City Council Proceedings The Canistota City Council met Monday, November 4, 2024 at 6:00 PM in the Canistota City Hall Community Room. City Council Members present: Mayor Justin Lee Engbarth, Jamie Miller, Matt Anderson, and Donovan O’Donnell. Jerry Bertelson arrived at 6:10 PM. Others present: Maintenance Supervisor, Darin Nugteren, Maintenance Assistant, Brandon Dolejsi, Finance Officer, Kathy J. Townsend, Fire Department Chief, Adam Richarz, and Marie Chandler. Sheriff’s Deputy Troy Rempfer arrived at 6:35P Mayor Engbarth called the meeting to order at 6:00 PM and led the Pledge of Allegiance. Miller motioned to amend and approve the agenda to include action on the 2025 contract with the Sioux Falls Humane Society, second by O’Donnell, all voted yes, the motion carried. Miller motioned, second by Anderson approve the proceedings from the last regular meeting as presented, all voted yes, the motion carried. The written report received from the Sheriff’s office was reviewed. The FO requested a visit from the Sheriff or his Deputy to attend a Council meeting this quarter. The written report was approved on a motion by O’Donnell second by Miller, all voted yes, the motion carried. Richarz presented the report for the Canistota Volunteer Fire Department, they responded to two rescue calls with one fire call. The main pump on the tanker needed to be replaced, additional rescue equipment has been purchased The ISO, insurance report, was discussed. The department has no fund raiser planned until the pancake breakfast in the Spring. The report was approved on a motion by O’Donnell, second by Anderson was approved, all voted yes. Richarz left the meeting at 6:08 PM. Nugteren & Dolejsi presented the Planning and Zoning Report, they have fielded questions concerning setbacks and zoning regulations, one building permit was submitted. The Planning and Zoning Commission will hold a public hearing on Monday, November 18th at 6 PM in the Community Room of City Hall to consider a conditional use permit. A letter detailing conditions has been sent to the property owner. Options for a residence on a piece of property along Railway were also discussed. O’Donnell motioned, second by Miller to approve the report, all voted yes, the motion carried. Anderson and Nugteren updated the Council on the CDC: Canistota Development Corporation met Thursday, October 31st at City Hall. Discussion included utilizing the Travel SD Grant Funds for effectively marketing the City of Canistota; two members will be attending a housing workshop, projects to enhance the pool or green spaces were also discussed. The next meeting of the CDC will be held on November 21st. Bertelson, supported by Miller moved to accept the report as presented, all voted yes, the motion carried. The Sioux Falls Humane Society’s Animal Control Services and Impoundment Facility Operation Agreement for 2025 was discussed and approved on a motion by Miller, second by O’Donnell, all voted yes, the motion carried. No response was received by Mayor Engbarth or Nugteren from Snyder Associates to attend the meeting. Citizen Concerns: Marie Chandler was present to express her concern for work still not completed on her property, including dirt and gravel repairs from the Phase 3 Improvement Project. Nugteren will look into her areas of concern. Chandler left the meeting at 6:30 PM The Council visited with Deputy Rempfer concerning tickets issued with the Deputy providing clarification. The deputy also indicated there are no major concerns about happenings in Canistota. Deputy Rempfer left the meeting at 6:43 PM Nugteren and Dolejsi presented the Maintenance report for October: Calls concerning dogs running at large were received. The grant reimbursement from the State for the two generators has been initiated. Nugteren has begun the process of updating and reviewing equipment rates and fees. A design updating the welcome sign on the south side of Canistota was reviewed along with placement of welcome signs on the east and west side of Canistota. Nugteren has requested quotes, with one received thus far. He will bring cost estimates, including the option for back-lighting to the December meeting. A new bladder for the ice-skating rink has been ordered. Concrete projects have been completed, including the pool deck around the baby pool. The sidewalk at the pool house also received new panels, Permanent corn hole concrete boards have been installed at Stalting Park; this project is sponsored by a private donation. An inspection at the rubble site was conducted by the State October 23rd. Dolejsi has been applying the required enzymes at the lagoon. Trees have been trimmed by the maintenance department to avoid equipment damage during the snow removal season. The maintenance report was approved as presented on a motion by Bertelson, supported by Anderson, all voted yes, the motion carried. Miller motioned, second by O’Donnell to approve the following bills for payment, including a reimbursement to John Hoiten for supplies he purchased: all voted yes, the motion carried. The following bills were approved for payment after the last meeting: AFLAC, Full time Employees, $426.62; October 15, Payroll, $5,308.58; SDRS, Full Time Employees, $1,406.34; Security State Bank, Payroll Taxes, $3,155.64. Delinquent utility accounts were acknowledged in the Finance Officer’s report. City Offices are closed November 11 in observance of Veteran’s Day. Bertelson, supported by O’Donnell motioned to approve the report as presented, the motion carried. Council Concerns: Mayor Engbarth: Miller motioned, second by Anderson to approve Ordinance 2024-10 amending Canistota Zoning Regulations to include: Owner-Occupied Short-Term Rentals, all voted yes, the motion carried. Bertelson motioned, supported by O’Donnell to adopt Ordinance 2024-12, Supplemental Appropriations Ordinance, all voted yes, the motion carried. Resolution 2024-13, Adjusting City Water Rates was approved on a motion by Bertelson, second by O’Donnell, all voted yes, the motion carried. RESOLUTION 2024-13 A RESOLUTION ADJUSTING CITY WATER RATES WHEREAS, THE Canistota City Council believes that it is necessary and in the best interest of the City of Canistota, in order to pay all costs for the operation and maintenance of the water system, to adjust the rates for the sale of water provided by the City of Canistota; and WHEREAS, Section 8.0103 of the Canistota City Ordinances gives the Canistota City Council the authority to establish water rates by Resolution of the Canistota City Council, now, THEREFORE, BE IT RESOLVED by the Canistota City Council that water rates shall be as follows: Effective January 1, 2025, each water customer shall pay a minimum monthly fee of Twenty-Three Dollars and Ninety-five cents ($23.95) plus $0.0069 per gallon water used per month. Townsend, Finance Officer City of Canistota Published: November 14, 2024 Effective: December 4, 2024 Bertelson motioned, second by O’Donnell to approve Resolution 2024-14, Adjusting City Wastewater Rates, all voted yes, the motion carried. RESOLUTION 2024-14 A RESOLUTION ADJUSTING CITY WASTEWATER RATES WHEREAS, the Canistota City Council believes that it is necessary and in the best interest of the City of Canistota, in order to pay all costs for the operation and maintenance of the wastewater system, to adjust the rates for the use of the wastewater system provided by the City of Canistota; and WHEREAS, Section 8.0103 of the Canistota City Ordinances gives the Canistota City Council the authority to establish wastewater rates by Resolution of the Canistota City Council, now THEREFORE, BE IT RESOLVED by the Canistota City Council that wastewater rates shall be as follow: Effective, January 1, 2025, residential users are one class of user and are assessed a minimum monthly fee of Twenty-Six Dollars and Eighty-Eight Cents ($26.88), per month, plus $0.0026 per gallon of water used per month. Non-residential users with BOD and TSS no greater than the average residential user’s strength of 200 ppm BOD and 250 ppm TSS will pay the residential user charge. Townsend Finance Officer, City of Canistota Published: November 14, 2024 Effective Date: December 4, 2024 The contribution requested from McCook County in support of McCook County EMS was discussed and on a motion by Bertelson, second by Miller, contingent upon a one-year contract signed by all parties with final approval by the City Attorney, the contribution will then commence in January, 2025 and end in December, 2025, contingent upon all municipalities agreeing to their portion of the contribution, all voted yes, the motion carried. An inquiry concerning a federal firearm license was discussed. The interested party will be encouraged to attend the December Council meeting. Mayor Engbarth will inform the resident of this request. O’Donnell had no concerns Miller had no concerns Bertelson had no concerns Anderson discussed nuisance properties and deadlines for compliance along with the steps needed to enforce compliance. Also discussed, code enforcement along with sidewalk repairs. Nugteren will address a concern about a business and nuisance violations. Bertelson motioned, supported by O’Donnell to adjourn the meeting at 8:06 PM, all in support and the motion carried. The next regular meeting of the Canistota City Council will be held Monday, December 2 at 6 PM in the Community Room at City Hall. All are welcome and encouraged to attend.
