City Council Proceedings
The Canistota City Council met Monday, July 1, 2024 at 6:00 PM in the Canistota City Hall Community Room.
City Council Members present: Mayor Justin Lee Engbarth, Jamie Miller, Jerry Bertelsen and Matt Anderson.
Donovon O’Donnell was absent. Others present: Maintenance Supervisor, Darin Nugteren, Maintenance
Assistant Brandon Dolejsi, Finance Officer Kathy J. Townsend; SEFP Facilitator, Nicole Webster, Fire
Department Representative, Dave Miller, City Engineer, Kyle Sokulski, Karmon Hoiten arrived at 6:43 PM,
Sheriff Deputy Troy Rempfer arrived at 6:58 PM along with Deputy Trainee, Todd Obele.
Mayor Engbarth called the meeting to order at 6:00 PM and led the Pledge of Allegiance.
Bertelson motioned, second by Miller to approve the agenda as presented, all voted yes, the motion carried.
D. Miller motioned, second by Anderson to approve the proceedings from the July meetings as presented, all voted
yes, the motion carried.
Miller presented the report for the Canistota Volunteer Fire Department, they responded to five rescue calls with no
fire calls. The department had ordered new gear which has arrived. The report was approved as presented on a
motion by Bertelson, second by Anderson, all voted yes, the motion carried. Miller left the meeting at 6:08 PM
Snyder & Associates engineer, Kyle Sokulski updated the Council on progress in the Phase 3 Improvement
Project. Yards have been sprayed for weeds, tilled, with grass planted. A letter was presented to Sokulski from a
resident in the affected area informing both the city and the engineer of his dissatisfaction with the quality of dirt
and the reseeding of his yard. Sokulski will follow up with the resident. A final walk through of the project will
be conducted in early July. A drainage issue at 6th and Pine still needs to be addressed by the engineer and
contractor. Sokulski reached out to H & W Contracting with no response received before the Monday night
Council meeting. Nugteren completed his walk through of the project area. He submitted his list of repairs which
will be addressed by the engineer and contractor. A drainage issue at the school was also discussed.
Nugteren & Dolejsi presented the Planning and Zoning Report: two building permits were issued during the month
of June. There were several calls for utility locates along with questions involving setbacks and zoning regulations.
A commercial business operating in a residentially zoned area was discussed with Zoning Administrator, Nugteren,
looking into the matter further. The report was approved on a motion by Bertelson, second by Miller, all voted yes,
the motion carried.
The Canistota Development Corporation did not meet in June.
Mayor Engbarth introduced SEFP Facilitator Nicole Webster. Webster spoke about her background and passion
for helping people succeed in her journey to Enterprise Facilitator. SEFP received seventy-six inquiries in 2023
with 26% coming from the Canistota community. Triple Play Campground is celebrating a ten-year anniversary
doing business in Canistota. Webster is working with three clients in the Canistota area at this time. Webster has
her office in Marion and can be reached at 605-648-2909
Webster and Sokulski left the meeting at 6:28 PM.
Nugteren and Dolejsi presented the Maintenance report for June: A homeowner requested assistance for a skunk
caught in a trap, the Sioux Falls Humane Society was called to assist. A refrigerator and microwave have been
purchased for the kitchen in the picnic shelter at Stalting Park. The picnic shelter is open every day 8 AM to 8:30
PM. The damaged gate at the rubble site has been replaced. The wheel loader will be taken to Sioux Falls for a
comprehensive inspection before the warranty expires. Information on an extended warranty will be considered at
the August meeting. Nugteren presented a bid from Pfeifer Implement on a package price for attachments for the
Bobcat 100 mini track loader. The package price is $24,413.20 and includes: 40-inch tiller, post hole auger, an
angle broom, a snow blower and a 54-inch utility plow blade. Anderson motioned to purchase the attachments
with Bertelson supporting the motion, all voted yes, the motion carried. The two generators for the maintenance
shop and City Hall have arrived and will be installed within the next week. Dolejsi has sprayed for mosquitos three
time in June. Progress on repairs at the baby pool are slow because of the rainy weather. Due to the flood/water
damage in McCook County from the recent heavy rains, chip sealing may not happen this year. Participation in the
Mandatory Lead Pipe Survey for the State of South Dakota is still very low. Drainage issues that occurred during
the recent heavy rains were discussed with Nugteren getting more information on a proposed solution to present to
the Council in August. The maintenance report was approved on a motion by Miller, second by Anderson, all
voted yes, the motion carried.
Sheriff Deputy Rempfer and Deputy trainee Obele met with the Council. The Sheriff’s office has one person
training at the academy at the present time with Obele attending the academy in November. The training lasts from
six to eight weeks. The Sheriff’s office is not fully staffed with deputies at this time. The report was approved as
presented on a motion by Bertelson, second by Miller, all voted yes, the motion carried. Rempfer and Obele left
the meeting at 7:13 PM
Under Citizen Concerns, Hoiten visited with the Council about a “Good Neighbor Program” to promote
neighborhoods by providing guidance, tools and man power to a resident that may not have the financial means to
maintain their property. The Mayor and Council are in support of her program. On the advisement of the City
Attorney, the City cannot assume ownership or house such an enterprise for insurance and liability purposes.
Council person, Anderson, feels this could be a good fit for the Canistota Development Corporation to implement
with Hoiten and volunteers. Hoiten will be exploring grant and other financial avenues to assist with funding the
program. Hoiten left the meeting at 7:40 PM
Bertelson motioned, second by Miller to approve the following bills for payment to avoid late fees and penalties,
including: Golden West, Menards, North Western Energy, New Century Press, US Bank Card and Xcel Energy
that were not received in time to include for payment at the July 1 meeting: all voted yes, the motion carried.

Townsend presented the Finance Officer’s report: Delinquent utility bills were discussed. The biennial audit for
the city will be conducted the week of July 15th. The FO report was approved as presented on a motion by Miller,
second by Bertelson, all voted yes, the motion was approved.
Council Concerns:
Mayor Engbarth: The second reading of Ordinance 2024-06, Supplement 2024 Budget was held and on a motion
by Miller, second by Bertelson, the Ordinance was approved: Bertelson, Yes, Miller, Yes, and Anderson Yes,
O’Donnell was absent, the motion carried. The Ordinance is printed elsewhere in this edition of The Special.
The first reading of Ordinance 2024-07, Nuisance Fire Alarm Calls was acknowledged. The contract with Sanford
Physicians for the use of the Medical Clinic was discussed. Regular hours will be observed at the pool for the 4th
of July Holiday, 1 PM to 5 PM and 6 to 8 PM.
Miller had no concerns
Bertelson had no concerns
Anderson discussed: Mowing around signs and hydrants located on private property. Anderson also inquired
about the spraying of weeds before Sport Days, especially on Main Street.
There was no need for executive session.
At 8:25 PM, Miller motioned to adjourn, second by Anderson, all voted yes, the motion carried.
The next meeting of the Canistota City Council will be held on Monday, August 5, 2024 at 6 PM in the
Community Room of City Hall. All are welcome and encouraged to attend.
