVID-19 is occurring, and transmission from asymptomatic individuals has been documented and suspected community transmission of the virus is occurring in the United States. Although the majority of individuals infected with COVID-19 recover from the disease without special treatment, there is significant potential for serious infection and death. The WHO declared the COVID-19 outbreak a public health emergency of international concern on January 30, 2020 and made an assessment on March 11, 2020 that COVID-19 can be characterized as a pandemic. The CDC has determined that the virus presents a serious public health threat, requiring coordination among state and local health departments to ensure readiness for potential health threats associated with the virus. The CDC has issued guidelines to local and state health departments, including the Napa County Health and Human Services Agency (HHSA), concerning risk assessment and public health management of persons with potential exposure to COVID-19. These guidelines require HHSA to make extraordinary efforts to monitor ongoing communicable disease threats and prepare for management of individuals who may have been exposed to COVID-19. HHSA, the Office of Emergency Services (OES), and other County partners (including the City of Napa) have been working diligently to implement the CDC guidelines, but now require additional tools and resources to protect the public health given the current state of the epidemic and the need for sustained response. According to the World Health Organization COVID-19 Situation Report No. 58, published March 18, 2020, 191,127 cases have been confirmed globally, tragically resulting in 7,807 deaths 1. As of March 18, 2020, the CDC reports 7,038 confirmed cases of COVID-19 in the United States 2. And as of March 17, 2020, the California Department of Public Health reported 598 positive cases and 13 deaths in California 3. The number of confirmed cases has continued to escalate dramatically over a short period of time. 1 https://www.who.int/emergencies/diseases/novel-coronavirus-2019/situation-reports/ 2 https://www.cdc.gov/coronavirus/2019-ncov/cases-updates/cases-in-us.html#investigation 3 https://www.cdph.ca.gov/Programs/CID/DCDC/Pages/Immunization/ncov2019.aspx Page 7 of 16 In order to address the global COVID-19 outbreak, Governor Gavin Newsom declared a State of Emergency to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare for broader spread of COVID-19 following one official COVID-19 death. The Napa County Health Officer declared a local health emergency as a result of the imminent and proximate threat to public health from the potential introduction of COVID-19 in Napa County, and subsequently issued a Shelter at Home order. A local emergency exists due to the conditions of extreme peril to the safety of persons and property within the City caused by COVID-19 and the conditions are likely to be beyond the control of the services, personnel, equipment, and facilities of the City, requiring the combined forces of other political subdivisions to combat. Therefore, staff requests the City Council adopt the resolution ratifying the City Manager’s proclamation, whereby requesting the Governor of the State of California include the City of Calistoga in any emergency declaration by the State, ensure the City of Calistoga is included in any emergency declaration by the President of the United States of America, waive regulations that may hinder response and recovery efforts, and make available California Disaster Act and State Private Nonprofit Organizations Assistance Program funding and any other FINANCIAL IMPACT None by this action; however, adoption of this resolution will facilitate the ability for the City to request resources including financial support and reimbursement from the State Office of Emergency Services (OES) and Federal Emergency Management Agency (FEMA) for costs incurred in preparation and/or response to the COVID-19 outbreak. CEQA REVIEW The recommended action is exempt from CEQA pursuant to CEQA Guidelines Section 15269 related to actions to prevent or mitigate an emergency, and also under the common sense exemption, in that CEQA only applies to projects that have a potential to cause a significant effect on the environment, and the acknowledgement of the existence conditions constituting a local emergency has no such potential. CONSISTENCY WITH CITY COUNCIL GOALS AND OBJECTIVES This action is consistent with City Council Goal 7 to enhance Calistoga’s small-town character by making it safe and attractive. ALTERNATIVES The City Council could determine that there is no emergency and not adopt the resolution. There would be no opportunity for the City to seek reimbursement for expenses incurred during the emergency response. ATTACHMENT 1. Draft Resolution Page 8 of 16  ATTACHMENT 1 RESOLUTION NO. 2020-XXX RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALISTOGA, COUNTY OF NAPA, STATE OF CALIFORNIA, RATIFYING THE PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY BY THE CITY MANAGER IN HIS CAPACITY AS DIRECTOR OF EMERGENCY SERVICES RELATING TO THE THREAT TO PUBLIC HEALTH POSED BY COVID-19 WHEREAS, international, national, state, and local health and governmental authorities have been and are responding to an outbreak of respiratory disease caused by a novel coronavirus named “SARSCoV-2,” and the disease it causes has been named “coronavirus disease 2019,” abbreviated COVID-19; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within the City caused by the threat of COVID-19 that will impact significant City and community operations, including critical public infrastructure and services, and which will require the provision of additional public safety and emergency services; and WHEREAS, the aforesaid conditions of extreme peril warrant and necessitate the proclamation of a Local Emergency to enable the City and other local government entities to adequately plan, prepare and preposition resources to be able to effectively respond to the threat posed by COVID-19, and to warn residents and visitors of the threat posed by COVID-19 and to enable them sufficient time to plan and prepare; and WHEREAS, Calistoga Municipal Code (CMC) §2.18.050 designates the City Manager as Director of Emergency Services and CMC §2.18.060 empowers the Director of Emergency Services to proclaim the existence of a local emergency when the City Council is not in session; and WHEREAS, on March 16, 2020 the City Manager, in his capacity as Director of Emergency Services, proclaimed the existence of local emergency in the City of Calistoga; and WHEREAS, CMC §2.18.060 states that the City Council shall take action to ratify the proclamation of the Director of Emergency Services within seven days thereafter or the proclamation shall have no further force or effect. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CALISTOGA DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. RECOMMENDATION: Receive the report and provide direction to staff on service level deliveries, programs and core services. BACKGROUND: The City has been responding to the COVID-19 Pandemic and is working closely with Napa County. A summary of the recent events includes the following: The World Health Organization (WHO) declared the outbreak a “public 1/30/2020 health emergency of international concern” The Health and Human Services Secretary declared a Public Health 1/31/2020 Emergency for the United States The Governor of the State of California, Gavin Newsom, declared a State 3/4/2020 of Emergency Page 15 of 16  The WHO publicly characterized COVID-19 as a pandemic 3/11/2020 The Napa County Health Officer declared a Local Health Emergency 3/12/2020 The President of the United States declared a National Emergency 3/13/2020 The City of Calistoga declared a state of local emergency 3/16/2020 The Napa County Health Officer issued a Shelter at Home Order 3/18/2020 restricting activities to only those defined as essential through 11:59 PM April 7, 2020 The effect of these declarations and orders presents a substantial financial impact to the City. The order limits business operations to only those defined as essential and requires the closure of bars, tasting rooms and limits restaurants to take-out or delivery only. As result many of the resorts, spas and hotels have completely closed and it is unknown when they will resume normal operations. The resultant loss of TOT (transient occupancy tax) and sales tax will affect projected revenues, but at this time the financial impact is unknown. The Shelter at Home Order also mandates that only essential meetings occur through 11:59 PM, April; 7, 2020. The next regular Planning Commission meeting is April 8, 2020 and is tentatively scheduled to be held; however, the April 7, 2020 City Council meeting may need to be rescheduled because it falls within the Order’s restrictions unless there is a matter of urgency that requires Council action. Staff is seeking direction from Council on service level deliveries, programs and core services. CEQA REVIEW: The recommended direction is exempt from CEQA pursuant to CEQA Guidelines Section 15269 related to actions to prevent or mitigate an emergency, and also under the common sense exemption, in that CEQA only applies to projects that have a potential to cause a significant effect on the environment, and the acknowledgement of the existence conditions constituting a local emergency has no such potential. CONSISTENCY WITH CITY COUNCIL GOALS AND OBJECTIVES: This action is consistent with City Council Goal 1 to maintain and enhance the economic vitality of the community and the financial stability of the City.
