City Council Proceedings
The Canistota City Council met Wednesday, January 4, 2023 at 6:00 PM in the Canistota City Hall Community
Room. City Council Members present: Mayor Justin Engbarth, Donovan O’Donnell, Jamie Miller, Brad Miller,
and Jessica Kerher. Others present: Finance Officer Kathy Townsend, Absent, Maintenance Supervisor Darin
Nugteren and Maintenance Assistant, Brandon Dolejsi.
Mayor Engbarth called the meeting to order at 6:01 PM
Mayor Engbarth led the Pledge of Allegiance.
The agenda was approved as presented on a motion by J. Miller, second by Kerher, all voted yes, the motion
carried.
The proceedings from the last regular Council meeting were approved on a motion by Kerher, second by J. Miller,
all voted yes, the motion carried.
Mayor Engbarth received a report from Fire Chief Richarz prior to the meeting; the Fire Department had
responded to one fire call and one rescue call in December. The report was approved as presented by Mayor
Engbarth on a motion by Kerher, seconded O’Donnell, all voted yes, the motion carried.
There was no report from the Sheriff’s Office.
Kerher gave an update from the Canistota Development Corporation; They discussed various ways to aid the
community with junk removal, bringing more traffic and businesses to Main Street and developing property in
Canistota. The report was approved on a motion by O’Donnell, second by B. Miller, all voted yes, the motion
carried.
Because of snow removal and keeping streets open, Nugteren and Dolejsi were not able to attend the meeting or to
submit a maintenance report.
The following bills were approved for payment, including paying the following invoices upon receipt that have
been delayed due to the winter storm: Golden West, New Century Press, Northwestern Energy, and Xcel Energy
on a motion by B. Miller, seconded by O’Donnell, all voted yes, the motion carried.

Townsend presented the Finance Officer’s report: On a motion by Kerher, seconded by B. Miller, the date for a
City Election, if needed, will be held in conjunction with the Canistota School District, on Tuesday, April 11, 2023,
all voted yes, the motion carried. There will be one open position for a Councilperson from both Ward 1 and Ward
2. The 2023 minimum wage was acknowledged. The Finance Officer’s report was approved as presented on a
motion by Kerher, second by O’Donnell, all voted yes, the motion carried.
Council Reports:
Mayor Engbarth: A 2023 pick-up has been ordered for the City of Canistota. Delivery will be confirmed at a later
date. Kerher motioned, seconded by B. Miller to appoint Mayor Justin Lee Engbarth to act on behalf of the Council
in all legal matters, all voted yes, the motion carried. B. Miller motioned, seconded by Kerher to adopt and support
the existing Internal Controls for Compliance Requirements for the City of Canistota, all voted yes, the motion
carried. Kerher motioned, seconded by J. Miller to approve Resolution 2023-01, Conflict of Interest for Appointed
& Elected Officials for the City of Canistota, all voted yes, the motion carried. B. Miller motioned, seconded by
O’Donnell, to abate City Utility fees in the amount of $45,608.68, all voted yes, the motion carried. The Finance
Officer is instructed to pay all invoices in a timely fashion to avoid late fees and penalties on a motion by Kerher,
second by J. Miller, all voted yes, the motion carried.
B. Miller: Availability of ice skates at the skating rink was discussed.
J. Kerher had no concerns
O’Donnell had no concerns
J. Miller: Snow removal from both Main Street and sidewalks was discussed.
At 6:41 PM, a motion to enter into executive session per SDCL 1-25-2-1 was made by B. Miller, seconded by
Kerher, all voted yes, the motion carried.
Mayor Engbarth declared executive session over at 7:10 PM with the Council convening in open session.
On a motion by Kerher, seconded by J. Miller, 2023 Compensation for employees is: Maintenance Supervisor,
$24.40/Hour, Maintenance Assistant, $19.00/Hour, Finance Officer, $22.20/Hour, Mayor and Council is as
follows: Mayor, $100/Month plus $100/meeting; Council Members, $100/meeting with Council and Mayor
receiving $50/meeting for attending special meetings. Full-time employees will be compensated $50/meeting for
attending City Council meetings. Two part-time maintenance positions will be compensated: Hoiten, $16.00/Hour
and J. Nugteren, $11.75/Hour. Part-time Rubble site attendant, lifeguards and pool manager compensation will be
determined at a later date, all voted yes, the motion carried.
B. Miller motioned to adjourn the meeting at 7:13 PM, seconded by Kerher, all voted yes, the motion carried.
The next regular City Council meeting will be held at 6 PM on Monday, February 6, 2023 in the Community
Room of City Hall. NOTE 6 PM START TIME.
