JOSEPH FISHER: Yeah, I just need to speak a bit louder. Is that it? PRESIDENT SHERER: No. JOSEPH FISHER: No? PRESIDENT SHERER: Well, we’ll just double check to make sure it’s on. JOSEPH FISHER: It says on. PRESIDENT SHERER: Okay. Good deal. Thank… thank you, Mr. Fisher. JOSEPH FISHER: Yep. I’d like to start out by saying… uh, after following the multiple letters in the mail I have gotten from the Mayor’s Office stating that the investigation over May 29th and the events that followed suit that night are under investigation, and I… that was about roughly two and a half weeks ago, I assume, that was both signed by Safety Director Perry and certified by the Mayor’s Office. I’d like to question on why has it taken this long even though Safety Director Perry and her office have already looked through the footage and have certified it to go through to the Mayor’s Office. As well I also question what has been included inside this investigation. Has there been any reviews of any police officer’s body camera footage who… who was there on that scene as well as any dash cam footage or local security cameras that… that were either on our numerous traffic lights and/or store fronts from areas in… uh, and around where the actions that happened on May 29th took place. I want to see all these inside the final result, as taking one side would obviously seem pretty bad to anybody who wants to see this investigation finished. So I… I question what has been and what will be investigated to the fullest extent by the Mayor’s Office that is not just the people who were arrested that night, but everything on the police officer’s side. We know that militarized vehicles that were capable of shooting off tear gas and rubber projectiles, as well as bear mace, by the police officers were used that nice… that night against protesters who… uh, for failure to disperse and which is directly against the Canton Police Department Code, and so I do question on what will be inside this investigation and how it will resolve. Thank you. I yield back the rest of my time. PRESIDENT SHERER: Thank you, Mr. Fisher. Our next speaker is Skylark Bruce. Ms. Bruce, could you please step forward and give us your name and residential address, please. SKYLARK BRUCE: My name is Skylark Bruce. I live at 1242 Worley Ave NW. Before I speak further, I wanted to hold space to remember the tragic deaths of Ace Lucas, Brandon Bush and Ronald Pleasant. All violence is connected. On July 15th an assortment of Canton City Council Members met with me and other members of the public who are concerned about accountability for the Canton City Police Department. I was at that meeting, Council Members passed the buck entirely to the Mayor and Police Chief. Those Council Members would not make any statements for or against any proposed changes, such as the 8 Can’t Wait measures or opening the complaints and disciplinary records of all officers. It seemed more like an opportunity for certain Council Members to lecture and posit hypothetical situations rather than to address the very real situations that have happened and continue to happen. Accountability and transparency did not attend that COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 306 MINUTES OF THE MEETING JULY 27, 2020 meeting. I hope they are present here tonight. Ultimately, I don’t care how much of my time and their time that city officials want to waste. That’s inconsequential since my motivation is to make my city safer for black people when it comes to police brutality. If we do that, the rest doesn’t matter. Public Speaks Rules indicate I should address my remarks to the Council President. Council President, would you pass a message to Mayor Bernabei, to Chief Angelo. The City can provide justice for the families of Ja’Ron Nero, Darryl Ross and Shawn Pirolozzi after their lives ended at the hands of Canton police. The City can respond in a timely fashion and implement important changes to police department policy and accountability. The City can fire and institute disciplinary action against officers who violate existing policy. The City can stand up to the police union and let them know that Ohio is a right to work state. The City can provide timely answers into the investigation into the police attacking peaceful protesters and bystanders on May 29th. The City can value the lives of black citizens. When I said all violence is connected, that also means street violence is connected to police brutality. When the police department notices they aren’t getting much help in solving crimes in an area, they must pursue change in the department to forge new trust in the community. Attacks, beatings and murders by cops don’t build public trust. When the higher ups get out of the way, some of the time, for one officer who wants to build trust, it is not nearly enough. One officers out of more than 150 is not nearly enough. Council Members can push for so much more. Arcel Lucas is the surviving black baby who was shot last week. Arcel deserves a future. Thank you. PRESIDENT SHERER: Thank you, Ms. Bruce. (Applause) Our next speaker is Brianne Grillon. Hopefully I got that right. BRIANNA GRILLON: Brianna. PRESIDENT SHERER: Brianna, sorry. BRIANNA GRILLON: That’s okay. PRESIDENT SHERER: Miss… could you please state your name and residential address, please. BRIANNA GRILLON: It’s Brianna Grillon, 1642 Cedarcrest Ave SW, Massillon, Ohio 44646. January 16, 2018, (inaudible) recklessly and with complete disregard for human life went left of center crossing double yellow lines striking me head on causing the man following close behind me to crash into me as well. I was simultaneously struck by two trucks driven by irresponsible men who killed my son, Zayne Paulik, on impact, rupturing his brain, severing his spine to the point of internal decapitation, leaving zero chance of survival for… for my first and only born son. Officer Wells, supposed lead crash scene investigator for CPD, was the responding officer at the scene of the crime. Wells didn’t choose to come from a place of humanity or helpfulness. Instead he chose what I feel an insensitive sexist route where he singled out the only female who was seriously injured and frantic over the wellbeing of her children. He chose to torment and accuse me of driving under the influence. Instead of flagging down the EMS and assisting, he followed me around demanding a sobriety test while they loaded by dead child into the ambulance. The Canton EMT made extremely callous and off putting decisions as well. He chose not to place Zayne on a spinal board or stretcher, but picked him up in a cradled position and carried him into the ambulance. Did not inquire about the status of my two year old daughter or myself one time. Also repeatedly telling me to shut the fuck up the entire way to the hospital because of my crying. Only to be met at Mercy by the most judgmental cruel nurses and doctors I COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 307 MINUTES OF THE MEETING JULY 27, 2020 could have dealt with in my greatest time of need. Then to be cornered in a room half unconscious from head trauma by two of Canton’s finest chauvinistic henchmen who continued with accusations and threatening to withhold my children until I submitted a urine sample, then went across the hall and treated the perpetrator like a god. It’s all recorded on their body cams which, surprisingly, they had turned on that night. I want to know why my family wasn’t deserving of basic… the basic level of care from any of the first responders. Canton made a mockery of my children’s lives and the one who raises them, me. They disregarded my son’s life as if he was human garbage and his family left behind was collateral damage. The struggle and psychological trauma I’ve endured in this building will have lifelong effects on me and my daughter. Not one of them care, which is why I will be here at every meeting spotlighting the corruption along with unfair prejudice and partiality they exhibited from the very start. How was I told by numerous Canton attorneys and the prosecutor the City was more thirsty to serve justice for a slain police dog than a living breathing child. You’re showing your priorities, Canton, and quite frankly, your ass. As told by Jason Reese, he admitted I was profiled from the start, and the big bad police didn’t like something about me, whether it was my hair, voice or the way I was dressed. He wasn’t sure, but I know it’s because I’m a woman of strength and confidence. Would I have had to lose both children or my own life for it to matter to you… to you desensitized people in power? Tell me how could that irresponsible overgrown man child cause the crash, which was determined by CPD twice over and the State Highway Patrol, walk away with not one charge, not one point on his driving record? How? Don’t tell me classism, gender bias and white privilege don’t exist inside these walls because I’m living, breathing proof that it does. (Applause) PRESIDENT SHERER: Thank you, Ms. Grillon. Our next speaker is Melanie Welsh. UNIDENTIFIED VOICE: They won’t let her in. SECOND UNIDENTIFIED VOICE: No, she’s outside. They won’t let her in. PRESIDENT SHERER: Okay. Well, why don’t we keep the meeting moving, and if Ms. Welsh comes in, we’ll give her a chance to speak. Our next speaker is Curstynn Marks. Ms. Marks, could you please step forward and give us your name and residential address, please. CURSTYNN MARKS: Curstynn Marks, 1211 Bordner Ave SW, Canton, Ohio 44710. I come here today to COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 308 MINUTES OF THE MEETING JULY 27, 2020 talk about the same issues I talked about two weeks ago. We learned that the City Council, members itself, individually can openly support the 8 Can’t Wait campaign. When we asked if City Council Members endorsed it, they said they needed more time to look at the policies. It’s been two weeks. I ask you, and so does the rest of the public, do you support the 8 Can’t Wait policies? I talked to the Mayor and he said it was in the works, not to be waiting around to see if things change within the upcoming weeks. It’s been two weeks. What changes are we seeing, Mayor? We are here for change and we are here to ask the City Council to put pressure on the Administration because as City Council Members, you represent the public voices. That is your purpose. So when concerns are brought amongst you from the public, we want you to put pressure on the Administration to make change or the 8 Can’t Wait. Because we feel five out of the eight of the basic minimum standards are expected across the country on the use of policy. So it’s been two weeks and we just want an answer as to what City Council believes on policy reform, on protecting their own community. Another point we talked about is why crime was a thing and multiple members said that was the most focus from the public, but yet failed to recognize that the reason crime exists is because of food insecurity, because of homelessness, because of poverty, because of lack of resources, and you see with the crimes and the violence that’s been happening in our communities, that the only way to effectively prevent that is not more policing, and is providing more funding which the City Council has the power to do to put it into programs to better the community. To prevent violence, we have to be proactive rather than reacting. And that is why I’m here to talk to City Council today, because I am not the only one that is tired of things not changing in Canton. Canton should be a place where people want to grow and thrive, and that can only be possible if the City uses its budget to actually… for community advancement and to lift us out of poverty and out of lack of education and lack of resources. And that’s the only way we’ll actually better the community. That’s why I ask here for you all today, endorse 8 Can’t Wait and encourage funding for actual community programs rather than more funding to go into policing and more funding that goes into tourism. So our next spek… speaker is Ashley Green. Ms. Green, could you please step forward and give us your name and residential address, please. ASHLEY GREEN: My name is Ashley Green, 1627 Bonnot Pl NE, Canton. Tonight I wanted to speak on a little bit about what should happen in our city. Our people and our children are dying. Our young people are at war with each other and violence is on the rise. We have been asked time and time again why we don’t have programs for our children to keep them off the streets and doing the right things. There is no reason that, even with COVID, we can’t have things for your young adults and children to do. Our libraries are closed and our libraries provide valuable programs for our community. The City has enough in the budget to make programs readily available to our community. It also has the funds that are needed to provide a safe space considering CDC recommendation for COVID, just like the bars and restaurants do. There is no reason that our children and young adults should feel there is nothing better to do than commit murders and crimes and run the streets. Reser… research shows that in a city of 100,000, each new non-profit community organization lead to a 1.2% drop in the homicide rate, a 1% reduction in the violent crime rate and a 0.7% reduction in the property crime rate. However, these organizations have little to no funding. And what about the drug wars and drugs on the streets, the problems with those? What about affordable programs for those who need it? We have more than enough funding to help those as well. Private substance abu… abuse treatment programs can cost tens of thousands of dollars a year, making free or low cost services from community based non-profits the only realistic way for many people to receive treatment. But here in Canton, those programs are limited. Instead of COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 309 MINUTES OF THE MEETING JULY 27, 2020 helping people, we are incarcerating people for drug use instead of using the community policing policies that are to our disposal and hoping get them treatment at a place of their choice. Too often incarceration has been used as a solution for drug abuse issues and a substitute for treatment. Nearly 40% of the U.S. prison population or 576,000 people are behind bars for little or no public safety reason. That is unacceptable. I know we may not be able to change the whole U.S., but we can start right here with Canton. We can raise the bar for other cities across the nation. For too long the stereotype for Canton is that we are one of the worst smallest cities in the U.S. for crime and homicides and other issues. We must stand with the people. Instead of… instead of spending millions of dollars on a resort for the Hall of Fame and bringing tourists to our city, we should be fixing our city. Why would you want to bring people to a city that’s broken, a city where most individuals can’t even afford to stay at such a resort or a hotel? Why bring people to our city to see shootings every day and crime, abandoned houses and abandoned communities? We need to do things for our people in our city and not worry about bringing others in until we as Canton are okay. When we can provide for own people, then we can provide for others. PRESIDENT SHERER: And you have three minutes. Thank you. MELANIE WELSH: Thank you. Bear with me, I did not practice. PRESIDENT SHERER: That’s okay. MELANIE WELSH: Okay, so qualified muni… uh, immunity is a legal doctrine in the United States Federal law which shields the government officials from being held personally liability… personally liable for discretionary actions performed within their officinal… official capacity unless their actions violate clearly established Federal law, even if their victim civil rights were violated. Uh, it is a form of so… sovereign immunity, sorry, less strict than absolute immunity, that is intended to protect offi… protect officials who make reasonable but mistaken judgments upon legal questions extending to all officials, but plainly incompetent to those knowingly violating the law. Qualified immunity applies only to government officials in civil litigation and does not protect the government itself from suits arising from official actions. Um, I’m going to give you guys a copy of this because I’m going to come back at the next meeting and I want to know your opinions on the qualified immunity act. Um, another thing is, it’s ti… it’s time to start put… stop putting these cops above the law and start holding them accountable. The system is designed to reward the bad cops currently. A good cop would have no problem supporting ending the qualified immunity act. Police departments need a disciplinary data base that is accessible not only to the police departments, but also the public, which OCC has been working on. We have the right to know who is serving and protecting us. Because if it came out of their pocket, they’d be a little more careful, because right now when a lawsuit happens, it comes out of our tax dollars. We have to pay for that. That’s not acceptable. If my nurse husband has to carry an insurance, so should a cop. And then when something happens, it goes up. They don’t want to screw up then. The… I mean that’s pretty much it. Um, I’m here today to speak on a few different topics. I first want to recognize the families who lost members over the last week here in Canton. Um, I really want to speak on, you know, where our money in Canton is going. Um, I have a huge issue with all the money that’s going into the tourism here. Um, our… our people are at war and it’s because we don’t trust our system because it’s not built to bill… to build us, it’s built to break us down and it’s proven time and time again here in Canton that our community has very little to no trust in our police department because of the repeated brutality that happens here in our sys… in our city. Um, so how are we gonna change our sys… our system so that we can gain trust from our community and so that our community can gain trust in our… our police department? Um, so that crimes like what has happened over the last week gets solved a lot quicker. I feel as though if there is more trust within… um, you know, and more com… like community outreach is so huge and there’s not enough of it. Our police do not do their job afterwards, you know, after taking, you know, a police report. Back in the day, you used to get a pamphlet for the trauma that you experienced, you used to get resources, and there’s none of that anymore. So how are we go… how… how do we expect these victims who are experiencing these… this trauma to… to continue life afterwards and not have any, you know, idea where to go, what to do, who to speak to. What are we gonna do for our people so that they have resources after these… after these incidents? What are we gonna do for our people so that these incidents stop? How are we gonna get our youth invested in something that’s gonna direct them towards college, direct them towards COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 311 MINUTES OF THE MEETING JULY 27, 2020 owning a business, direct them towards something other than violence because that is a huge issue. We do not have enough for our people to do here in the City. We do not have enough activities, we don’t have enough entertainment, we don’t have enough education. There should be aquariums for our kids to go to. There should be way more than just basketball and the few community centers that we do have. We need swimming pools. We need centers so that these kids can start getting off of the streets so that… we need something for them to… to direct their money when they are working so that they’re not purchasing drugs, to… to use themself or resell in our community. We need something for our youth to do, we need trust within our community, and my question for you is what are… what is Canton gonna do for our youth and for our people? How can we stop the violence and bring trust into our community and into our police department? Thank you. (Applause) PRESIDENT SHERER: Thank you, Ms. Mason. Our next speaker is Brenden Perez. Mr. Perez, could you please step forward and give us your name and residential address, please. BRENDEN PEREZ: My name is Brenden Perez and my address is 621 Market Ave NE, Canton, Ohio 44702. Um, you know, my name is Brenden Perez. Uh, I’m a pro black pro… uh, protester, mostly starting a blog that’s gonna talk about that as well as a lot of issues internationally and local in the community. Um, so a couple weeks ago I attended an event that was scheduled by Kylee Cheatwood, Jaylynn and Sarah, my friends. Uh, Corey Minor Smith was at that event and was a speaker there. Um, each of the ten or so speakers had an opportunity to have open dialogue in individual groups about social changes we can each make in the community locally. Um, so I was in a group with Sandy Womack. Some of you might know him, he’s a prin… he was a principal all around the community in… uh, in different communities as well, Cleveland, everywhere. Um, so one of the problems that I think we face culturally, locally and internationally is trust in police officers. You’ve heard it already tonight. It’s… it’s a big theme right now. Um, it’s hard for our community to… to trust police officers to handle problems when it seems like a lot of times they’re escalating them. Um, so specifically though that problem is bigger in the black community. Um, with situations like Tamir Rice, George Floyd and Eric Garner, just to name a few, the police were called, and the police job is to protect and serve, if I’m not mistaken, and… and I don’t know about you, but it… it didn’t seem to me like they did much protecting or serving in that situation. Um, I… uh, on top of trust issues within the community and after seeing how peop… uh, people of color are being treated by police, a second issue that we have in the community is accountability, because when police officers are making mistakes in the commun… in local communities internationally, it seems like we have a hard time holding them accountable for some reason. And to be honest, I think situations like this is… is a part of the problem. We need to be more vocal in the community and call out and that’s what we’re trying to do right now with protesting. Um, so Breonna Taylor is a perfect example of that. You know, her… you know, police broke in unjustly, they murdered her and they’re… we’re still asking for justice and at this point we’re begging. Um, so it’s understood that pea… you know, police are supposed to act off evidence, so how can we expect the community to… to trust police after there’s been so evidence to the contrary that we don’t… they don’t deserve our trust. Um, so my first question is like, is there anybody… anything that you want to say to that community in specific that doesn’t trust the police? And also the lack of… I’m not gonna say anybody’s name here, but there’s somebody in specific that I would like to say their name… um, the lack of haste in regards to the May 29th investigation is very disheartening, in my opinion. In my mind, there… there needs to be some more… some more accountability had and it’s taking too long. Um, so, you know, you guys are elected officials and that’s why we’re coming to you today to hope that you can speed along this protest as well as provide us some answers going forward. COUNCIL PROCEEDINGS JOURNAL 108 JOURNAL PAGE 312 MINUTES OF THE MEETING JULY 27, 2020 PRESIDENT SHERER: Thank you, Mr. Perez. So earlier I heard you all was voting, and what’s the difference, like 49,000 or 41,000 you all was talking about investing in the Detective Bureau? That correct? PRESIDENT SHERER: Um, I believe, yes. Yes, continue on. JASPER ROBINSON: Okay, so you all talking about putting this money in the Detective Bureau, but in the Constitution, right, we have a right to gather and I’m saying protest, right. And it just so happens that we’re gathering and protesting against police brutality, and so when the police come out there and we’re protesting and no one’s doing anything to them until they come out provoking and bring the truck out and wanna hit people with, you know, the tear gas and stuff like that. How do you think that makes us feel that when we are protesting about the police brutality and things that need to change within that system, but you turn around and want to give these people $49,000.00. You don’t think that’s a smack in our face that you want to give them $49,000.00 but they’re not there to protect us? We’re still citizens. Just because we’re protesting against the system that they’re upholding, don’t make us any less of a citizen anywhere. You see what I’m saying? So that’s wrong right there. That’s a smack in our face. I’m gonna let you know that right now. Second, by now the Mayor and the Chief of Police, like everybody else, knows what’s going on. How come they haven’t just come forth and adopted a policy of not hiring anybody with police brutality on their record? And also bringing in the policy that they will allow or put in a jacket for them to have this investigation on their rap sheet if they was to step down or resign, so then that way they can’t be fired, so this kind of investigation can go on their rap sheet and go inside of a data bank that we can use universally and can be used all… at least all over Ohio so these kind of cops don’t get hired in Ohio period. There should be something here that they should be doing right now instead of just sitting up here, you know, just looking around. Sitting out here meeting with people during the whole time of protesting, shaking hands, kneeling, faking like they showing some love, like they really want to be with us, but their showing nothing. They’re giving us absolutely positively nothing, but again, you want to give these people $49,000.00. I don’t understand that. That’s a smack directly in our face. And instead of trying to give our people some kind of real resources… cause I remember back in the day, Cherry was a predominant spot, a lot of black people had a lot of businesses over there, and then Route 30 came which directed a lot of traffic from over there. And so a lot of those black businesses went down. And that right there was a resource changer, when you taking traffic away from that. You all didn’t think about that when you all took that traffic, but you all did. So what we need now is a way to get our resources back up, so then now we can hire our youth and put them in positions of having jobs that benefit them more than what McDonalds is gonna give us because they ain’t trying to give us nothing, let alone hire us in there if I got locks or some tattoos, you see what I’m saying? Luckily I own my own business, and yes, I’m out here trying to teach others to own their own business as well, but by the same token, you all need to step up and do some help around here because they’re trying to give some people $49,000.00 and they sitting here tear gassing some citizens for protesting. Why is it taking so long to make the changes in our community that everybody else around the world and in other states are making as far as defunding our police, which will also give other programs to our… our youth if we’re able to do that to get the youth out of our streets, so we can stop the violence that’s happening in our… in our community which the police aren’t helping at all. Also, my question I want answered while I’m here on this podium with the next two and half minutes I have… excuse me, I’m getting (inaudible) shook. I want to know why the hell it took so long… it took a half hour for responders to come to the shooting last time. The last people that took three men’s lives, in… including a baby, why did it take so long for police… why did the police get there before the ambulance did? Why did the police have to go… call the ambulance? Why do… why does the ambulance come quicker to the suburbs before it comes to the hood? Why? Why isn’t there… why isn’t there protocols being set in… in place and nobody’s doing nothing about it? Nobody’s doing nothing. Also, while I’m thinking about it, since you just… since you guys just made everybody’s vests somewhat visible with the (inaudible) um… public records so we can see who’s getting written up, which by the way, after 2017 everybody’s blanking their names out, so we can’t see who’s violating the… the… the policy. We can’t see who’s violating the policy now because you guys are hiding from us. We need to have a community review board for our community so we stop having these racist ass… excuse me. So we can stop having these people that are not for our community and our people in our community messing with our kids. How do we expect to stop the violence if we’re not giving the youth anything to work with? How? How? You guys aren’t worried about your babies? I’m worried about my daughter. I’m worried about my son. My husband is black. My stepdaughter is black. I have bi-racial family everywhere. I have to worry about it because I get… I get targeted for what I stand for because I absolutely refuse for people of color to continue to be treated how they be treated in our… in our community, point blank period. And we need to make a change. It starts with today. And I want to know, is… um, hold on, Vincent Roman, is he still on the force? Vincent Roman, can anybody answer me that?
