SUMMARY: At the September 15, 2020 Council meeting the City Council accepted a Proclamation recognizing Napa Valley Latino Heritage Month through October 15, 2020. This is celebrated annually on September 15th through October 15th valley-wide with proclamations and many activities under the County Health Director’s requirements for reduction of Covid19 cases. These observances coincide with the long-standing civic and cultural tradition of National Hispanic Month. BACKGROUND: At the September 15th meeting Councilmember Lopez-Ortega requested the Flag of Mexico be displayed on the City’s Ceremonial Flag Pole. Council policy requires that a majority of the Council support displaying the displaying any ceremonial flag on the City’s Ceremonial Pole as agenized on the City Council Agenda . Staff is seeking Council approval, by motion, to display the Flag of Mexico on the City of Calistoga’s Ceremonial Flag Pole from September 23, 2020 to October 15, 2020 in honor of Napa Valley Latino Heritage Month. Southern California fires kept us busy but we are fine now. Displaying the Mexican flag per agenda #1 is not a good idea. Hispanic Heritage month involves far more countries than just Mexico. In fact the time frame in agenda #1 takes this into account as it is the period Latin American countries became independent from Spain. Logically, either all or no flags should be displayed. Thank you, Dom Tallerico Page 7 of 21 Page 8 of 21 CITY OF CALISTOGA STAFF REPORT TO: Honorable Mayor and City Council FROM: Derek Rayner, Public Works Director/City Engineer DATE: September 22, 2020 SUBJECT: Consideration approving the installation of four temporary Parklets on Lincoln Avenue due to the Covid-19 Pandemic Approved by Michael Kirn, City Manager DESCRIPTION: Consideration approving the installation of four temporary Parklets on Lincoln Avenue due to the Covid-19 Pandemic RECOMMENDATION: By motion and roll call vote approve the recommended action SUMMARY: As a result of the COVID-19 Pandemic there is a significant public health and community need to provide additional outdoor seating and physical distancing along the Lincoln Avenue corridor. Due to the high concentration of businesses and pedestrian traffic, it is in the best interest of public safety that additional public space be created on the Lincoln Avenue corridor. BACKGROUND: Staff has submitted and received approval from Caltrans to install four parklets along Lincoln Avenue as shown in Attachments 1 and 2. Caltrans requires that the parklets be protected by either by a concrete or water filled barrier. Staff has identified water filled barriers as the best approach due to the fact that they can be repurposed for other events like the Harvest Table, parades, and road closures that we can “rent back” to event sponsors. This should enable the City to recover the purchase costs on over a 3-4 year window. The proposed parklets will be approximately 8'x40' minimum and 8'x80' maximum consisting of water filled barricades on three sides with ADA accessible ramps. Any additional ADA accommodations with be the responsibility of the adjacent business as necessary. Page 9 of 21 The estimated cost to purchase the water filled barriers is $21,000 with an associated cost to fabricate and install the ADA ramps of $7,000. It is important to note that parklets are for generic public use and not specific to any business. Any furniture, lighting, or decorations inside the parklets, along with cleaning, would be up to the individual users. The City would perform nominal cleaning consistent with our street and sidewalk maintenance program. FINANCIAL IMPACT: The FY 20/21 Budget contains Pavement Maintenance; Account No. 01-5402-4905-4915 to fund the recommended expenditure. CEQA REVIEW: The project is exempt from California Environmental Quality Act Construction of the parklet would involve a minor alteration to an existing parking area and is not an expansion of existing services. As such, from the provisions of the pursuant to California Code of Regulations Title 14, Chapter 3, Section 15301(e). CONSISTENCY WITH CITY COUNCIL GOALS AND OBJECTIVES: Construction ofthe parklets would further the FY 20-21 City Council’s goal of maintaining and enhancing the economic vitality of the community (Goal 1) and its objective of promoting the qualities of Calistoga that are attractive to residents and visitors (Goal 1, Objective 2). Advertising in any form is prohibited on State Highway System right-of-way by Code of Federal Regulations Title 23, Part 750 and California Business & Professions Code 5403. Temporary public seating in the parking areas must fully comply with parklets design guidance available in Section 500.3I of the Encroachment Permit Manual. This permit authorizes posting “No Parking” signs prohibiting curb side parking in existing curb side parking spaces. Necessary signs or other temporary traffic control devices in accordance with CA-MUTCD can be placed to enable curbside pickup for business along the highways and within limits listed above. The permittee is responsible for ensuring the curbside pickup activities do not impact the safety or operations on the State Highway System. No temporary or fixed objects (Tables etc.) can be placed on sidewalk along parking spaces designated to assist or serve curbside pickup activities. Public seating area must include signage designating the area for use by the general public and not reserved for any patrons of the adjacent businesses or specific business. • Vending, sales, transactions, table service, and similar activities in the public seating area are strictly prohibited. No portion of a transaction may take place within the State Highway System right-of-way. For example, the public may purchase takeout/ “to-go” food at a business and use the public seating area to consume the food, but the business may not conduct the sale of the food or accept payment for the food while in the public seating area. • Public seating area may include temporary benches, tables, chairs or other seating, bike racks, and planting areas, but must not include any fixed object. Temporary tables and seating must be distinct from those of nearby businesses and must not include the same or similar color scheme, marking, logo, symbol, or any other identifier of any particular business. • All installations must be heavy enough, or other measures be implemented, to ensure they do not move onto the travel lanes, highway users, or business properties, or obstruct the minimum required accessible path of travel on the sidewalk. • Public seating area must be installed to conform with the Americans with Disabilities Act Accessibility Guidelines (available at https://www.access-board.gov/guidelines-and-standards/buildings-and-sites/about-the-ada- standards/ada-standards). • Public seating area may include a sign identifying the local public entity permittee. All forms of advertising are prohibited in the public seating area and in the curbside pickup area. • The permittee must ensure that no fee is being charged for the use of the public seating area or the curbside pickup area. • Public seating area must be properly maintained and kept free of trash or nuisance. • Following sign, large and legible enough to read easily by users, must be posted at the public seating areas: “Consumption of Alcohol is Prohibited.” Closure of travel lanes is prohibited. One-way traffic control is permitted between 9:00 AM to 3:00 PM, Monday through Friday. Close one traffic lane and stop traffic for periods no more than 5 minutes. The permittee is solely responsible for compliance with the Americans with Disabilities Act (ADA). Adequate clearance in accordance with Caltrans Design Information Bulletin 82 (DIB 82) must be maintained through the sidewalk to serve pedestrians. DIB 82 can be accessed at https://dot.ca.gov/-/media/dot- media/programs/design/documents/dib82-06-a11y.pdf. The encroachments on State Highway System right-of-way must not negatively impact the safety of highway users, including but not limited to motorists, bicyclists, and pedestrians, and any person legally using the State Highway System right-of-way. The encroachments must not negatively impact highway operations or maintenance of State Highway System right-of-way. The permittee must ensure all objects placed in connection with the authorized activities do not create a tripping hazard or other hazard to any person or property. Page 7 of 9 Page 15 of 21 City of Calistoga 04-20-N-MC-2113 September 17, 2020 Page 4 of 5 The permittee must not construct nor place on the State Highway System right-of-way any improvement which would impair Caltrans' ability to maintain, operate, use, repair, or improve any part of the transportation facility in State Highway System right-of-way. The permittee is responsible for promptly removing, at its sole cost and expense, any improvement which Caltrans identifies as a hazard to or impairment of a transportation facility. The permittee must treat all businesses equally and any measures implemented by or on behalf of the permittee on State Highway System must be fair and serve all businesses equally. The permittee must handle and resolve any and all complaints. The permittee may not attach anything to the travel way or highway facilities/structures (signs, etc.) by bolt, screw or any other invasive connection type. No signs are allowed to be posted on any State-owned warning guide or regulatory sign posts. The permittee is responsible for removing all location signs posted within the State right of way. Caltrans may revoke the permit at any time, for any or no reason. Common reason for revocation would be violation of the terms of this permit, operational needs, or safety issues. The permittee must not hook-up or connect into any Caltrans owned utilities. The permittee is expected to independently procure needed utility services and infrastructure like necessary temporary lighting fixtures, etc. The permitted lighting fixtures, mirrors, reflectors, and supports must not present a glare or other safety hazard. The permittee must assign a liaison to coordinate and oversee the authorized activities under this permit. The liaison must always be available to address any and all issues/requests associated with the permit. The permittee is solely responsible for the objects (i.e., canopies, tables, chairs, benches etc.) and securing all object installations. The permittee and its agents, employees, representatives, and contractors must be solely responsible for installing, operating, and maintaining the temporary installations authorized by the permit. The permittee and its agents, employees, representatives, and contractors must ensure that the objects placed within State Highway System right-of- way are properly serviced, maintained, and repaired. Any traffic control required must receive prior approval from the State Representative. If Caltrans standard traffic control plans are not adaptable for the required traffic control needs, site-specific traffic control plans stamped and signed by a California Licensed Engineer must be submitted along with a rider permit request, for review and approval prior to using such site-specific traffic control plans. Standard plans may be referenced and are available at https://dot.ca.gov/programs/design/ccs-standard-plans-and-standard-specifications. All traffic control devices (signs, flagging, flags, PCMSs and other devices) must conform to the requirements set forth in the latest California Manual on Uniform Traffic Control Devices (CA-MUTCD) and Caltrans Standard Plans and Specifications. The permittee must monitor and maintain all traffic control devices for the entire duration of this permit. At least one person must be assigned by the permittee to provide full-time maintenance of traffic control devices. No excavation or ground disturbance is allowed. All installations allowed must be above ground installations only. The permittee must not attach nor temporarily affix any item on Caltrans facilities or infrastructure, unless otherwise expressly allowed in this permit. The permittee must restore the State Highway System right-of-way to pre-existing condition, which includes the pickup, removal, and disposal of all litter, materials, and other items related to the permittee’s activities to Caltrans’ satisfaction. Dear Sirs, I support the proposed Parklets on Lincoln Ave. Parking is not congested during the pandemic and I am very supportive of outdoor options for our restaurants in town. Further, they will offer a safer use of the sidewalk for residents and visitors alike. Many other towns in Napa and Sonoma have experimented successfully with “parklets” without notable problems. City council special meeting September 22, 2020 Item G: General Government Consideration of an approval the installation of four temporary parklets on Lincoln Avenue (Hwy 29) and authorizing an expenditure of $28,000 from the Pavement Maintenance CIP Budget Dear Honorable Mayer and Council Members, Because public attendance is now prohibited at council meetings, I submit these questions for answers regarding the addition of 4 parklets on Lincoln Avenue. I am neutral on the parklet idea, I just needed clarification on some details. 1. Added cost per parklet? Will there be city garbage cans for each parklet? 2. How will diverted funds be replaced? Donna Higgins 3.) Dear Calistoga Council Members, Page 19 of 21 I'm in favor of the parklets in concept and believe $28,000 is a fair price for the potential benefit. I'm confused as to how they will work if for shared by both businesses (restaurants & tasting rooms I presume?) and the general public at large. How will they be shared? I believe some formal 'guidelines' are necessary and should be well spelled out and agreed upon before they're installed. I'm concerned how they will look? Water-filled barriers - are these like what you see on a freeway protecting a buttress? Plastic? What color(s)? They need to be appealing. I suppose this has to do with getting permission/approval from Cal Trans since Lincoln Ave is a state hwy. I also believe that those that most benefit from them (specific businesses) should have a stake in them, i.e. skin in the game, responsibility to maintain them to some prescribed standards, responsibilities since these are a 'gift' to the community and visitors alike that may help ease the pain of covid. I also believe that they should be considered/studied so that if found to be truly beneficial they could become permanent fixtures to enhance our Downtown. We appreciate the City’s creative efforts to increase access opportunities for residents and visitors alike to enjoy the downtown area during this very challenging time for all of us. We feel the installation will be welcomed by most residents as a reasonable measure to support our local businesses, including some of our “land locked” restaurants, while helping to establish a safe environment for everyone to meet and enjoy a bit of socialization. We strongly feel the very small amount of street parking that would be temporarily unavailable is a very fair tradeoff for the added convenience of useable space for all to access. Very frankly, from our vantage point on the corner of Lincoln and Washington, we have yet to see the main and side streets filled with Page 20 of 21 cars, let alone our public parking lots, since this past February, so our sense is there’s no undue burden for drivers. Let’s not forget to stress the temporary nature of the parklets. No one is committing the City to these as permanent fixtures. September 22, 2020 Subject: Proposed Parklets Based on what the City has made available for viewing, there are many questions surrounding the proposed ‘parklets' along Lincoln that are not obviously answered. I will address only a few. I understand these are temporary. I am wondering about the design of these ‘parklets.’ We were told by Council, when the first ‘parklet' on Washington Street was erected it remained a work in progress in that there were to be additions ‘soon’… like plantings to make it more visually pleasant. That never occurred. And the barriers protecting it from damage from outside forces (automobiles?) are extremely unattractive. Personally, the overall design of that ‘structure’ leaves a lot to be desired. If the city plans to go ahead with these ‘parklets,’ I would hope the council looks at the project with an artful eye. The design should reflect Calistoga and not something pulled from some other city or some other county or state. Next, from the Staff Report: “It is important to note that parklets are for generic public use and not specific to any business. Any furniture, lighting, or decorations inside the parklets, along with cleaning, would be up to the individual users. The City would perform nominal cleaning consistent with our street and sidewalk maintenance program.” “Individual users?” Does this refer to the business owners or the public utilizing the ‘parklet?’ Probably it means (although not specifically defined) the business owners when it comes to ‘outfitting’ the ‘parklet' with tables, chairs, etc. And what responsibility, as a business owner, should one feel about supplying those items. BUT, cleaning? I come from down the street at the bakery where I bought my food, walked down the street and decided to sit in a ‘parklet' proximity unrelated to the bakery. I sit down at one of these ‘parklets’ and enjoy a meal or a cup of coffee and a pastry and whoops…. spilled my coffee and slopped part of my meal on the table. I get up and walk away. Who is to clean up my mess? And, have you surveyed ALL of the businesses along Washington Street, regarding their yea or nay for this project. If I own the Mad Mod Shop, or Copperfield Books, or the like and I am losing parking for my customers for the benefit of restaurants? What about businesses such as those? The ‘parlket’ on Washington Street is NOT without litter. To say that business owners are responsible for the day to day maintenance is not appropriate especially since each of these units are not the responsibility of any one business. Coved19 regulations: Who is responsible for things like disinfectant or refuse containers? Who is responsible for the cleaning of tables and chairs when one party exits and another sits? My feeling is that there are things that are NOT being addressed ~ at least as far as the ‘public eye’ is concerned. I do NOT think this is a project ready for a stamp of approval. I think the Council needs to exercise more caution, overview/oversight and consideration prior to moving forward.
