JAMES WOOFTER: That’s close. PRESIDENT SCHULMAN: Well, I’m sorry. JAMES WOOFTER: That’s okay. PRESIDENT SCHULMAN: I apologize. JAMES WOOFTER: I’m your neighbor, but it’s Jim Woofter, W-o-o-f-t-e-r. PRESIDENT SCHULMAN: Well, see, that’s the problem! (Laughter). Sorry Jim. JAMES WOOFTER: Well, I’m trying to sell your house for you, so... PRESIDENT SCHULMAN: Good. JAMES WOOFTER: First of all, I’d like to address the young people over here, just so you’re aware...boarding house, whatever. 1966 I get out of the Marine Corps, I go to work at Timken. There’s six boarding houses in a five block area. Timken would not have survived without those boarding houses. Those people would come in on Sunday night from West Virginia, work the full week, head back to West Virginia with their paychecks. But without the boarding houses, Timken would have been deep doodoo. PRESIDENT SCHULMAN: Before you continue, may I get your name and address please, for the record. Go ahead, sorry. JAMES WOOFTER: I’m glad I came tonight, and I’m glad I came to the early meeting. It was nice to know that if I receive a letter from our Law Department telling me to cease and desist, I can just pitch it because nobody’s going to do anything about it. I mean, I’ll do things for four to six months, illegal, because that’s what the letter says that I’m doing, but yet City Council won’t vote on the measure and they’re just going to let it ride, and I’m talking AirBnB, that’s what I’m talking about, sir. I’ve been involved in that neighborhood for forty-one years, trying to keep the neighborhood together, trying to keep the neighbors happy, kinda...trying to COUNCIL PROCEEDINGS JOURNAL 106 JOURNAL PAGE -318- MINUTES OF THE MEETING MAY 21, 2018 keep the homes kept up to date, but yet, I really shouldn’t be doing that because somebody’s going to walk in and all of a sudden have an AirBnB and do what the heck they want to do. And to me, R-1...Residential 1, is what it means, single family homes. I hope you people take this...this into consideration. It just blows my mind that you wouldn’t vote it down tonight and then next week put it back on the agenda to send it uh...whoever it’s got to go. So, I’m saying good luck to ya, and I, I hope you come up with the right decision. But my faith is...is failing. PRESIDENT SCHULMAN: Thank you sir, very much. Appreciate it. Our next speaker is Marjorie Burkhart. Ms. Burkhart, good evening, welcome to Canton City Council. If you’ll give us your name and residential address, please. MARJORIE BURKHART: First I have a copy that I’d like to pass out to everyone. PRESIDENT SCHULMAN: Sure. MAN IN AUDIENCE: Marjorie, you go ahead and do that, I’ll do that. PRESIDENT SCHULMAN: Don’t forget to give us your name and your residential address, please. MARJORIE BURKHART: My name is Marjorie Burkhart. My address is 1253 11th St. NW in Canton. I live directly across from the home at 1258 11th St. NW, which appeared as an AirBnB in the Canton Repository on April 9th, this year. We, the neighbors feel that we have been totally blind-sided. No one ever expected that and no one ever told us about that. I am here this evening, representing fifty-seven people in the Westpark neighborhood who have signed a petition requesting the R-1a zone for single family residences be upheld. That no business be allowed to supercede this ordinance, meaning no exceptions allowed. I have presented this petition to our future chairman of the Judiciary Committee, John Mariol, this evening, of which you all have received a copy now. We are asking each of you, as our representatives in Canton, on the City Council here, to support us on this issue as we strongly believe that the single family residences contribute to the stability in our city. I’ve heard prior to this that you want the city the best, this family residential area is very important for that because we financially pay our taxes, we help with our jobs, we help one another in our communities, and we also support and contribute to our community organizations. Therefore, please retain the zone R-1a as single family residences with no business and no exceptions in our Westpark neighborhood. We appreciate the respect and support in this manner, and I thank you. Having listened to the committee meeting, some of you have no experience with what goes on in these said places. AirBnB is a rooming house. It’s definitely a rooming house. They rent it to people for transient situations as well as I have personally experienced, they rent it for long-term experiences. I know for a fact that least (Inaudible), I know for fact the person was paying that, okay? Here, we see out of state license plates. We see all kinds of things and we are also concerned that our children are at risk and our families are at risk, not knowing who comes in and out of this city. We already have had solicitors, we’ve already had um...drug situations, break-ins in our very block. I was one whose home was bought...broken into. And so, we have great concern for this. Basically, people come in from out of town, they own the homes, and they are not people who have contributed to the city for years, such as the neighbors who have signed these petitions have lived here years and are very concerned for the transition. I live at 1245 11th St. NW in Canton. I have a question. I wasn’t here earlier, I was told that you talked about what zoning you’re allowed to have and what you’re not. No place can I find exactly how single family zoning is defined, other than “single family zoning.” It doesn’t say what you’re allowed, it doesn’t say what you’re not allowed. I’d like to have that explained. Thank you. PRESIDENT SCHULMAN: Sorry, sir? DON JOLIAT: I would like to have that explained, what the...just exactly what you’re allowed to do, what you’re not allowed to do in single family zoning. Whereas, Graduating from Minerva High School, Edmond James Mack went on to receive his undergraduate degree from Kent State University cum laude with a Bachelor of Arts in philosophy and history. He received his law degree from the University of Akron School of Law cum laude, and was admitted to the Bar in 2007; and Whereas, Recognized for his work in civil litigation and oral advocacy, Edmond is currently a partner with the law firm of Tzangas Plakas Mannos Ltd. where he has successfully represented corporations, municipalities and individuals in a wide range of disputes; and Whereas, Edmond’s outstanding achievements include being recognized as an Ohio Rising Star for the years 2010 through 2018 by Super Lawyers Rating Service, receiving a 10.0 Top Attorney rating from Avvo Legal Services, and being recognized by the Canton Regional Chamber of Commerce ystark! and the Canton Repository as one of Stark County’s Top Twenty Under Forty Young Professionals for 2014; and Whereas, Edmond’s civic excellence is also reflected through his service on the Board of Trustees of the Stark County District Library and the Stark County Association for Justice. He is also a member of the Ohio Association of Justice, the Stark County, Akron, Ohio and American Bar Associations, the Kent State University Alumni Board, the NAACP and the Ohio ACLU; and Whereas, in January 2012 Edmond took office as Canton City Councilman for Ward 8 where his dedicated public service continued. Edmond was instrumental in the creation of the DORA and medical marijuana legislation, as well as the lighting project in the Santa Clara neighborhood, the Gervasi trailhead, Market Square development, and the Comprehensive Plan. He was also a strong proponent of the Issue 13 income tax initiative. During his Council tenure, Edmond served as Chairman of the Judiciary Committee and active member of the Comprehensive Plan Steering Committee, and Whereas, Edmond is currently engaged to marry Miss Julie Jakmides on July 7, 2018, and is the proud parent of daughter, Isabella. Now Therefore Be It Resolved: That we, the Members of Canton City Council, do hereby honor and commend Councilman Edmond James Mack for his commitment and devotion to public service, his contributions to the legal profession, and his outstanding accomplishments on behalf of the greater Canton community. He did many, many legal things to assist the city that were not a part of his job as a Councilman. I thank him for his work and dedication to his Ward, and the City Council as Judiciary Chairman, and I especially thank him for his work from day one on the Comprehensive Plan. He’s been a member of our Steering Committee. He will be difficult to replace, but we will need someone from City Council to replace him. He worked diligently on the ballot language and on other legal issues associated with Issue 13, as well as being a strong supporter. I look forward to calling upon you and asking you, as a citizen- neighbor, to come back and help us with our many needs and I truly appreciate all of your work. Thank you. (Applause). And when I was appointed, then Chairman, Randy Gonzalez, told me he would recommend reaching out to Edmond Mack, a young person that might be good to team up with. And from that point we have been a team. And usually, I know I don’t say this, if one of us is supporting something, you’re probably going to get the other one. Over these six years, and this is something that has been really exciting, especially with the Issue 13, this Council, six years ago, there was no Onesto, no Hercules, no DORA, no Market Square plans, no Issue 13, and Edmond and I have talked about this, being young, working with all of you, um...t’s been amazing, what’s been accomplished. And, from my standpoint, Edmond has been such a vital part of that, because of your legal expertise, your commitment, you know, uh...a lot of those things happened or were as big of an impact because of your service. So, I can say, very confidently, that Ward 8 has probably never had a finer Councilman and I’ve never had a finer friend, so, it’s been a pleasure serving with you and I wish you the best.
