Comments received by 9 a.m. on the day of the meeting will be posted online with the agenda packet and included in the record but will not be read aloud. If a comment is received after the agenda item is heard but before the close of the meeting, the comment will still be included as a part of the record of the meeting but will not be read aloud. Pursuant to Government Code section 54954.3 (the Brown Act), however, the Council cannot consider any issues or take action on any requests during this comment period. Dear council members, I would like to once again highlight the following section of the Civic Operating Agreement to be revised and accurately reflect the city's current Municipal Code: 10.3 Relations with Staff As required by CMC 2.08.080, Councilmembers of the City Council shall deal with employees of the City only through the City Manager, except otherwise permitted by the City Manager. The City Manager shall take her/his orders and instructions from the Council as a body only when the Council is sitting in a duly convened meeting, and no individual Councilmember shall give any orders or instructions to the City Manager outside of a City Council meeting, without approval of the City Council. Neither the Council as a whole, nor an individual Councilmember, shall give orders or instructions to subordinates of the City Manager. Several months ago I requested an amendment to the above section of the Civic Operating Agreement, as it did not accurately reflect Calistoga's Municipal Code. It seems it has yet to be revised, and I would like to make the following suggestions and clarifications: "As required by CMC 2.08.080, Councilmembers of the City Council shall deal with employees of the City only through the City Manager, except otherwise permitted by the City Manager." CMC 2.08.080 of the "City Manager" section still does not exist. Please delete this line, or proceed with the ordinance adoption process to make this code. "The City Manager shall take her/his orders and instructions from the Council as a body only when the Council is sitting in a duly convened meeting, and no individual Councilmember shall give any orders or instructions to the City Manager outside of a City Council meeting, without approval of the City Council." Please site section CMC 2.08.050 Administrative Relations for this line. This is already expressly stated in this section of the Calistoga Municipal Code. "Neither the Council as a whole, nor an individual Councilmember, shall give orders or instructions to subordinates of the City Manager." Please site section CMC 2.04.060 Administrative Relations for this line. This is already expressly stated in this section of the Calistoga Municipal Code. It's unclear why only some lines were selected from Title 2 to make up "Relations with Staff" in the Civic Operating Agreement, and it's important to note that currently "CMC 2.08.080" is not actually code. Please ensure you're doing your due diligence when reviewing. City Council Members, I ask you all to recognize that the public has not received adequate notification for this meeting. It may fit the parameters for notice for a "Special Meeting"; but it is not reasonable time for residents to review the pages and pages of documentation being presented and to then present their thoughts on all of the matters before you. Even if you were only going to discuss among you at this meeting all of these issues, notice to the public is not adequate for their input. This does not meet the promises of open dialogue with the residents that I believe was part of each of your campaigns. I ask that you do not take any action at all on any of these issues on the 26th. I am disappointed and feel that the public has not been given adequate time to go over the agenda and then form a intelligent response, and send that back to the city. This is especially poignant because of the last city council meeting where a councilperson spoke up that the public needs adequate time for their input. I'm hoping tomorrow that I get to speak out loud on each one of these numbered items you are considering. I also noticed there is no way to watch this meeting via Zoom or YouTube. The council has been very vocal on expressing their wishes to have public input and participation yet with the reduction of council meetings and now this less than 24-hour notice of a special workshop, it seems the opposite is happening. Hopefully tomorrow I can get an explanation why there seems to be an effort to discourage public participation.
