City Council Proceedings
The Canistota City Council met Thursday, July 6, 2023 at 6:00 PM in the Canistota City Hall
Community Room. City Council Members present: Mayor Justin Engbarth, Donovan
O’Donnell, Jamie Miller and Lori Forsman. Jessica Kerher arrived at 6:06 PM. Others present:
Finance Officer Kathy Townsend, Maintenance Supervisor, Darin Nugteren, Maintenance
Assistant Brandon Dolejsi, Brad Sherer, Fire Chief Adam Richarz arrived at 7:15 PM.
Mayor Engbarth called the meeting to order at 6:00 PM
Mayor Engbarth led the Pledge of Allegiance.
The agenda was amended and approved as amended on a motion by O’Donnell, second by Miller to
include discussion and action on renewal of Retail (on-off sale) Malt Beverage & SD Farm Wine
License to Total Stop, all voted yes, the motion carried.
The June proceedings were approved as presented with the correction of the meeting date from July
8, 2023 to July 6, 2023 on a motion by Miller, second by O’Donnell.
No report was received from the Sheriff’s Office
Nugteren presented the planning and zoning report: Eight (8) building permits were issued in June.
Nugteren and SECOG disused placing a building on an existing concrete pad. Nugteren answered
several inquiries about the Phase 3 Improvement Project. The report was approved on a motion by
Miller, second by Kerher, all voted yes, the motion carried.
Nugteren updated the Mayor and Council on grant donations for tiles for the pickleball court and
shuffleboard court, along with using the first tranche of a grant from the State of South Dakota for
website development. The report was approved as presented on a motion by Miller, second by
O’Donnell, all voted yes, the motion carried.
Forsman motioned, second by Kerher to approve the renewal of the Retail Malt Beverage & SD
Farm Wine License to Total Stop Food Store, all voted yes, the motion carried.
No report was available from the pool manager. Family passes and guidelines for the passes were
discussed.
Citizen Concerns:
B. Sherer commented on nuisance properties. The City is working with the City code enforcement
officer along with the City attorney on several nuisance properties. With construction on 7th Ave, the
parade route for Sport Days was also discussed and clarified.
Nugteren & Dolejsi presented the June Maintenance Report: Nugteren will meet with the Code
Enforcement Officer on July 10th to review nuisance properties. Supplies for use on City Streets and
at the Ballpark have been received and utilized. The payloader has been serviced with repairs
completed. Nugteren is working on signage for several areas around the city; he is also working
closely with SD DANR on the Rubble Site Expansion/Permit. Streets have been cracked sealed with
chip sealing also completed on various streets. Nugteren will proceed with working with an
engineer to facilitate repairs on the water tower before winter. This will include repairs inside the
bowl as well as painting the outside, including a new logo. Several scenarios of replacing existing
lights at the ballpark were discussed with costs ranging from $49,000 to $148,000.00 for new poles
and lights to be installed.
Miller motioned, second by Forsman to authorize Nugteren to spend up to $50,000.00 to purchase a
truck using the State Bid, all voted yes, the motion carried. Nugteren has ordered the tiles for the
pickleball court and shuffleboard, they are currently in transit. A ribbon cutting at Stalting Park was
also discussed. The report was approved as presented on a motion by Kerher, second by O’Donnell,
all voted yes, the motion carried.
Richarz presented the report for the Volunteer Fire Department: They responded to eight fire calls
and 6 rescue calls. Their “Chase the Ace” fund raiser is still in progress. Repairs have been
completed on the tanker. The report was approved on a motion by O’Donnell, second by Kerher, all
voted yes, the motion carried.
Richarz & Sherer left the meeting at 7:20 PM

Townsend presented the Finance Officer’s report: Townsend will send reminders to Golf Cart
owners to register/license their carts with the Finance Office The license fee is $10.00 along with
proof of insurance. Restitution from a 2022 vandalism was discussed. Several complaints about
fireworks and underage drivers of all-terrain vehicles were discussed. Townsend will bring more
information to the August meeting on Firewall updates. The report was approved as presented on a
motion by Miller, second by Kerher, all voted yes, the motion carried.
Council Reports:
Mayor Engbarth: The City Attorney will prepare an amendment to City Ordinances to change the
meeting time of the Council from 7 PM to 6 PM. Web page options with costs was discussed.
Town Web has a competitive cost with hosting options to be explored. A three-year commitment is
required, Townsend will get cost estimates for annual increases before the August meeting. The
first reading of Amended Ordinance 2023-04, Addressing license for a Full-Service Restaurant
within City limits was acknowledged.
Kerher had no concerns.
O’Donnell had no concerns
Miller had no concerns
Forsman had no concerns
The next regular meeting of the Canistota City Council will be held Monday, August 7, 2023 at 6
PM in the Community Room of City Hall. All are welcome
A motion to adjourn was made by Kerher at 7:56 PM, second by Forsman, all voted yes, the motion
carried.
