COUNCIL PROCEEDINGS JOURNAL 98 JOURNAL PAGE -219- MINUTES OF THE MEETING MARCH 31, 2010 PRESIDENT SCHULMAN: So, good evening ladies and gentlemen. Welcome to Canton City Council. I see we have our regulars this evening on this beautiful spring day and with a quorum being present, the Chair calls this meeting of Canton City Council to order. Roll call vote please Madame Clerk. ROLL CALL TAKEN BY CLERK TIMBERLAKE: 10 COUNCIL MEMBERS PRESENT: (TERRY PRATER, MARY CIRELLI, JOE COLE, BILL SMUCKLER, GREG HAWK, THOMAS WEST, JAMES GRIFFIN, MARK BUTTERWORTH & BRIAN HORNER) NINE COUNCIL MEMBERS PRESENT. (DAVID DOUGHERTY, CHRIS SMITH, AND PATRICK BARTON ABSENT.) CLERK TIMBERLAKE: Nine present, Mr. President. PRESIDENT SCHULMAN: Thank you, Madame Clerk. EXCUSING MEMBERS PRESIDENT SCHULMAN: Member Prater, I will recognize a motion to excuse Members Dougherty, Barton and Smith from this evening’s meeting. MEMBER PRATER: Mr. President, I move we excuse Member Dougherty, Member Smith and Member Barton from tonight’s meeting. MEMBER CIRELLI: Seconded. PRESIDENT SCHULMAN: It’s been moved and seconded to excuse Member Dougherty, Member Barton and Member Smith from this evening’s meeting. Are there any remarks? If not Madame Clerk, roll call vote please. CLERK TIMBERLAKE: Nine yeas, Mr. President. NO REMARKS ROLL CALL 9 YEAS, 0 NAYS PRESIDENT SCHULMAN: Thank you Madame Clerk. The motion carries and those Members Dougherty, Smith and Barton are excused from this evening’s meeting. We’ll have our invocation tonight given by Ward 5 and our Leader this evening, Council Member Terry Prater. Will you please all remain standing for the Pledge of Allegiance. The special meeting of Canton City Council was held on Wednesday, March 31, 2010 at 5:30 P.M. in the Canton City Council Chamber. The roll call was taken (see above) by Clerk of Council Cynthia Timberlake. The invocation was given by Ward 5 Council Member, Terry Prater. The Pledge of Allegiance led by President Schulman. AGENDA CORRECTIONS & CHANGES PRESIDENT SCHULMAN: Thank you Leader Prater. We’re now under Agendas, agenda corrections and changes. Members of Council you’re going to be asked to suspend Rule 22A to add the 2nd Readings of COUNCIL PROCEEDINGS JOURNAL 98 JOURNAL PAGE -220- MINUTES OF THE MEETING MARCH 31, 2010 Ordinance #1. Leader. MEMBER PRATER: Mr. President I move Rule 22A be suspended to add 2nd Readings of Ordinance #1. MEMBER CIRELLI: Seconded. PRESIDENT SCHULMAN: It’s been moved and seconded to suspend Rule 22A to add Ordinance #1 to this evening’s agenda. Any remarks? Hearing none, Madame Clerk roll call vote please. And I’d like the, before you do that, I’d like the record to reflect that Council Member Smith did arrive and we appreciate you being here, so let the record reflect that please. PUBLIC HEARINGS PRESIDENT SCHULMAN: We are now under Public Hearings. We have no Public Hearings this evening. PUBLIC SPEAKS PRESIDENT SCHULMAN: We are now under Public Speaks. We have no speakers that signed up this evening. INFORMAL RESOLUTIONS PRESIDENT SCHULMAN: We’re have no Informal Resolutions. COMMUNICATIONS PRESIDENT SCHULMAN: And we have no Communications. ORDINANCES & FORMAL RESOLUTIONS FOR FIRST READING PRESIDENT SCHULMAN: We have no First Reading Ordinances. ORDINANCES & FORMAL RESOLUTIONS FOR SECOND READING PRESIDENT SCHULMAN: We’re now under Ordinances for their Second Reading which we do have. Madame Clerk, will you please read Ordinance #1. #1. (2ND RDG) ADOPTED AS AMENDED AS ORDINANCE NO. 67/2010 AN ORDINANCE AMENDING APPROPRIATION ORDINANCE NO. 1/2010 TO APPROPRIATE ADDITIONAL MONEYS NEEDED FOR THE OPERATING EXPENSES OF THE CITY OF CANTON FOR THE REMAINDER OF FISCAL YEAR 2010; AND DECLARING THE SAME TO BE AN EMERGENCY PRESIDENT SCHULMAN: Leader Prater. PRESIDENT SCHULMAN: There’s a motion to suspend the Statutory Rule for Ordinance #1. Are there any remarks under this motion? If not, roll call vote please. NO REMARKS ROLL CALL 10 YEAS, 0 NAYS CLERK TIMBERLAKE: Ten yeas, Mr. President. PRESIDENT SCHULMAN: Motion carries. You’ve heard the three readings, Leader Prater. MEMBER PRATER: Mr. President I move we adopt Ordinance #1. MEMBER CIRELLI: Seconded. PRESIDENT SCHULMAN: It’s been moved and seconded that you adopt Ordinance 1. Are there any remarks under this Ordinance, Leader? MEMBER PRATER: Mr. President I move we amend Ordinance #1 per the copy that all Council Members have in front of them. MEMBER CIRELLI: Seconded. AMENDMENT Pursuant to Rule 36, I move to amend Exhibit A to Agenda Item No. 1 as follows: (1) Add a page 4 listing the following appropriation reductions: FROM: 2211 505001 Compliance Administration Travel/Training ($4,000.00) TO: Unappropriated Balance of 2211 Community Development $4,000.00 FROM: 2215 505010 Fair Housing Travel/Training ($4,000.00) TO: Unappropriated Balance of 2215 Fair Housing $4,000.00 (2) Amend the first appropriation supplement listed on page 2 as follows: (a) Reduce the amount listed from the unappropriated COUNCIL PROCEEDINGS JOURNAL 98 JOURNAL PAGE -222- MINUTES OF THE MEETING MARCH 31, 2010 balance from $(2,841,905.23) to $(2,791,905.23). (b) Reduce the amount listed for 1001 501001 Mayor from $68,121.75 to $18,121.75. PRESIDENT SCHULMAN: It’s been moved and seconded to amend the Ordinance #1 per the copy before each Member of Council. Are there any remarks under this motion? Hearing none, by voice vote, all those in favor of the motion, signify by saying aye. Those opposed no. NO REMARKS AMENDMENT PASSED UNANIMOUSLY BY VOICE VOTE PRESIDENT SCHULMAN: The ayes have it and the motion carries. Leader Prater. MEMBER PRATER: Mr. President, I move we adopt Ordinance #1 as amended. MEMBER CIRELLI: Seconded. PRESIDENT SCHULMAN: It’s been moved and seconded to adopt Ordinance 1 as amended. So the Ordinance you’re now voting on is the Ordinance as amended per the copy before each of you. Are there any remarks under this Ordinance as amended? MAYOR HEALY: Mr. President PRESIDENT SCHULMAN: Mayor Healy. MAYOR HEALY: Yes to make sure I understand the process here, the Council will be voting on the, to add the amendment to the main budget bill. PRESIDENT SCHULMAN: That’s my understanding. Is that correct, Chairman Hawk? MEMBER HAWK: (Inaudible) PRESIDENT SCHULMAN: Yes. MAYOR HEALY: Thanks. PRESIDENT SCHULMAN: You’re welcome. Any other remarks? Member Smith do you? You look perplexed. NO REMARKS ROLL CALL: 8 YEAS, 2 NAYS (MEMBERS HAWK AND BUTTERWORTH VOTED NAY) CLERK TIMBERLAKE: Eight yeas, two nays, Mr. President. COUNCIL PROCEEDINGS JOURNAL 98 JOURNAL PAGE -223- MINUTES OF THE MEETING MARCH 31, 2010 #1 ADOPTED AS AMENDED AS ORDINANCE NO. 67/2010 PRESIDENT SCHULMAN: The motion carries and the Ordinance #1 is adopted. MEMBER HAWK: Thank you everybody for their hard work on this budget. It is greatly appreciated. We have a budget, thank you. PRESIDENT SCHULMAN: Good. Congratulations everyone and that includes the administration. ANNOUNCEMENT OF COMMITTEE MEETINGS PRESIDENT SCHULMAN: We are now under Announcement of Committee Meetings and the Committee meetings were announced at our last formal Council meeting on Monday. These Committee meetings will be held on April 5th, 2010 at 6:30. MISCELLANEOUS BUSINESS PRESIDENT SCHULMAN: We’re now under Miscellaneous Business. Is there any Miscellaneous Business?
